Muslim divorce in the UAE is governed principally by the Personal Status Law issued under Federal Decree-Law No. 41 of 2024. The law distinguishes divorce by the husband, khula and court-based revocation or separation. Each route has different legal requirements, evidence and financial consequences. An informal separation or private statement should not be treated as a complete court record without checking its legal effect and documentation.

the family-law team can review the marriage, the proposed divorce route, urgent child or financial issues and the documents needed for the competent UAE court. Request a review through the inquiry form or WhatsApp +971 50 627 5196.

When the UAE Personal Status Law applies

The 2024 Personal Status Law contains rules on its scope for UAE citizens and non-citizens. Religion, nationality, agreements on applicable law and other legislation may affect the analysis. A Muslim spouse should not assume that foreign nationality alone displaces UAE personal-status law, particularly where the family, children or proceedings are in the UAE.

The legal-route review should record:

  • whether one or both spouses are Muslim;
  • each spouse’s nationality and residence;
  • the place and form of marriage;
  • whether the marriage is registered in the UAE;
  • any written condition in the authenticated marriage contract;
  • previous pronouncements, reconciliation, khula discussions or court filings;
  • the children’s residence and travel position; and
  • any foreign family case or order.

If a party asks a UAE court to apply foreign law, the request, proof of that law, translation and public-policy considerations require individual advice. Do not copy a foreign-law argument from another case.

Main routes for Muslim divorce in the UAE

Divorce by the husband

The Personal Status Law defines divorce as dissolution of the marriage contract by the husband’s will using legally recognised expression and regulates divorce by the husband in Articles 53 onward. It also addresses authorisation of another person, cases in which a divorce does not take effect, repeated divorce, revocable and irrevocable effects, and documentation of taking back a wife after a revocable divorce.

The precise words, intention, date, circumstances and any later reconciliation may matter. A voice note, message or private statement should not be summarised from memory. Preserve the complete record and obtain advice about proof and formal documentation. The civil-status and court record must be clear for maintenance, iddah, remarriage, children and use of the divorce abroad.

Khula

Khula is a distinct dissolution route involving an agreed exchange or consideration, subject to the law. Articles 65 to 68 of the Personal Status Law regulate khula, competence, consideration and documentation. The terms require careful review because a spouse may be giving up or settling financial rights.

Do not sign a short “full and final” document without identifying what is exchanged, which claims are waived, whether child-related provisions are lawful, and what happens if payment or documentation is not completed. A child’s maintenance and welfare should not be treated as a bargaining asset between parents.

Court-based revocation or separation

The law also provides court remedies connected with defects, harm and other statutory circumstances. The correct claim depends on the facts. A spouse seeking court relief should identify the legal ground, events, dates, attempts at resolution and admissible evidence rather than filing a broad narrative with no link to the remedy.

Possible evidence may include official incident records, medical material, financial documents, witness information, complete communications, proof of residence or absence and earlier family-guidance or court files. Not every marital grievance satisfies a statutory ground, and not every ground requires the same proof.

Is family guidance mandatory for Muslim divorce?

Article 8 of the 2024 Personal Status Law gives the supervising judge discretion to refer parties to the Family Guidance Department or Section if an amicable resolution appears feasible. It also exempts specified matters, including urgent and temporary cases and cases in which reconciliation is not foreseeable, such as claims to prove marriage or prove divorce.

If a settlement is reached before family guidance, the law provides for a signed report that is approved by the supervising judge and has executory force, subject to the statutory limits. This makes drafting important. The agreement should identify maintenance, mahr, housing, children, contact, travel and any other issue precisely. Vague phrases can create a second dispute.

Muslim divorce procedure in the UAE

1. Confirm the court and remedy

The first review addresses jurisdiction, applicable law and whether the client seeks proof of an existing divorce, a new divorce, khula, court separation or connected relief. Filing the wrong remedy can waste time and prejudice the presentation of the case.

2. Secure the marriage and identity record

Prepare the authenticated marriage contract, passports, Emirates IDs, residence details and any certified translation. If the marriage occurred abroad, check legalisation and UAE attestation requirements. Differences in names, dates or transliteration should be resolved before filing where possible.

3. Identify urgent applications

Urgent questions may include temporary maintenance, children’s living arrangements, school fees, medical needs, travel restrictions, access to documents or safety. The application should be proportionate and supported by reliable evidence. Immediate danger should also be reported to the competent emergency or protection authority.

