Visitation and access rights in the UAE determine when a child spends time or communicates with a parent who does not have the child in daily care. The governing rules depend on whether the case proceeds under the Personal Status Law, an eligible federal civil personal-status regime or Abu Dhabi civil-family law. The custody judgment and any later variation control the practical arrangement.

Mr AlBalooshi assists parents seeking a clear contact schedule, responding to safety concerns, enforcing missed access or varying an order that no longer fits the child. Use the inquiry form to upload the current judgment and a calendar of missed or disputed contact, or WhatsApp +971 50 627 5196.

Contact is a child arrangement, not a reward for either parent

Parenting time should support the child’s safe relationship with both parents. It should not be used to punish an adult, bargain over maintenance or force a child to carry messages.

Federal Decree-Law No. 41 of 2024 contains a specific section on visitation of a child in custody. The court may organise visitation and change its dates and places in a manner that serves the child’s best interests. The exact statutory entitlement, persons involved and operative order need case-specific review.

Under civil routes, contact may be part of joint physical custody rather than a traditional custodial-parent and visitor model. A parent should first identify the legal structure, then ask for the schedule or remedy actually needed.

A precise order is easier to follow and enforce

General wording such as “reasonable access” may work for cooperative parents but create repeated disputes when communication is poor. A detailed order can address:

  • school-week and weekend days;
  • start and end times;
  • overnight contact;
  • collection and return locations;
  • the adult authorised to conduct handover;
  • public and school holidays;
  • Eid, birthdays and family occasions;
  • telephone and video communication;
  • travel and passport arrangements;
  • notice for unavoidable changes;
  • replacement time after cancellation; and
  • supervision or other safeguards where justified.

The schedule should fit school, sleep, health, travel distance and the child’s age. Equal-looking blocks are not always practical, while vague arrangements may leave the child uncertain.

Personal Status Law and civil joint custody must remain distinct

Under the Personal Status Law, one parent may hold daily custody while the other has visitation or may take the child during authorised time. Custody and guardianship remain separate, so contact does not automatically transfer authority over every school, medical or passport decision.

Federal Decree-Law No. 41 of 2022 gives eligible civil personal-status parents a joint and equal custody right after divorce. Cabinet Resolution No. 122 of 2023 addresses joint custody, schedules, waiver and disputes. Abu Dhabi Civil Family Court’s official guidance describes joint legal and physical custody after separation unless waived or otherwise ordered.

A civil case may therefore need a parenting-time allocation, decision protocol or sole-custody application, not only “visitation.” Eligibility for that route must be established rather than assumed.

Contact arrangements should reflect the child’s developmental needs

Young children may benefit from shorter, more frequent contact and familiar handovers. School-age children need predictable homework, activities and sleep. Teenagers may require greater flexibility while remaining protected from pressure to choose sides.

Relevant considerations can include:

  • the child’s existing bond with each parent;
  • age, health and additional needs;
  • prior care pattern;
  • school and activity timetable;
  • travel time between homes;
  • siblings and important family connections;
  • each home’s safety and suitability;
  • parents’ work and childcare arrangements; and
  • the child’s views where lawfully and appropriately considered.

Do not ask the child to negotiate the calendar or record a preference for court. A child-focused proposal explains how the arrangement will work without making the child responsible for the outcome.

Overnight contact depends on the facts and legal route

There is no responsible universal answer that every contact order includes or excludes overnights. The court can consider the child’s age, relationship, accommodation, previous care, health, school travel and any proven safety issue.

A parent seeking overnights should show a suitable sleeping arrangement, practical transport and ability to meet the child’s routine. A parent opposing them should identify a child-specific concern rather than rely on adult disagreement.

A staged plan may be appropriate where a parent and child have had limited recent contact. It can begin with shorter visits and progress if safe and successful. Terms should define who evaluates progress and how disputes are returned to court if agreement fails.

