A divorce settlement agreement in the UAE can resolve financial, child and practical issues without requiring the court to decide every dispute. The value of an agreement depends on more than consent. It must use the correct legal route, identify each obligation precisely, respect mandatory law and public order, and be approved or recorded in a form that produces the intended legal effect.

Mr AlBalooshi assists separating spouses and legal-service seekers with settlement planning, document review, negotiation, drafting and the appropriate UAE approval or court process. Use the inquiry form with your name, mobile, email, emirate, marriage details, children’s ages, current case stage and the main terms under discussion. You may attach a draft term sheet or one priority court document. For the correct intake step, WhatsApp +971 50 627 5196.

An initial inquiry does not create a lawyer-client relationship or reserve representation for a session, filing, travel date, limitation period or hearing. Identity, conflicts, legal route, authority, scope and engagement must be confirmed before the team can act.

A UAE divorce settlement must fit the governing family-law route

The phrase “UAE divorce agreement” can refer to legally different instruments. The first task is to identify which law and court process apply.

For Muslim personal-status matters within Federal Decree-Law No. 41 of 2024, suitable disputes may be referred to Family Guidance. Article 8 provides that a reconciliation report signed by the parties and family counsellor and approved by the supervising judge has the force of an execution writ. The official text also restricts an appeal against that approved report except where it contradicts the law.

Dubai has an additional current conciliation framework under Law No. 9 of 2025, which amended Law No. 18 of 2021. It provides for family disputes to be proposed for conciliation, subject to statutory exclusions. A qualifying conciliation agreement signed by the disputants, approved by the conciliator and given the executory formula has the force of a writ of execution when the legal requirements are met.

Eligible non-Muslims may fall within the federal Civil Personal Status Law, Federal Decree-Law No. 41 of 2022, and Cabinet Resolution No. 122 of 2023. That no-fault divorce route can separate the divorce judgment from later financial or child issues. Abu Dhabi also operates a distinct local civil-family system under Abu Dhabi Law No. 14 of 2021 and Resolution No. 8 of 2022. The Abu Dhabi Judicial Department publishes a dedicated Post-Divorce Settlement Agreement form and a separate application for a financial order.

Do not blend these regimes. A clause copied from an Abu Dhabi civil-family form may not be the correct instrument for a Muslim divorce before Dubai Courts. A Family Guidance settlement may have a different approval route from a private agreement between spouses who have not opened a case.

A private term sheet is not automatically an executable settlement

Spouses often reach agreement by email, WhatsApp, mediation note or a signed document prepared abroad. Such material may be relevant evidence of negotiations, consent or a contractual position, but it should not automatically be described as a UAE execution writ.

There are at least four possible stages:

  1. Heads of terms: a negotiation document identifying proposed points, often subject to legal review and final drafting.
  2. Private signed agreement: a definitive document between the spouses whose validity and legal effect depend on its terms, governing law and applicable rules.
  3. Court or Family Guidance record: terms recorded and approved through the competent family process.
  4. Instrument with executory force: an approved reconciliation agreement, judgment or other legally recognised instrument capable of enforcement through the execution court.

The document should say what stage it represents. Marking every draft “binding” can create avoidable disputes; marking a final agreement “without prejudice” without understanding the consequences can do the same. Before signature, identify whether the parties intend immediate legal obligations, court approval, incorporation into a divorce process, or only a basis for further drafting.

Build the settlement around decisions, not broad promises

A reliable settlement term sheet separates status, finances, children, property, procedure and implementation. Typical headings include:

  • the divorce route and who will file or complete the required declaration;
  • dowry, waiting-period maintenance, divorce compensation or other regime-specific rights;
  • spousal support, child maintenance and housing;
  • school, medical, insurance, transport and exceptional child expenses;
  • custody, guardianship, residence, contact and handover arrangements;
  • passports, travel consent, notice and relocation;
  • use or transfer of the family home and return of personal belongings;
  • bank accounts, vehicles, shares, businesses and other assets;
  • loans, credit cards and third-party liabilities;
  • legal, translation, attestation, expert and court costs;
  • existing cases, applications, complaints, judgments or execution files;
  • performance dates, evidence of payment and document delivery;
  • claims released, preserved or deferred; and
  • the method for approval, enforcement, review or later variation.