4. File and complete service

The claim is registered through the competent court channel, and the other spouse is notified. Overseas service, an unknown address or deliberate avoidance can affect timing. Keep proof of every known address, phone number, email and employer, but do not use unlawful tracing or access methods.

5. Present evidence and respond

The court may receive written submissions, documents, testimony and other evidence allowed by law. The case should distinguish established facts from allegations. Translated excerpts should not omit surrounding messages that change meaning.

6. Review judgment, appeal and enforcement

After judgment, check what the order actually decides, the appeal position, any amount or deadline, and whether enforcement must be opened separately. Documentation may also be required for immigration, civil status or use in another country.

Financial rights after Muslim divorce

Financial claims are not identical in every case. Depending on the marriage contract, divorce route and facts, the file may involve prompt or deferred mahr, waiting-period maintenance, compensation or other spousal claims recognised by law, child maintenance, housing, school and medical costs, and recovery or defence of unpaid amounts.

Prepare a schedule showing each claim, its legal basis, amount, due date and evidence. Keep mahr separate from gifts, ordinary household spending and jointly owned property. If a spouse alleges payment in cash, jewellery or transfers, connect each payment to the obligation with receipts, acknowledgments or complete communications.

Children after Muslim divorce

The 2024 Personal Status Law regulates custody and guardianship as distinct concepts. Divorce does not permit either parent to ignore the child’s education, healthcare, maintenance, residence or relationship with the other parent. The court’s assessment depends on the applicable provisions and the child’s circumstances.

A parenting proposal should address ordinary weeks, holidays, handovers, remote contact, medical decisions, school communication, passports and travel. Where travel or relocation is disputed, obtain advice before removing a child from the UAE or withholding documents.

Evidence to preserve

Create a dated, lawful evidence file containing:

  • the authenticated marriage contract and any written conditions;
  • the exact divorce or reconciliation communications, including full threads;
  • court, family-guidance, police or protection documents;
  • bank statements, transfer records and proof of mahr or maintenance;
  • tenancy, housing and utility records;
  • children’s school, medical and expense documents;
  • travel records and passport information where relevant;
  • a chronology separating what you witnessed from what another person reported; and
  • details of witnesses who have direct knowledge.

Do not secretly access an account, impersonate another person, edit recordings or publish private allegations. Ask how evidence can lawfully be obtained and used.

International Muslim divorce issues

An expatriate family may need to consider a foreign marriage record, overseas spouse, parallel proceedings, foreign assets or recognition of a UAE divorce. The UAE judgment’s legal status and the foreign country’s recognition test are separate. Attestation verifies official signatures and seals; it does not decide foreign recognition.

Before choosing a forum, obtain advice about jurisdiction, service, child residence, foreign-law evidence and enforcement. Starting cases in two countries without coordination can increase cost and create conflicting orders.

What a contested Muslim divorce file should explain

A contested application should allow the court to understand the legal remedy and the material facts without searching through an unstructured history. Start with the authenticated marriage, the parties’ present residence and the exact relief requested. Then set out the relevant events in date order, link each allegation to its supporting document and explain any gap in the evidence. If a communication was translated, retain the original and the complete conversation as well as the certified translation used for filing.

The response should be equally disciplined. It should admit facts that are not genuinely disputed, identify what is denied, give the alternative account and attach the supporting record. Financial allegations should use schedules and source documents rather than estimates hidden in narrative paragraphs. Child-related proposals should describe a workable arrangement and the child’s needs, not merely criticise the other parent.

Where reconciliation, a private settlement or a previous pronouncement is alleged, record who participated, what was said or signed, the date and whether the event was later documented. The legal effect should be argued from the verified record. A party should not destroy evidence, contact witnesses improperly or post allegations online while proceedings are pending.

Separation, divorce status and enforcement are separate questions

Living apart may be important evidence, but physical separation does not automatically provide the same official status as a documented divorce. Likewise, a judgment ending the marriage does not itself collect unpaid mahr or maintenance, transfer an asset, implement child contact or update a foreign civil register. The client should leave the case review with a list of each required order, document and implementation step.

How the family-law team can assist

A qualified UAE family-law representative may analyse the applicable route, review the marriage contract and alleged divorce events, identify urgent applications, organise evidence, prepare settlement terms, draft or respond to proceedings, and address enforcement. Where a foreign legal opinion is needed, the UAE workstream can be coordinated with qualified counsel in the relevant country.

