UAE family law guides should help you prepare a real decision, not give the impression that one checklist fits every case. A Muslim divorce may involve talaq, khula, dowry and statutory dissolution questions. A qualifying non-Muslim civil divorce follows a different legal route. An application to the Abu Dhabi Civil Family Court cannot be generalised to Dubai or every UAE court. Foreign documents, overseas service and enforcement add further layers.

Deciding on a UAE divorce

This guide is for a spouse considering divorce, responding to a claim or preparing for family guidance. It separates three starting pathways: Muslim personal status under Federal Decree-Law No. 41 of 2024; federal civil personal status under Federal Decree-Law No. 41 of 2022 and Cabinet Resolution No. 122 of 2023; and Abu Dhabi Civil Family Court review.

Record the marriage, residence, children, separation, existing proceedings, immediate risk, financial issues and any foreign connection. Its decision map covers jurisdiction, family guidance or direct filing, interim relief, notification, evidence, settlement, judgment, appeal review and enforcement. It does not state that every stage applies.

The document list begins with the marriage certificate or contract, passports, Emirates IDs where applicable, residence information, children’s birth certificates, current orders and a one-page chronology. Route-specific sections add dowry wording, civil-marriage documents, financial agreements or foreign-law materials.

Preparing for the Dubai family courts

This guide covers what to organise before family guidance, case registration, a hearing or a settlement discussion. It does not reproduce a generic court timeline or assume that Abu Dhabi civil forms can be used in Dubai.

Assemble a court-and-case cover sheet, a chronology, a document index, an issue list, a record of notices and dates, a settlement agenda and the questions you want put to counsel. It asks whether the matter concerns divorce status, dowry, spousal maintenance, child maintenance, custody, guardianship, contact, travel, protection, property or enforcement.

For evidence, it prompts lawful preservation of full message threads, bank and salary records, school and medical documents, tenancy records, police references and earlier orders. It warns against unauthorised account access, tracking software, altered files and public accusations.

Custody, guardianship and child travel

This guide helps parents identify the actual child-related decision. Day-to-day custody or hadana is not identical to guardianship or wilayah. Civil joint custody uses its own statutory framework. Passport possession, consent to a journey, a court travel restriction and permanent relocation are separate questions.

The child’s current arrangements section records residence, school, health, care, contact, travel documents and existing orders. The proposal section asks for a practical weekly schedule, decision-making process, holiday plan, communication method and implementation arrangements.

For relocation, it adds immigration status, housing, school, healthcare, financial plan, family support, travel costs and proposals preserving the child’s relationship with the other parent. For an imminent journey, it prioritises the itinerary, consent request or refusal, passport status and any existing restriction.

Maintenance and financial evidence

The point of this section is to organise figures, not to predict a court award. It keeps spousal maintenance, each child’s needs, direct payments, arrears, interim requests and variation applications separate.

The income schedule records salary, allowances, bonuses, commissions, business income and other declared resources. The expense schedule records housing, food, education, medical costs, insurance, transport, domestic help and other claimed needs with a document reference beside each amount. It retains the original frequency and shows only an arithmetic monthly equivalent.

The arrears page uses the operative order or agreement, due date, amount due, amount received, credited direct payment and shortfall. It does not add interest, penalties or enforcement cost automatically. Business owners receive a separate list for licences, share records, accounts, distributions, shareholder loans and personal expenses paid by a company.

Reviewing a family settlement agreement

A family settlement should say exactly what is resolved and what remains open. Work through an issue schedule covering marital status, dowry, spousal support, child maintenance, custody, guardianship, residence, contact, travel, school, health, property, debts, costs and enforcement.

The drafting checklist asks for amount, currency, commencement, due date, payment method, review, notice, transfer steps and default consequences. Child arrangements are presented as workable calendars rather than broad promises. Overseas property, shares or pensions are flagged for destination-country advice before a transfer obligation is signed.

The guide also distinguishes a private document from a family-guidance agreement, court-recorded settlement or other enforceable instrument. It warns against signing wording in a language a party does not understand or exchanging child contact for maintenance.

