DIFC Wills give eligible non-Muslims a dedicated Dubai framework for directing the succession of covered UAE assets and, where the chosen instrument permits, nominating guardians for minor children. The DIFC Courts Wills Service maintains the Registry for Non-Muslims, while the DIFC Courts handle probate matters and claims under the system. A registered will is powerful, but only when its form, asset scope and appointments match the testator’s real circumstances.

DIFC Wills operate within a dedicated Dubai legal system
The DIFC Courts Wills Service is a joint initiative of the Government of Dubai and the DIFC Courts. Its authority is reflected in Dubai Law No. 15 of 2017 concerning administration of estates and implementation of wills of non-Muslims in Dubai, together with the DIFC Courts Wills and Probate Registry Rules and current directions.
The Registry is not merely a document-storage service. Registration places the instrument within a framework that addresses form, executors, guardianship, probate and judicial orders. The DIFC Courts Wills Service provides administrative support, and probate claims connected with registered DIFC Courts Wills are handled within the DIFC Courts system.
This route must remain distinct from a will notarised through Dubai Courts and from an ADGM or Abu Dhabi Civil Wills instrument. Each has its own registration authority, governing documents and post-death procedure. A person should choose after comparing eligibility, assets, family needs, language, implementation and existing foreign wills.
Choose the will type by mapping assets first
The official DIFC service offers several types of wills. The correct selection is based on what the testator owns and wants the instrument to do, not simply the lowest registration cost.
Full Will: designed for a variety of assets and can combine asset distribution with qualifying guardianship provisions. Its mandatory provisions appear in Schedule 1 of the Registry Rules.
Property Will: limited to real estate and, under the current official service description, can encompass up to five UAE properties or shares in up to five properties.
Financial Assets Will: designed for specified UAE bank and brokerage accounts. The official service currently describes coverage of up to ten qualifying accounts or shares in those accounts, subject to the account and institution conditions.
Business Owners Will: designed for qualifying shares in UAE onshore or free-zone companies. The current service describes up to five separate UAE shareholdings, subject to its conditions.
Guardianship Will: addresses appointment of guardians rather than general asset distribution. A Full Will may be more suitable where both assets and guardianship need coverage.
Digital Assets Will: a specialised offering for qualifying digital assets within the official service’s defined arrangement. Its technical scope should be checked at the time of registration because supported assets and custody features can change.
An asset outside a limited will does not disappear. It may fall under another valid will or the applicable intestacy rules. Prepare a complete inventory before selecting a form.
Eligibility should be confirmed against current Registry Rules
The Wills Service is intended for non-Muslims investing or living in the UAE who satisfy the applicable requirements. Age, religion, capacity, UAE asset or guardianship connection, and the scope of a particular will type must be checked using the current Rules and service guidance.
Do not assume that holding a DIFC company, living in a particular emirate or owning one Dubai property automatically makes every will form suitable. Equally, a person does not need to treat DIFC incorporation as ownership of personal assets; a shareholder owns shares, while the company owns its own property.
If religion, capacity or beneficial ownership could later be challenged, preserve reliable records at the time of instructions and registration. A testator should understand the document, act voluntarily and use the required registration process.
The executor must be able to administer a UAE estate
An executor is responsible for seeking probate, collecting and preserving estate property, addressing liabilities, keeping accounts and implementing distributions under the will and court orders. The choice should be practical, not ceremonial.
Consider residence, willingness, age, independence, language, ability to handle digital systems, potential conflicts and whether a professional or corporate executor is appropriate. Name substitutes in case the first executor dies, refuses, loses capacity or is unsuitable.
The executor does not own the estate and cannot use assets personally. Beneficiaries should receive transparent inventories and accounts, while the executor must protect confidential information and comply with court directions.
Guardianship provisions need both interim and long-term thinking
The DIFC Courts Wills Service states that a Guardianship Will can nominate guardians, and a Full Will can include qualifying guardianship provisions. The DIFC Courts may issue interim and permanent guardianship orders where the Registry Rules, eligibility and UAE public policy requirements are met.
Parents should consider an interim guardian near the children who can respond immediately and a permanent guardian able to provide long-term care. Discuss residence, visas, schooling, health, culture, siblings, travel and the proposed guardian’s consent.