Terms should be capable of performance. “The father will pay school expenses” may not answer which school, which charges, when payment is due, whether payment goes to the school or parent, how invoices are shared, and how a change of school is approved. “Reasonable visitation” may not answer the weekday, time, location, holidays, transport or notice period.

These decisions are easier to settle when each is written out on its own: a payment calendar with dates and amounts, a child-arrangements schedule precise enough to follow, a table of assets and debts, and a note of what still needs approval and by whom. Vague terms such as “reasonable” tend to be where later disputes start.

If you would like a draft or a set of agreed principles considered for a consultation, describe them through the inquiry form. The scope of any assistance is confirmed after review.

Financial disclosure should come before final releases

A spouse cannot evaluate a financial settlement sensibly without understanding the material financial position. Appropriate disclosure depends on the claims and legal route, but may include:

  • recent salary and employment records;
  • bank and investment statements lawfully available to the disclosing party;
  • company ownership and reliable business accounts;
  • property ownership, financing and valuation material;
  • end-of-service, pension or employment-benefit information;
  • loans, guarantees, credit liabilities and tax exposure;
  • regular household and child expenses;
  • existing maintenance payments and arrears; and
  • foreign assets, trusts, companies or proceedings where relevant.

Disclosure should be proportionate and lawful. A spouse should not hack an account or take confidential company data without authority. If material information is withheld, the available court, expert or disclosure route should be considered.

Record the valuation date and currency. A property estimate, business balance sheet and bank balance from different dates may create a misleading total. Identify whether an amount is gross, net of secured debt, jointly owned, disputed or located outside the UAE.

A broad waiver of “all present and future financial claims” may be significant. It should not be signed on the assumption that an undisclosed asset can always be pursued later. The availability of a later challenge depends on the instrument, law, facts, fraud or deception allegations and strict procedural rules.

Maintenance clauses need amounts, dates and proof of payment

A maintenance settlement may address spousal support, child support, housing, education, healthcare, transport, domestic assistance or other items recognised under the applicable regime. Each obligation should identify:

  • the beneficiary;
  • the amount or objective calculation method;
  • the start date and due date;
  • the payment account or authorised channel;
  • currency and transfer charges;
  • duration and any lawful review trigger;
  • invoices or evidence required for variable expenses;
  • treatment of historic arrears;
  • credit for payments already made; and
  • what happens if payment is late or disputed.

Separate current monthly support from accumulated arrears and one-off expenses. If an existing judgment or interim order is in force, explain whether the settlement satisfies, replaces or preserves it and what formal step is needed. A private agreement should not be assumed to cancel an enforceable court order.

Avoid unsupported automatic escalation clauses or foreign-index formulas that are impossible to verify. If the amount changes with school fees, income or residence, specify the evidence, timing and dispute mechanism. Read Alimony and Maintenance in UAE Divorce for the legal distinctions behind the drafting.

Child arrangements are not ordinary commercial consideration

Parents can agree practical arrangements, but a child is not property and child-related rights are not simply exchanged for money. The child’s welfare and the competent court’s powers remain central. A settlement should avoid language suggesting that one parent “owns” custody or that contact is purchased by waiving maintenance.

Useful provisions may address:

  • ordinary residence and the weekly care schedule;
  • school days, weekends, public holidays and religious occasions;
  • summer and overseas holidays;
  • collection, return, transport and authorised adults;
  • telephone or video contact;
  • routine and emergency medical decisions;
  • school access, reports and parent meetings;
  • passports, visas and travel documents;
  • advance notice and written travel consent;
  • relocation proposals and the response process;
  • communication between parents; and
  • safe variation as the child grows.

