Adoption, kafala and child fostering are not interchangeable in the UAE. UAE official guidance states that adoption is not allowed under the domestic framework, while eligible Emiratis may embrace and raise a child of unknown parentage subject to legal conditions. Federal Decree-Law No. 24 of 2022 regulates children of unknown parentage and foster-family custody.
Mr AlBalooshi assists families with UAE fostering eligibility, custody documentation, a foreign adoption’s UAE implications and cross-border care arrangements. Use the inquiry form to upload the child’s current order, foreign adoption record and identity documents, or WhatsApp +971 50 627 5196.
The correct legal term determines the available rights
People often use “adoption” for several different arrangements:
- full adoption under a foreign country’s law;
- kafala or a guardianship-based care arrangement;
- UAE foster-family custody of a child of unknown parentage;
- ordinary custody by a relative after parental death or incapacity;
- temporary placement by a child-protection authority; or
- sponsorship of a child’s residence without transfer of parentage.
Each creates different consequences for lineage, surname, inheritance, nationality, maintenance, guardianship, travel and the authority to make decisions. Before filing, identify the legal instrument that already exists and the result required in the UAE.
UAE fostering does not replace the child’s legal lineage
Federal Decree-Law No. 24 of 2022 establishes a protective framework for a child whose parents are unknown. It regulates custody by a foster family or foster woman, authority oversight and the child’s care and rights.
Fostering provides a family environment without creating a false biological relationship. The child’s identity, dignity and official records must be handled through the competent authority. A foster carer should not independently change a child’s lineage, invent parentage or use an informal surname arrangement.
The distinction affects inheritance and marital prohibitions as well as documents. A family should obtain advice on lawful gifts, wills, guardianship and financial planning rather than assume every consequence of biological parenthood follows.
Applications go to the competent ministry or local authority
The 2022 law provides that a family seeking custody of a child of unknown parentage submits an application to the Ministry or local authority. The authority assesses eligibility and the child’s placement under the statutory framework.
In Dubai, the Community Development Authority publishes a foster-child service for Emirati citizens. Other emirates may use their competent social authority. The current service channel, documents and waiting process should be confirmed directly because administrative requirements can change.
Do not arrange a private transfer of a child between families. A hospital, intermediary or individual cannot replace lawful registration, protection assessment and placement by the competent body.
Eligibility is statutory and requires official assessment
Federal Decree-Law No. 24 of 2022 contains conditions for a foster family and a foster woman. UAE Government guidance describes the service as available to eligible Emiratis under specified terms. The authority can examine matters including nationality, religion, family status, age, capacity, health, conduct, housing and ability to care, as applicable under the law.
Applicants should prepare complete and accurate records such as:
- Emirates IDs and family book information;
- marriage-status documents;
- income and housing evidence;
- health certificates;
- good-conduct or security records where requested;
- family composition;
- reasons and care plan; and
- consent or declarations required by the authority.
No website should promise eligibility or placement. The competent authority applies current law and assesses the child’s interests.
The child’s interests remain the central consideration
Federal Law No. 3 of 2016 on Child Rights, as amended states that the natural family is the first and best environment and that an alternative family may be used when necessary. It gives priority to the child’s best interests and recognises alternative care through a foster family or social-welfare institution.
An assessment may consider the child’s age, health, development, sibling relationships, stability, attachment and cultural or religious needs. The foster family’s ability to provide safe, continuous care and cooperate with official supervision is important.
Applicants should approach the process as a long-term child-protection responsibility, not a private entitlement to select a child.
Authority supervision continues after placement
Foster placement is governed by law and oversight. The competent authority may require home visits, reports, health and education records, notice of changes and cooperation with specialists. Conditions can regulate travel, residence, contact, confidentiality and the family’s continuing suitability.
Keep a secure file containing:
- placement and custody decisions;
- identity and health records;
- school reports;
- authority correspondence;
- travel permissions;
- expenses and benefits; and
- any incident or safeguarding report.
Notify the authority of a material change such as divorce, death, serious illness, criminal investigation, relocation or inability to continue care. Do not wait until the child faces disruption.