Guardianship of the child and administration of the child’s inheritance are different roles. The same person can sometimes perform both, but the will should identify who controls funds and the safeguards that apply. A nomination remains subject to the competent court and the child’s welfare; it is not an automatic private transfer of custody.
Registration formalities protect the integrity of the instrument
The official service uses its portal and registration appointment process. The testator must complete the required information, pay current fees, satisfy pre-registration checks and execute the will with the witnessing and electronic formalities prescribed for that product.
Do not sign a final instrument prematurely if the Registry requires signing during the appointment. Names, identification details and asset descriptions should match official documents. Ambiguous percentages, missing substitutes, inconsistent residue clauses and incorrect company names can create execution problems even where the will is registered.
Registration does not prove ownership of every listed asset. It records testamentary instructions within the DIFC framework. At death, the executor still needs evidence that the asset belonged to the testator and falls within the will.
Coordinating several wills prevents accidental cancellation
An international family may need a DIFC Courts Will for UAE assets and another will for foreign assets. Each document should state its territorial and asset scope, and the revocation language must be coordinated. A later will that revokes “all prior wills” can unintentionally cancel a carefully prepared instrument elsewhere.
Executors in each country should know that parallel administrations may be needed. Original-document custody, death certificates, foreign grants, translations and asset-specific transfer rules should be considered in advance.
If the testator changes nationality, residence or family structure, both local and foreign advisers should review whether the choice of law, tax treatment or probate plan has changed. A DIFC registration does not decide overseas tax or succession questions.
Business, property and bank details must be exact
A Property Will should use the current title deed and identify the ownership share, emirate, mortgage and any sale or off-plan status. If a property is sold and replaced, the will may require modification depending on its wording and product type.
A Financial Assets Will requires qualifying account information consistent with the service conditions. Joint accounts require care because the testator’s beneficial interest, not the account label alone, determines what enters the estate.
A Business Owners Will concerns shares, not assets owned by the company. The memorandum, articles, shareholder agreement, licence, free-zone rules, options, pledges and transfer restrictions should be reviewed. The will should coordinate with business-continuity and management arrangements rather than assume the beneficiary becomes an authorised manager immediately.
Amendments and revocation must use an effective process
Marriage, divorce, birth, death of a beneficiary or executor, asset acquisition or disposal, business restructuring and relocation can justify review. A handwritten note attached to a registered will should not be treated as an effective amendment.
Use the Registry’s current modification or revocation procedure. Review substitutions, residue, guardianship and interaction with other wills each time. Keep the latest registered copy and confirmation available to the intended executor without exposing confidential details widely.
If capacity may later be questioned, complete the review while the testator can give clear independent instructions. Appropriate medical evidence may be considered where circumstances justify it, but it should not be collected or disclosed indiscriminately.
DIFC probate is the post-death authority stage
Registration occurs during life; probate occurs after death. The executor or appropriate applicant must present the death and will, satisfy the Rules, disclose the estate and seek the orders required to administer it. Contested validity, executor disputes or ownership questions may become probate claims.
The probate order does not itself complete every asset transfer. A Dubai property may require Dubai Land Department procedures; a bank or brokerage applies its compliance requirements; a company registry applies share-transfer rules. Foreign assets may require separate grants in the country where they are located.
Estate expenses and enforceable debts must be addressed before final distribution. The executor should maintain a ledger and avoid paying one beneficiary early without authority.
A validity dispute is decided by evidence, not family preference
Challenges may allege lack of capacity, undue influence, forgery, defective execution, revocation, a later will, mistaken asset ownership or misconduct by an executor. Preserve the registered instrument, appointment record, drafting instructions, witness details and contemporaneous records lawfully available.
Do not alter files, obtain medical records without authority or access the deceased’s accounts unlawfully. The DIFC Courts’ procedures govern disclosure and expert evidence. Settlement may be possible, but it must protect creditors, minors and absent beneficiaries and remain capable of implementation.

Keep a private implementation schedule with the registered will
The will should not contain passwords, informal valuations or instructions that may quickly become outdated. Keep a separate confidential schedule listing current title numbers, accounts, company licences, advisers, insurance contacts and the location of original documents. Update it without trying to amend the testamentary gifts informally.
The executor should know how to find the registered will and schedule, but beneficiaries need not receive sensitive access information during the testator’s life. Review secure storage, recovery access and device instructions so essential records are available after death without compromising privacy now.