Supervised contact requires a proportionate reason

Supervision may be requested where reliable evidence indicates violence, abuse, neglect, substance misuse, abduction risk, serious instability or another danger. The application should identify the conduct, dates, effect on the child and proposed supervisor or venue.

Possible safeguards include:

  • a professional or approved supervisor;
  • a neutral contact centre where available;
  • a trusted adult accepted by the court;
  • public or protected handovers;
  • no removal from a defined location;
  • restrictions on named persons;
  • testing or treatment conditions where lawfully ordered; and
  • review after a defined period.

Supervision should not be requested merely to humiliate the other parent. Equally, a genuine protection issue should not be minimised for the sake of informality.

Safe handovers reduce conflict around the child

Many contact disputes occur at collection and return. A practical order may use school as the handover point, a neutral public location, a third party or staggered arrival times. Communication can be limited to a written parenting channel when direct exchanges are unsafe or unproductive.

Keep handovers brief. Do not argue about maintenance, property or litigation in front of the child. Record the date, scheduled time, actual time and any objective problem. A neutral log is more useful than repeated accusatory messages.

If domestic abuse or stalking is alleged, disclose the concern to the family-law team so the application can address protected locations, communication and safety. Do not disclose a protected address simply to make an ordinary template fit.

Missed access should be documented accurately

When contact is not provided, keep the operative order and a simple calendar showing:

  • scheduled date and time;
  • confirmation or notice sent;
  • arrival and waiting period;
  • reason given for cancellation;
  • evidence such as a school notice or medical record;
  • whether replacement time was offered; and
  • the effect on later arrangements.

Distinguish deliberate obstruction from illness, travel disruption or genuine emergency. One mistake may require communication; a pattern may require enforcement or variation. Avoid repeated attendance at a home after a clear safety instruction or court restriction.

Where a child is withheld beyond authorised contact, the issue may become custody enforcement, urgent travel protection or a cross-border case rather than an ordinary missed visit.

Enforcement must follow the judgment and competent procedure

A parent should not respond to denied contact by withholding maintenance, taking the child outside the order or confronting the other parent. The lawful route may include enforcement of a sufficiently specific judgment, an application to clarify terms, a variation request or urgent relief.

The parent seeking enforcement should provide the sealed order, proof of service where relevant and evidence of each breach. If the existing wording is too vague, a clearer order may be more effective than repeatedly alleging non-compliance.

Police and court enforcement are not interchangeable. The proper authority depends on whether the issue is breach of a family order, immediate danger, disappearance or another alleged offence.

Variation may be needed when circumstances change

A schedule may stop working because of a new school, work pattern, residence, health need, child’s age, relocation or proven safety concern. Parents can seek an agreed revision in enforceable form or apply to the competent court.

Evidence should show what changed after the earlier order, why the present arrangement no longer serves the child and how the proposed terms solve the problem. A parent should not create a new status quo by repeatedly ignoring the judgment.

Temporary flexibility is useful, but written agreement should identify the exceptional dates and confirm whether the underlying order remains. Permanent informal changes can later create disagreement about what was consented to.

Telephone and video contact need workable boundaries

Remote contact can maintain a relationship during travel, illness or long distance. It should not become continuous monitoring of the other home. A useful arrangement can identify days, approximate duration, platform, who initiates and what happens if the child is asleep or unavailable.

Parents should give the child reasonable privacy without coaching or interrogation. Calls should not be recorded unless lawful and necessary advice has been obtained. Do not use a child’s device to track the other parent or collect household information.

Virtual contact does not automatically replace in-person time, but it can supplement a schedule and preserve connection after relocation.

Travel during contact requires separate permission analysis

A contact order does not necessarily authorise foreign travel. Under the Personal Status Law, written approval or court authorisation may be required for custodial-parent travel, and passports have separate rules. Civil joint-custody orders may contain their own consent terms.

Before any trip, confirm destination, dates, return, passport delivery, school impact and whether a travel restriction exists. Domestic movement may also require schedule changes if the child cannot be returned on time.