Custody, guardianship, residence, travel authority and contact are distinct concepts. Agreement that a child lives mainly with one parent does not necessarily transfer all guardianship powers. A travel clause should identify destination information, notice, consent, passport handling and return arrangements without pretending to override an authority that must make its own decision.

Do not ask a child to choose terms, deliver proposals or sign an adult settlement. If there are allegations of violence, coercion, abduction risk or serious welfare concern, an urgent or protection route may be needed instead of ordinary negotiation.

Property and debt clauses must respect third-party rights

A settlement between spouses cannot automatically bind a bank, landlord, company, land registry, pension administrator or foreign authority. If one spouse agrees to transfer a mortgaged property or take responsibility for a joint loan, the creditor’s consent and separate transfer process may still be required.

For each asset or debt, identify:

  • legal owner and any disputed beneficial claim;
  • current location and registry;
  • valuation basis and date;
  • secured debt or third-party interest;
  • transfer, sale or retention method;
  • who pays fees, finance, insurance and maintenance pending completion;
  • documents and signatures required;
  • deadline and fallback if consent or transfer is refused; and
  • foreign-law or tax advice required.

Do not use a release between spouses as proof that a lender released a borrower. Do not promise a company-owned asset without confirming corporate authority. Shares in a UAE or foreign company may need board, registry or contractual steps that are separate from the family settlement.

Personal belongings should also be specific. Use an inventory and collection protocol rather than “all items to be returned”. Identify children’s documents, jewellery, family records, work equipment and items whose ownership is disputed.

Dubai conciliation agreements have formal content and approval rules

Dubai’s conciliation framework contains important safeguards for agreements within its scope. Article 23 of Law No. 18 of 2021, as substituted by Law No. 9 of 2025, requires plain language and party identification, permits a definitive and binding form where proper approval is obtained, and prohibits terms conflicting with legislation, UAE public order or morals. The framework also addresses the effect of settlement on the underlying litigation; the precise provision should be checked in the current text before signature.

The law requires entry of the agreement in Arabic in the system and conciliator approval. A foreign-language version must be prepared in dual text and attested by a legal translator licensed by the competent UAE entities; the language and precedence rules should be confirmed from the current text. It also expressly allows a disputant to consult any person and have the draft reviewed before signature and approval.

Article 27 of Law No. 18 of 2021, as substituted by Law No. 9 of 2025, sets requirements for approval and the executory formula, including authorised conciliator status, system registration, signatures, capacity and consistency with public order and morals. The framework also provides a short grievance route in specified cases; the precise provision should be checked in the current text.

These rules do not mean that every private family agreement must use the Dubai CASD process. They explain the legal effect and formal requirements of a conciliation agreement within that framework. The competent route must be confirmed from the dispute, court and current filing stage.

Abu Dhabi civil-family settlements follow a separate local pathway

The Abu Dhabi Civil Family Court publishes its own Post-Divorce Settlement Agreement form, no-fault divorce documents and financial-order application. The court’s official guidance states that where an amicable financial settlement is not achieved, a post-divorce financial-order application may be made after the divorce judgment.

Abu Dhabi’s local civil-family law and regulation address no-fault divorce, post-divorce financial claims, expert assessment and joint custody. They should be analysed separately from the federal Muslim Personal Status Law and Dubai’s conciliation provisions. Eligibility for the civil-family court must also be confirmed.

An agreement may need to align with the local court form and case-management direction. If the parties have children, financial terms and the parenting arrangement should be complete enough for the court to understand what is agreed and what, if anything, remains for decision.

Use the Abu Dhabi Civil Family Court guide for the route overview. Do not rely on an unofficial adaptation of the court form when the current official version is available.

International families should test performance in every relevant country

A UAE settlement may refer to foreign property, overseas bank accounts, children who travel, a foreign divorce, another nationality’s pension or a spouse living abroad. A clause can be valid in the UAE yet require a separate order, deed, registration or recognition process elsewhere.