A foreign adoption order does not automatically create UAE parentage
Expatriate families may arrive with an adoption valid in another country. The UAE treatment of the order can depend on the family’s legal regime, nationality, religion, the foreign court’s jurisdiction, public order and the particular administrative purpose.
Recognition for one purpose, such as presenting a residence application, should not be assumed to establish inheritance or parentage for every UAE purpose. Obtain advice on the adoption judgment, amended birth certificate, parental-consent record and finality.
Do not describe the foreign order as void or automatically recognised without case-specific analysis. The correct question is what effect the competent UAE court or authority can give it for the requested outcome.
Recognition of foreign judgments needs formal documents
Federal Decree-Law No. 42 of 2022 sets conditions for recognition and enforcement of foreign judgments onshore, subject to treaties and the nature of the order. Family-status decisions may require careful public-order and jurisdiction analysis.
Prepare:
- the sealed adoption or guardianship judgment;
- proof it is final and enforceable;
- evidence of lawful service and parental consent;
- the original birth certificate and any amended certificate;
- passports and nationality evidence;
- certified translation; and
- attestation or apostille analysis.
Ministry of Foreign Affairs attestation confirms document formalities. It does not guarantee substantive recognition or create UAE nationality.
Residence sponsorship is not the same as adoption
Immigration permission allows a child to reside in the UAE under a particular sponsor and category. It does not by itself create parentage, guardianship or inheritance rights. A foreign adopted child may require case-specific documentation from immigration and the issuing country.
Before travel, confirm the child’s passport, entry permission, sponsor, custody authority and the consent needed to leave the country of origin. Airlines and border authorities may request documents beyond the UAE residence approval.
Avoid inconsistent descriptions of the relationship across visa, school, health and court records. If the lawful terminology differs between countries, provide the underlying order and certified explanation.
Travel with a fostered or adopted child requires written authority
The carer should not assume that physical custody authorises international travel. Review the placement decision, guardian’s powers, authority approval, passport custody and destination requirements.
A travel file may need:
- the child’s passport and residence status;
- foster or guardianship order;
- competent-authority travel consent;
- parental consent under the foreign adoption route where applicable;
- itinerary and return date;
- destination visa; and
- emergency medical authority.
International relocation may require a new assessment. Do not move the child first and ask the UAE authority to regularise the arrangement later.
Inheritance planning should be deliberate and lawful
Fostering does not automatically reproduce every inheritance consequence of biological parentage. Families can ask Mr AlBalooshi about wills, gifts, beneficiary nominations, guardianship and asset structures that are lawful under the applicable succession regime.
Do not use an inaccurate birth certificate or fabricated parentage to secure inheritance. A lawful plan should identify the child correctly, respect mandatory rules and account for assets in different jurisdictions.
Foreign adoption may affect inheritance abroad while receiving different treatment in the UAE. Coordinate the estate plan across relevant countries.
Names, birth records and privacy must be protected
Federal child-rights law protects the child’s name, birth registration, parentage under applicable law and privacy. Records concerning unknown parentage and placement are sensitive.
Use only names and details authorised by the competent authority. Do not post the child’s history, hospital information or placement story on social media. Schools and healthcare providers should receive only the records needed to care for the child.
The child’s origins should be handled with age-appropriate professional support. Disclosure decisions should prioritise dignity and psychological welfare, not adult curiosity or online attention.
Existing relatives and ordinary guardianship require another route
A child living with grandparents, an aunt or an older sibling after a parent’s death is not necessarily a child of unknown parentage. The family may need custody, guardianship, maintenance, inheritance or travel orders under the Personal Status Law.
Likewise, a step-parent’s daily care does not automatically become adoption or guardianship. The biological parents’ rights, existing judgments and child’s safety must be addressed.
Using the unknown-parentage framework for a known family relationship can create incorrect records and delay the proper application.
International kafala arrangements need country-by-country advice
A kafala or guardianship decision issued abroad may not be treated as full adoption in another country. Immigration, citizenship and parental-responsibility rules vary widely. The receiving country may require its own recognition, suitability assessment or immigration category.
Verify whether the origin country permits departure, what ongoing supervision applies and whether the arrangement can be recognised in the UAE. Official treaty status should also be checked where intercountry adoption instruments are raised; participation in one convention should never be assumed to determine a kafala case.