If non-return risk is genuine, seek specific protection rather than cancelling all contact without an order. Read Child Travel Bans and Child Relocation.

Maintenance and visitation should be enforced separately

Failure to pay child maintenance does not usually give the other parent permission to suspend contact. Missed visitation does not cancel the duty to support the child. Each obligation has its own claim or enforcement route.

Parents can present connected facts to the court where relevant, but they should not condition access on payment at handover. That exposes the child to adult financial conflict and may breach an order.

Keep a separate maintenance schedule, payment record and contact calendar. Clear evidence helps Mr AlBalooshi choose the correct application for each issue.

International access requires detailed travel planning

When parents live in different countries, contact terms may concentrate time in school holidays and use video calls during term. The order should address flights, accompaniment, visas, passports, costs, itinerary, emergency care and recognition abroad.

Check whether the destination will recognise or enforce the UAE order and whether any relevant treaty applies. Do not assume an embassy can enforce contact. Certified copies, translation and attestation may be needed, but document attestation alone does not make an order executable abroad.

If a child is not returned after contact, urgent relocation or international child-abduction advice may be required. Delay can make location and jurisdiction more difficult.

How Mr AlBalooshi can assist with access arrangements

Mr AlBalooshi can identify the applicable law, interpret the custody order and prepare a precise contact, enforcement or variation application. He can advise on supervision, protected handovers, holiday travel, remote communication and cross-border arrangements.

No lawyer can guarantee a particular number of days, enforcement result or timetable. The objective is a safe order that fits the child and can be followed in practice.

Describe the schedule as ordered and the schedule as it is actually working through the inquiry form. The scope of any assistance is confirmed after review. Upload the judgment, a three-month calendar, key messages, school timetable and evidence supporting any safety request, or WhatsApp +971 50 627 5196.

Frequently asked questions

What are visitation rights in the UAE?

They concern a child spending time or communicating with a parent or other person entitled under the applicable law and order. Civil cases may frame this as joint physical custody.

Does the non-custodial parent have a right to see the child?

The Personal Status Law provides for visitation of a child in custody, subject to statutory rules and the child’s interests. Review the exact judgment.

Can visitation include taking the child away from the handover place?

It may, depending on the law and order. The terms should specify location, duration, travel area and return.

Are overnight visits automatic?

No. Overnights depend on the legal route, child’s needs, prior care, accommodation, schedule and any proven risk.

Can contact be supervised?

Yes, where justified by reliable child-specific safety evidence and ordered by the court. The supervision proposal should be practical and proportionate.

Can I stop visitation because maintenance is unpaid?

Do not assume so. Contact and maintenance have separate enforcement routes. Suspending contact may breach the order.

Can the other parent stop paying because access was denied?

No automatic right arises. Child support remains a separate obligation that should be varied or enforced through the proper court process.

What should a visitation schedule contain?

It can specify days, times, overnights, handovers, holidays, calls, travel, notice, replacement time and necessary safeguards.

What if the child refuses contact?

Identify the reason without coaching or punishment. Age, safety, relationship and the order matter; professional or court directions may be needed.

How do I prove missed visitation?

Keep the order, confirmation messages, arrival evidence, a neutral calendar, reasons given and any replacement-time proposal.

Can grandparents obtain contact?

The Personal Status Law contains provisions concerning visitation and persons entitled. The statutory conditions, parents’ circumstances and child’s interests require review.

Can a contact order be changed?

Yes, potentially by enforceable agreement or court variation where circumstances and the child’s needs support new terms.

Does joint custody mean exactly equal time?

Not necessarily. Civil joint custody recognises both parents’ legal and physical roles, but the schedule must be workable and child-focused.

Can a parent take the child abroad during access?

Not merely because contact is ordered. Check written consent, court permission, passport rules and any travel restriction before booking.

What should I send Mr AlBalooshi?

Send the custody and contact orders, child’s schedule, missed-contact log, key messages, travel details and evidence supporting any supervision or variation request.
