A financial settlement after divorce in the UAE starts with a question that is often missed: which legal regime applies to the spouses and to each asset? The answer can affect spousal claims, maintenance, marital agreements, jointly owned property and the procedure used to obtain or enforce an order. There is no safe assumption that every asset is divided equally, that title alone resolves every contribution claim, or that a foreign divorce automatically settles UAE property.

Start by separating five different financial questions
Many disputes become unmanageable because all money issues are described as “the settlement.” Prepare separate schedules for:
- Ownership: who legally owns the home, account, shares, vehicle, investment or personal property?
- Contribution: did one spouse pay towards property held by the other, improve it, discharge its loan or transfer money for a defined purpose?
- Support: is the claim for wife’s maintenance, post-divorce civil alimony, child maintenance, housing or arrears?
- Contract: does a marriage contract, prenuptial agreement, postnuptial agreement, shareholders’ agreement, loan document or written settlement govern the issue?
- Implementation: can the proposed transfer, sale, payment plan or security actually be completed in the UAE and in every country where an asset is located?
A single transfer may raise more than one question. Money sent into a spouse’s account could be household support, a gift, a loan, a purchase contribution or business capital. Its legal character depends on the applicable law, the parties’ agreement and the evidence, not on the label chosen after separation.
UAE financial settlements differ by legal route
Muslim personal-status route
Federal Decree-Law No. 41 of 2024 recognises that each spouse has a separate financial identity. A spouse remains free to deal with his or her own property, and one spouse may have a claim where both participated in developing property, building a home or a comparable asset. This is not an automatic community-property or equal-division rule. Title, contribution, purpose, agreement and proof matter.
The same law separately regulates maintenance, waiting-period rights, compensation in defined circumstances, dowry and child-related financial obligations. Those claims should not be confused with a claim to own a share in land, a company or an account.
Federal civil personal-status route
Federal Decree-Law No. 41 of 2022 permits spouses within its scope to agree terms in the civil marriage contract, including rights during marriage and after divorce. It also allows a divorced woman to seek alimony after the divorce judgment, subject to the law, the Executive Regulations and judicial assessment where the contract does not determine the issue.
The existence of a civil divorce does not by itself create a universal 50/50 transfer of everything acquired during marriage. The court must identify the relevant contractual, ownership and financial claims. Property or company issues may also engage legislation outside the civil personal-status decree.
Abu Dhabi civil-family route
The Abu Dhabi Civil Family Court publishes a post-divorce settlement form and a separate application for a financial order. Its official guidance states that a party who cannot reach an amicable financial settlement may apply for a financial order after the divorce judgment. This local process should not be presented as the procedure for every Dubai or federal case.
Foreign-law and cross-border route
A foreign law may become relevant only after jurisdiction, applicable-law rules and proof requirements are assessed. Even where a foreign court determines the spouses’ financial rights, a UAE asset may require recognition, enforcement or a local transfer procedure. Foreign real estate, pensions, trusts and companies may need advice in the place where they are located.

Build an asset and liability map before negotiating
Use one line for every asset and debt, including items that one spouse says are separate or disputed.