Urgent protection and interim orders

If anyone faces immediate danger, call UAE Police on 999. Nothing written on this page is an emergency service. It helps organise information for protection, temporary maintenance, housing, child travel or another time-sensitive family application after safety has been addressed.

The incident section records dates, conduct, witnesses, police references, medical records, photographs and complete messages. The urgency section identifies what may happen, when, the supporting evidence and the proportionate order requested. It avoids general accusations that do not connect to specific relief.

Make a safe-document plan, and do not alert another person where doing so would increase the risk. It does not promise that a court, police or protection authority will make a particular order.

Civil family routes for non-Muslim couples

This section compares federal civil personal status with the Abu Dhabi Civil Family Court at a high level. Record nationality, religion where legally relevant, UAE residence, place and form of marriage, civil-marriage record, existing cases and the relief required.

The federal section identifies Federal Decree-Law No. 41 of 2022 and its executive regulation. The Abu Dhabi section uses the current ADJD court page and forms for civil marriage, no-fault divorce, post-divorce financial orders, settlements and child-custody disputes. The guide never treats “non-Muslim” as automatic Abu Dhabi jurisdiction.

It also explains that divorce status, financial consequences and children may require separate preparation. A no-fault status route does not guarantee a financial order or eliminate evidence needs.

Planning a cross-border family case

Keep jurisdiction, applicable law, service, recognition and enforcement apart from one another. It records each spouse’s nationality, residence and domicile claims; marriage and separation locations; children’s present residence; assets; active cases; foreign judgments; and the country where the outcome must operate.

The documents section covers complete foreign judgments, proof of finality, service records, marriage and birth certificates, official copies, certified Arabic translation and legalisation or attestation where required. Authentication does not by itself guarantee recognition.

The enforcement checklist considers the UAE Civil Procedure Code, any applicable treaty, originating-court jurisdiction, proper notice, finality, conflicting judgments and public policy. The guide does not assume UAE participation in a treaty without checking the current official status table.

Appeal and enforcement records

For appeal review, collect the complete judgment, proof of notification, pleadings, submissions, evidence index, hearing record where available and prior orders. Identify the precise finding challenged and the result requested. Do not rely on a generic online deadline.

For enforcement, add the enforceable judgment or settlement, proof of finality where required, party details, payment information, an arrears or compliance schedule and the specific execution measure under consideration. Money, child arrangements, passport issues and status registration may require different steps.

Appeal, correction, clarification, variation and execution are separate routes and should be kept separate. Which of them applies cannot be settled without the complete record. Use the family judgment enforcement guide.

Reading by urgency and decision stage

The most useful guide is not always the one with the broadest title. Read the one that helps with the next legal decision. Before any case, a route-selection and document guide may be enough. Once family guidance or litigation begins, work from the current notice, claim, response, order and deadline. After judgment, an enforcement or appeal records pack is more useful than a general divorce checklist.

Urgent protection, an imminent child journey, a hearing, expiring residence status or a possible appeal requires immediate individual review. Reading a page cannot test urgency, issue an application or extend a deadline. State the date and risk clearly in the inquiry form and keep official emergency numbers available where safety is involved.

For a planned matter, organise documents before paying for unnecessary translation or attestation. Confirm which original, certified copy, legalisation chain and Arabic translation the receiving court actually requires. Foreign judgments and powers of attorney often need a different preparation route from ordinary supporting documents.

Protecting privacy while you prepare

Family files contain children’s records, identity documents, addresses, health information and financial data. Upload only material relevant to the immediate review. Do not send passwords, full device backups, intimate images, unrelated medical records or another person’s account credentials. Redact an unrelated third party’s account number where the complete number is not legally relevant, but never alter the substantive evidence or original file.

Keep a clean original and a working copy. Name documents by date and subject, preserve complete message threads and record where each document came from. If authenticity may be disputed, retain the original electronic file and metadata. Do not obtain evidence through unauthorised access, impersonation, tracking software or covert publication.