Coordinate advice before committing to travel, fees or a private intermediary. Child placement is a regulated protective process, not a commercial transaction.
Warning signs in private adoption offers
Seek immediate advice if anyone offers to arrange a child in exchange for money, bypass an authority, create a false birth certificate, conceal known parents or guarantee a passport. Preserve communications and do not transfer funds or take custody.
Possible trafficking, sale, exploitation or document fraud requires competent-authority attention. Wadeema’s Law identifies kidnapping, sale, trafficking and exploitation as threats to a child requiring protection.
Genuine legal fees and official charges should be documented; no professional can sell placement priority or influence an authority’s decision.
A contingency plan protects the child if care breaks down
Foster carers and guardians should plan for illness, death, marital separation or another event that makes continued care difficult. The plan can identify the competent authority, approved emergency carer, location of identity and medical records, current medication, school contact and immediate financial needs.
It should not privately nominate a replacement family as though the child were transferable. Any change of placement or legal guardian must follow the applicable authority and court process. Early notice gives specialists time to protect attachment, siblings, education and health.
Families with assets or homes in several countries should coordinate wills and guardianship documents without assuming that a private nomination overrides the UAE placement order.
How Mr AlBalooshi can assist with fostering and kafala
Mr AlBalooshi can identify whether the matter concerns UAE fostering, ordinary family custody, foreign adoption recognition, immigration documents or cross-border guardianship. He can review placement orders, advise on travel and inheritance planning, and coordinate foreign-law advice.
No lawyer can guarantee eligibility, selection of a child, placement timing, recognition or immigration approval. The competent authorities decide within the statutory framework and the child’s interests.
Set out the existing order and where it was made through the inquiry form. The scope of any assistance is confirmed after review. Upload every placement or adoption order, birth record, identity document, authority letter and travel deadline, or WhatsApp +971 50 627 5196.
Frequently asked questions
Is adoption allowed in the UAE?
UAE Government guidance states that adoption is not allowed under the domestic framework, while eligible Emiratis may foster a child of unknown parentage under law.
What is the difference between adoption and kafala?
Full adoption may create legal parentage under foreign law. Kafala or fostering generally concerns care and guardianship without replacing biological lineage.
Who can foster a child of unknown parentage?
Federal Decree-Law No. 24 of 2022 contains eligibility conditions, and official guidance identifies eligible Emiratis. The competent authority decides each application.
Where is a UAE fostering application submitted?
The law directs applicants to the Ministry or relevant local authority. Dubai’s Community Development Authority publishes a foster-child service.
Can expatriates use the UAE unknown-parentage fostering programme?
Do not assume so. Official guidance describes eligible Emiratis; expatriates with foreign adoption or guardianship orders need a different, case-specific analysis.
Does fostering change the child’s surname and lineage?
It does not authorise creation of false biological parentage. Identity and records are controlled by law and the competent authority.
Does a foster child inherit automatically from the foster family?
Do not assume the same inheritance as a biological child. Obtain advice on the applicable succession law, wills, gifts and beneficiary arrangements.
Can a foster family travel abroad with the child?
Only with the passport, placement powers and authority approvals required for the case and destination. Confirm permission before booking.
Is a foreign adoption automatically recognised in the UAE?
No universal answer applies. The order’s jurisdiction, finality, family’s status, public order and requested UAE purpose require review.
Can an adopted child receive a UAE residence visa?
Immigration authorities determine the category and documents. Residence permission does not itself create UAE parentage or nationality.
Can a step-parent adopt a spouse’s child in the UAE?
Do not assume a domestic adoption route exists. Custody, guardianship, parental consent and foreign options require individual advice.
What if the child’s biological relatives are known?
The case may require ordinary custody or guardianship rather than the unknown-parentage fostering framework.
Are foster placements supervised?
Yes, the statutory framework involves competent-authority assessment and oversight. Families must cooperate with current conditions and reporting.
What should I do if someone offers a private adoption?
Do not pay or take the child. Preserve evidence and seek advice or report possible sale, trafficking, exploitation or document fraud to the competent authority.
What should I send Mr AlBalooshi first?
Send the placement, kafala or adoption order, birth certificate, passports, authority letters, immigration records and details of the UAE outcome required.