Do not omit an asset merely because it is held through a company or outside the UAE. Equally, do not describe a company-owned asset as personal property without reviewing the company records and the rights attached to the shares.
Homes and investment property
For UAE real estate, obtain the current title record, sale and purchase documents, mortgage statement, payment evidence, valuation and any lease. The registered interest is a central starting point, but the full dispute may include contributions, contractual promises, beneficial assertions, loan responsibilities or an order made in another proceeding.
If one spouse wants to keep the home, test the proposal against the lender’s requirements and the land-registration process. A private promise to “take over the mortgage” does not release the other borrower unless the lender and required authorities complete the change. The settlement should address transfer costs, valuation date, outstanding service charges, rent, possession, utilities and the consequence if refinancing is refused.
Where children live in the property, distinguish their housing needs from ownership. A housing or maintenance order is not necessarily an ownership transfer, and ownership does not by itself decide the children’s residence.
Businesses, professional interests and company shares
A business dispute needs two separate analyses: the value and ownership of the spouse’s shares, and any claim concerning money or work contributed by the other spouse. Review the licence, memorandum and articles, shareholder register, capital contributions, accounts, bank statements, related-party transactions, dividends, remuneration and shareholder agreements.
The business’s cash and property belong to the company where the company is the legal owner. They should not be treated as the shareholder’s personal wallet. At the same time, income, dividends, shareholder loans and the value of shares may be relevant to support, valuation or settlement.
Avoid disrupting staff, customers or banking arrangements. A settlement can use an independent valuation, staged disclosure, a buyout, security for payment or a sale mechanism. Confidential company material should be handled through lawful court or agreed disclosure, not by unauthorised account access.
Bank accounts, investments, cryptoassets and valuables
Identify the account holder, institution, currency, balance dates and transaction history. Joint signing authority does not always determine beneficial ownership, and access to an account does not authorise a spouse to empty it after separation.
For investments and digital assets, record the platform, legal account holder, wallet or custody arrangement, acquisition funding and transaction trail. Preserve lawful records, including statements and verified exports. Do not guess the value from a single volatile date; agree or request a sensible valuation method.
Jewellery, gifts and personal items can carry emotional value out of proportion to their market price. Use inventories, receipts, photographs, insurance schedules and evidence of gifting. A practical division may save disproportionate litigation cost, but it should be written precisely enough to identify each item.
Debts and financial guarantees
List mortgages, personal loans, credit cards, tax liabilities, school arrears, business guarantees and informal family loans. Determine who signed, who received the benefit, what security exists and whether the creditor has released either party.
An agreement between spouses does not normally bind a bank that is not a party. If one spouse agrees to service a joint debt, the settlement should address payment proof, default, indemnity, refinancing deadline and what happens if the lender pursues both borrowers.
Informal loans from relatives require credible evidence of a real obligation. A transfer should not be described as a loan merely because repayment now supports one spouse’s case.
Financial disclosure and lawful evidence
Prepare complete, dated disclosure rather than a document dump. Useful records commonly include:
- recent and historical bank and card statements;
- salary certificates, payslips, employment terms and bonus records;
- company accounts, ownership records and dividend information;
- title deeds, mortgage statements, tenancy and property valuations;
- investment and pension statements;
- loan and guarantee documents;
- tax returns or foreign declarations where relevant;
- marriage and financial agreements; and
- evidence supporting the purpose of disputed transfers.
If there is a genuine concern that evidence or assets may disappear, obtain advice on an urgent, proportionate remedy. Do not hack an account, install tracking software, impersonate the other spouse, take privileged documents or publish allegations. Evidence obtained unlawfully can create separate legal risk.
Valuation: choose the right date and method
Value is not always the latest balance. Property may need a qualified valuation; a private company may require an accounting expert; jewellery may need an appraisal; and a foreign pension may need specialist calculation. The valuation date can materially change the result.
Agree what the valuer is being asked to determine, the information each party must provide, assumptions about debt, tax or marketability, and how questions will be raised. If the court appoints an expert, comply with the directions and present organised source documents rather than advocacy disguised as accounting.
Settlement terms should be capable of performance
A workable agreement should identify:
- every claim being settled and any claim expressly reserved;
- the legal owner and recipient of each asset;
- payment amount, currency, date, account and instalment schedule;
- interest or consequences of default where lawful and agreed;
- valuation and sale process, including reserve price and agent selection;
- mortgage discharge, lender consent and registration steps;
- company approvals and share-transfer conditions;
- responsibility for documented costs and liabilities;
- maintenance and child-related payments kept distinct from property transfers;
- documents to sign and the deadline for signing;
- court approval, notarisation or authentication required; and
- enforcement forum and method.
Do not rely on “full and final settlement” without defining its scope. Personal-status rights, child rights, property, company claims and foreign proceedings may not all be disposed of by one vague sentence.
Negotiating a financial settlement
Start with a shared balance sheet and an issue list. Mark agreed values and ownership facts, then isolate the true disagreements. Negotiation is more productive when each proposal shows the asset, value, debt, transfer mechanics and effect on cash flow.
Consider liquidity. A spouse may appear asset-rich but unable to pay a large lump sum without selling property or shares. Instalments may require security, disclosure obligations and default provisions. If a sale is needed, set dates and a mechanism for dealing with refusal or delay.
Settlement discussions should not postpone a court deadline. Ask how communications should be protected and how any agreement will be recorded. A signed private document may still require court approval or formal implementation for particular assets.