Before signing, ask:

  • Which country controls transfer of each foreign asset?
  • Will a foreign court recognise the UAE divorce or child arrangement?
  • Does a treaty or local recognition procedure apply?
  • Are notarisation, legalisation, apostille or MOFA attestation required?
  • Is a local pension, tax or company consent needed?
  • Could a broad release affect a claim pending abroad?
  • Which language version will be used in each jurisdiction?
  • How will service and enforcement work if one party leaves the UAE?

Avoid a clause stating that the agreement is “enforceable worldwide”. No document can guarantee that result. Obtain local advice where performance or recognition is required and coordinate the instruments so that one does not contradict another. See Cross-Border Family Law for the wider jurisdiction and recognition issues.

Negotiation should be informed, safe and properly authorised

Settlement requires genuine consent. Tell the lawyer or competent authority about threats, financial control, restricted access to documents, stalking, disability, interpretation needs, immigration pressure or child-safety concerns. A person should not sign a final release because a spouse threatens to withhold a passport, essential payment or access to a child.

If a representative negotiates under a power of attorney, confirm whether the authority permits negotiation only or signature of final settlement terms. A general litigation power should not be assumed to include every compromise, waiver, property transfer or child-related decision.

Keep communications factual and confidential. Do not threaten publicity, criminal accusations or immigration action to obtain financial concessions. Do not record private meetings or access accounts without advice on UAE law.

Parties should have time to read the final version and compare it with the term sheet. In Dubai’s statutory conciliation framework, the law expressly recognises the disputant’s discretion to consult another person and obtain draft review before signature.

A pre-signature review should answer twelve practical questions

Before approving a divorce settlement, check:

  1. Are the parties, marriage, children, court and existing cases correctly identified?
  2. Does the document use the correct legal regime and approval pathway?
  3. Is every obligation clear enough to perform without another negotiation?
  4. Are financial figures supported and material assets or debts disclosed?
  5. Are current support, arrears and future variable expenses separated?
  6. Are child terms workable and consistent with welfare and legal authority?
  7. Does the agreement preserve necessary claims and release only intended claims?
  8. Are third-party consents and separate transfer documents identified?
  9. Are Arabic and translated texts accurate, complete and properly certified?
  10. What happens to existing cases, orders and execution files?
  11. Where and how will breach be enforced?
  12. What foreign steps remain after UAE approval?

Record unresolved points. A settlement can be partial if the document clearly identifies what is agreed and what remains for adjudication. It is safer to preserve an issue expressly than to assume silence leaves it open.

From signed terms to an enforceable result

The implementation plan should be written before signature, not improvised afterward. It may include:

  1. final legal and translation review;
  2. signature by parties or properly authorised representatives;
  3. submission through Family Guidance, conciliation or the competent court route;
  4. approval, judgment or executory formula where applicable;
  5. withdrawal or amendment of identified proceedings;
  6. payment and document handover;
  7. property, bank, company, school or immigration steps;
  8. delivery of the enforceable copy to each party;
  9. proof of performance; and
  10. opening or updating an execution file if a clear obligation is breached.

An approved agreement should be stored with the divorce judgment, translations, proof of service and payment records. Do not rely on the last draft in an email chain. If the agreement changes an existing execution file, obtain the correct official record of that change.

For later non-compliance, the Family Judgment Enforcement guide explains executory copies, arrears schedules and the role of the execution judge.

Settlement drafting errors that create future disputes

Common problems include:

  • using the wrong family-law regime or court form;
  • signing before financial disclosure is complete;
  • undefined phrases such as “all expenses” or “reasonable access”;
  • no start date, payment channel or currency;
  • failing to credit previous payments;
  • mixing child contact with maintenance concessions;
  • promising transfer of a mortgaged or company-owned asset without third-party approval;
  • waiving claims that were never identified;
  • ignoring an existing order or foreign proceeding;
  • inconsistent Arabic and English versions;
  • no plan for foreign property or overseas enforcement;
  • a representative signing without adequate authority;
  • closing a case before required performance; and
  • assuming regret creates a normal right of appeal.