Advice is based on the documents and agreed scope. No result can be promised, and an inquiry becomes a matter only after conflict checks and engagement terms are completed.

Documents to assemble before a consultation

Gather the marriage contract, identity documents, a chronology, information about the children, the mahr position, maintenance, housing, any prior declarations and any existing case. Note what you cannot obtain as well as what you hold. Do not send intimate or highly sensitive evidence until a secure and appropriate method has been confirmed.

The Consultation Document Builder runs in your own browser and can organise your answers into a list of that kind. To have the matter considered for a consultation, describe it through the inquiry form; the scope of any assistance is confirmed after review.

Request a review

Tell the team whether a divorce has already been pronounced or filed, the date and wording if known, the emirate, where both spouses live, whether children are involved and what is urgent. Use the inquiry form or WhatsApp +971 50 627 5196.

Frequently asked questions

What law governs Muslim divorce in the UAE?

Federal Decree-Law No. 41 of 2024 on Personal Status is the principal federal statute. Its scope provisions, other applicable legislation and any valid foreign-law issue must still be assessed for the parties and forum. Do not rely on guidance written only for the repealed 2005 law.

Is talaq the only way to end a Muslim marriage?

No. The law regulates divorce by the husband, khula and court-based remedies. The correct route depends on who seeks relief, the facts, any agreement and the evidence. Each route can produce different financial and procedural consequences.

Does a verbal talaq automatically complete every legal step?

Do not assume so. The words, intention, circumstances, type of divorce, documentation and any later taking back may require legal analysis. A clear official record is important for rights, civil status, remarriage and foreign use.

Can a husband authorise another person to divorce?

The Personal Status Law addresses authorisation of another person in the divorce provisions. The authority, wording and proof should be reviewed carefully. A general power of attorney should not be assumed to contain the required authority without checking its text and legal effect.

What is khula?

Khula is a statutory dissolution route involving agreed consideration or exchange and formal documentation. The proposed terms should identify the consideration and every right affected. Child maintenance and welfare should be treated separately from personal financial waivers between spouses.

Can a wife ask the court to end the marriage?

The law provides court-based remedies for specified circumstances. The application must identify the correct legal ground and supporting evidence. A broad complaint about the marriage may be insufficient if it does not establish the elements of the remedy sought.

Must we go to family guidance?

Not every matter follows the same path. Article 8 permits referral where reconciliation appears feasible and lists exemptions, including urgent and temporary matters and certain proof claims. The court, remedy and current procedure should be checked before filing.

Can a family-guidance settlement be enforced?

The 2024 law provides that a qualifying reconciliation report signed before family guidance and approved by the supervising judge has executory force. The terms must be lawful and precise. Obtain advice before agreeing to broad releases or child-related provisions.

What happens to deferred mahr on divorce?

The marriage contract, due event, divorce route, payment history and applicable law must be reviewed. Obtain the official contract and proof of payment or non-payment. Do not combine mahr with gifts, general expenses or property claims.

Is a divorced wife entitled to maintenance?

Potential entitlements depend on the statutory category, divorce circumstances and evidence. Waiting-period maintenance and other claims should be assessed separately from child maintenance. Prepare income, expense, housing and payment evidence rather than assuming a fixed amount.

Who keeps custody of the children?

There is no safe answer without the children’s ages, circumstances and applicable provisions. Custody and guardianship are distinct under the Personal Status Law. The court considers the legal criteria and child’s welfare; existing orders and travel restrictions must be respected.

Can I stop child support if access is refused?

Do not make that assumption. Maintenance and contact are separate legal obligations and remedies. Record missed contact, continue to comply with existing orders and obtain advice about enforcement or variation rather than using payment as private leverage.

Can I divorce in the UAE while living abroad?

Possibly, subject to UAE jurisdiction, representation, identity, service and evidence requirements. A power of attorney may help in some cases but may not remove every attendance requirement. Recognition in the country of residence should be checked separately.

Can a UAE Muslim divorce be used overseas?

That depends on the foreign country. You may need a final certified judgment or divorce record, translation, attestation and a recognition process. Confirm requirements with qualified counsel or the competent civil-status authority in the destination country.

What should I send for an initial review?

Send a short chronology, marriage certificate, identities, any alleged divorce wording, existing case documents, children’s details and a summary of urgent issues. Use a secure channel approved by the team for sensitive evidence and keep originals.