Urgent risks before a settlement is final
Seek prompt advice if there is a credible risk of asset disposal, account depletion, mortgage default, eviction, business disruption, child-housing loss or breach of an existing order. Urgent relief is evidence-based. Prepare the asset details, recent event, threatened action, supporting record and the narrow order required.
Do not create urgency by moving money, concealing property or interfering with lawful business operations. Courts can assess conduct and evidence, and enforcement problems often become harder when records have been altered.
After agreement or judgment: complete the implementation
Financial settlement does not end when terms are signed or judgment is issued. Create a completion list for payments, title transfers, mortgage releases, company resolutions, account closure, delivery of property, updated beneficiaries where lawful and certified documents for use abroad.
If an obligation is missed, review the exact wording, due date, evidence of default and enforcement forum. A divorce judgment may need a separate execution file. A foreign order may first require UAE recognition; a UAE order concerning an overseas asset may require steps in that country.
Documents for a financial-settlement consultation

Frequently asked questions
Are assets automatically divided 50/50 after divorce in the UAE?
No universal rule automatically divides every asset equally in every UAE divorce. The court must identify the applicable legal regime, ownership, agreements, contributions and the nature of each claim. Abu Dhabi civil-family financial orders and federal civil claims must also be kept distinct from Muslim personal-status rights. Obtain advice before assuming that a foreign community-property concept applies to UAE assets.
Does the name on the title deed decide everything?
Registered title is important, but it may not answer every contribution, contract or beneficial assertion. The evidence may include purchase funding, mortgage payments, written promises and the purpose of transfers. The available remedy depends on applicable law and procedure. Do not attempt a transfer or restriction without advice and the required registry or lender process.
Can I claim money paid towards a property in my spouse’s name?
A claim may be possible depending on the legal route, agreement, purpose of payment and proof. Federal Personal Status Law recognises separate financial identity and addresses participation in developing property or building a home. Prepare bank records, invoices, messages, title and loan documents. The court will not necessarily treat ordinary household spending as acquisition of an ownership share.
Is maintenance part of the property settlement?
It should be analysed separately. Wife’s maintenance, civil post-divorce alimony, child maintenance, housing, arrears and property ownership have different legal bases. A settlement may resolve several categories, but it should allocate amounts clearly so that duration, variation, tax or enforcement issues are not obscured.
How are business interests handled?
Review the shares, company records, valuation, income and any contribution claim. Company property usually belongs to the company, not directly to a shareholder. A settlement might transfer shares, arrange a buyout or use other assets, but corporate approvals, restrictions and creditor rights must be respected.
Can my spouse hide money in a company?
Do not assume concealment merely because funds move through a business. Identify the specific company, account, transaction or missing disclosure and explain its relevance. Lawful disclosure, accounting records and an expert process may be needed. Unauthorised access to business systems can create separate legal and evidential problems.
What happens to a joint mortgage?
The lender’s contract continues unless the lender releases or replaces a borrower. A divorce agreement between spouses does not itself remove liability to the bank. Address refinancing, transfer, payment proof, default and sale arrangements. Obtain the lender and registry requirements before making the settlement conditional on a transfer that may not be approved.
Can we agree a settlement privately?
Spouses can negotiate, but enforceability and implementation depend on the terms, applicable law and asset. Some terms may need court approval, notarisation, company action, lender consent or registration. Child-related terms remain subject to applicable protections. Have the final document reviewed before signing or withdrawing proceedings.
Will a prenuptial agreement be followed?
Its effect depends on the legal regime, drafting, consent, scope, public order and the specific claim. Federal civil law expressly permits contractual terms concerning rights during marriage and after divorce. Abu Dhabi publishes a prenuptial template. Do not assume a foreign agreement is automatically effective without a UAE and cross-border review.
How is a private company valued?
The method depends on the business, records and purpose of the valuation. An expert may consider earnings, assets, debt, marketability and shareholder rights. Agree or seek directions on the valuation date, information, assumptions and treatment of personal expenses. A headline revenue figure is not the value of the spouse’s shares.
Can the court stop an asset from being sold?
Urgent protective relief may be available where the legal requirements and evidence are met. The applicant should identify the asset, ownership, credible risk, recent conduct and proportionate order required. A general fear is usually less useful than a title record, sale communication, transfer instruction or other specific evidence.
What if assets are outside the UAE?
The UAE case may determine rights between spouses, but an overseas asset can require local recognition, disclosure and enforcement. Foreign courts may apply different property rules. Coordinate early so that UAE pleadings, settlement wording and foreign steps do not contradict each other.
Do I need to disclose assets that are only in my name?
Do not conceal relevant assets. The scope of required disclosure depends on the claim and court process, but a lawyer needs a complete confidential account to advise properly. Failure to disclose can damage credibility, delay the case and complicate settlement or enforcement.
When should property be valued?
The appropriate valuation date depends on the asset, dispute and order sought. In a volatile market or lengthy case, more than one date may matter. Record the date used in every proposal and provide for an updated valuation if completion is delayed.