The objective is not the longest agreement. It is a lawful document that enables both parties, the court and an execution judge to understand exactly what was resolved.

How the family-law team can assist with divorce settlement planning

Subject to conflicts, jurisdiction and agreed scope, the family-law team may assist by:

  • identifying the correct Muslim, federal civil or Abu Dhabi civil-family route;
  • reviewing existing court, Family Guidance and foreign proceedings;
  • preparing a settlement term sheet and disclosure request;
  • analysing maintenance, arrears, housing and child-expense proposals;
  • drafting precise custody, guardianship, contact, travel and passport terms;
  • mapping assets, debts, businesses and third-party consents;
  • negotiating or responding to settlement proposals;
  • reviewing Arabic and translated drafts with appropriate professionals;
  • preparing the agreement for the competent approval process;
  • coordinating foreign counsel where performance is required abroad; and
  • planning evidence of performance and enforcement if a term is breached.

No lawyer can guarantee that the other party will agree, the court will approve every term, a third party will consent, or another country will recognise or enforce the arrangement.

Frequently asked questions about divorce settlement agreements in the UAE

1. Is a WhatsApp agreement a valid divorce settlement in the UAE?

Messages may be evidence of negotiation or agreement, but they are not automatically an approved or executable family settlement. The wording, consent, legal route and formal approval must be reviewed.

2. Does a settlement itself end the marriage?

Not necessarily. The divorce must be completed through the legally applicable court or status procedure. Settlement terms may accompany or follow that process.

3. Can a Family Guidance agreement be enforced?

Under Article 8 of the federal Personal Status Law, a qualifying reconciliation report approved by the supervising judge has execution-writ force. The actual approved instrument and terms must be checked.

4. What makes a Dubai conciliation agreement executable?

Dubai Law No. 9 of 2025 requires the statutory agreement, signatures, proper conciliator approval, system registration and executory formula, together with the other legal conditions.

5. Can I have the draft reviewed before signing in Dubai?

Yes. Dubai’s 2025 conciliation amendments expressly allow a disputant to consult any person and have the draft reviewed before signature and approval.

6. Which language should the settlement use?

The applicable authority determines filing language. Dubai’s conciliation law requires system entry in Arabic and regulates an attested dual-text translation, with Arabic prevailing over English in a conflict.

7. Can spouses agree the amount of maintenance?

They may negotiate lawful financial terms, but the agreement should identify beneficiary, amount, due date, duration, evidence, arrears and enforcement. Child welfare and mandatory law remain relevant.

8. Can custody be exchanged for a financial waiver?

Child arrangements are not ordinary commercial consideration. The child’s welfare and the court’s powers remain central, and maintenance and contact should not be used as improper leverage.

9. Does a settlement release a bank from a joint loan?

No. A private allocation of responsibility between spouses does not automatically release either borrower. The lender’s written consent or separate restructuring may be required.

10. What if a spouse hides an asset before settlement?

The legal consequences depend on disclosure duties, wording, approval route and facts, including possible fraud or deception. Obtain urgent advice and preserve lawful evidence.

11. Can an agreement cover property outside the UAE?

It can state obligations concerning foreign property, but transfer or enforcement may require a separate deed, order, registration and advice in the property’s country.

12. Can we settle only some divorce issues?

Potentially. A partial settlement should state exactly what is resolved, what remains disputed and how pending proceedings or interim orders are affected.

13. Can a signed settlement be appealed because I changed my mind?

Do not assume so. Approved Family Guidance and Dubai conciliation instruments have restricted challenge routes. Capacity, lawfulness, fraud, deception and the exact instrument require immediate review.

14. What happens if the other spouse breaches the agreement?

If the instrument has executory force, an execution application may be available. A merely private document may require a different claim or approval step. Review the final official copy.

15. How can Mr AlBalooshi review a proposed settlement?

Use the inquiry form with the emirate, case stage, key terms and latest draft, or WhatsApp +971 50 627 5196 for intake. Work starts only after conflicts, scope and engagement are confirmed.
