Enforcing a foreign judgment in the UAE requires more than an authenticated copy of the overseas order. The UAE court must identify the correct recognition or enforcement route, test the judgment against federal procedural conditions and any applicable treaty, and decide what effect the order can lawfully have in the UAE. Divorce status, child arrangements, maintenance and property directions may each require a different analysis.
Mr AlBalooshi assists families with UAE recognition and enforcement planning, document review and applications before the competent onshore court. Use the inquiry form or WhatsApp +971 50 627 5196 and upload the complete judgment, proof of finality, service records and certified translations if available. Early review can expose a notice, jurisdiction or public-policy problem before time and cost are committed to the wrong procedure.
A foreign judgment is not automatically executable in the UAE
The Civil Procedure Code has been amended since it was promulgated. Article numbering in the enforcement chapter should be checked against the current consolidated text before a citation is relied on in a filing.
A judgment issued outside the UAE does not enforce itself against a person, bank account, salary, property or civil-status record in the Emirates. The applicant ordinarily needs an order from the competent UAE court or execution judge. The route may also depend on whether a treaty applies between the UAE and the country of origin.
Recognition and enforcement are related but distinct. Recognition asks whether the UAE legal system will accept the foreign decision and its legal effect. Enforcement asks whether coercive measures can be used to obtain payment, transfer property or compel compliance. A foreign divorce may be recognised for marital status even when separate steps are needed for maintenance, custody or assets.
The foreign court’s description is not conclusive. An “order,” “decree,” “consent judgment,” “certificate” or “minute” must be examined by legal effect, finality and enforceability under the law of origin.
The Civil Procedure Code is the starting point for onshore enforcement
The Civil Procedure Code (Federal Decree-Law No. 42 of 2022) on Civil Procedure governs enforcement in the UAE of judgments and orders made in a foreign country, unless a treaty provides another route. The statutory test is applied by the UAE court and should be addressed with evidence, not assumptions.
The court examines matters including whether:
- the UAE courts lack exclusive jurisdiction over the dispute and the foreign court had jurisdiction under its own conflict rules;
- the parties were properly summoned, appeared or were validly represented;
- the judgment has the force of res judicata under the law of the issuing country;
- the foreign judgment conflicts with no UAE judgment or order; and
- the result contains nothing contrary to UAE public order or morals.
The exact Arabic legislation, current judicial practice and any treaty must be reviewed for the particular application. A translated summary is not a substitute for the judgment and procedural record.
Treaty analysis comes before the ordinary statutory route
The UAE participates in bilateral and regional judicial-cooperation arrangements. A treaty may address recognition, service, documents, competent authorities or execution and can alter the ordinary route. The relevant questions are the country of origin, the subject matter, the date, the designated courts and whether the instrument is in force between both states.
Do not rely on a general statement that two countries have “reciprocity.” Obtain the treaty text or official status information and confirm that it covers the particular family judgment. Some arrangements focus on civil and commercial money judgments, while personal-status, child or public-law measures may be excluded or treated separately.
The UAE Ministry of Justice maintains official information on bilateral judicial agreements. The agreement and the Civil Procedure Code should be considered together rather than treated as competing shortcuts.
Recognition of a foreign divorce needs a status analysis
A foreign divorce judgment may need UAE recognition before it is relied on to update marital-status records, remarry, sponsor family members or resolve a later personal-status case. The applicant should provide the marriage certificate, complete divorce judgment, finality evidence, proof of service and the identity documents that connect the names in every record.
The court may examine whether the issuing court had jurisdiction, whether both spouses had notice and whether the divorce is final. It may also assess the applicable personal-status regime. Federal Decree-Law No. 41 of 2024 is the current federal Personal Status Law for matters within its scope, while Federal Decree-Law No. 41 of 2022 provides a civil personal-status framework for qualifying non-Muslims. Abu Dhabi’s civil-family system is a distinct local route and should not be confused with every onshore application.
Recognition of marital status does not necessarily approve every financial or child-related paragraph in the same foreign decision.
Foreign custody orders require a child-centred UAE review
A foreign custody or parenting order is not simply converted into a UAE execution file. The child’s present location, welfare, passports, residence, schooling, guardianship position, travel restrictions and later orders must be identified. UAE concepts of custody and legal guardianship may not correspond exactly to foreign concepts such as parental responsibility or legal custody.
The applicant should explain the practical relief sought: return of the child, residence, contact, passport delivery, travel permission, school decision-making or protection. The UAE court may need to decide whether the foreign order can be recognised, whether new local relief is required and whether urgent interim measures are justified.
Never move a child, retain a passport or breach a current order merely because a foreign judgment exists. Treaty status, including any claimed Hague Convention mechanism, must be checked from the official status table for the countries and date concerned.
Foreign maintenance judgments raise calculation and collection issues
A maintenance order may include spousal support, child maintenance, arrears, interest, indexation, expenses or costs. The UAE application should separate each amount and explain the calculation period, currency and any payments already received.
The foreign judgment must ordinarily be final and enforceable in its country of origin. If the order remains variable, provisional or subject to appeal, the UAE effect requires specific analysis. A certificate from the issuing court may be needed to establish finality, enforceability and the outstanding balance.
Once recognised, actual recovery still depends on lawful execution measures and identifiable UAE assets or income. The debtor can raise permitted objections, including payment, satisfaction, mistaken identity or defects in the recognition basis.
Property directions may exceed the UAE court’s practical reach
A foreign family judgment might require the transfer of real estate, company shares, bank funds, a pension or trust interests. Each asset follows the law and registration system of its location. A foreign direction concerning Dubai land does not itself alter the Dubai land register.
The UAE court will consider the character of the order, jurisdiction and public policy, while the relevant registrar or institution may require a local executable instrument. Company-owned assets are not the same as personally held shares. Joint accounts, nominees and beneficial-ownership allegations require evidence rather than assumption.
Prepare an asset schedule showing legal owner, location, approximate value, encumbrances, account or title identifiers and the exact order affecting it. This determines whether recognition, a local substantive claim, execution or a settlement implementation document is needed.
Default judgments are tested through service and opportunity to be heard
A default judgment is not automatically refused, but proof of valid notice is critical. The applicant should show what originating process was served, by which method, at which address, on what date and under which rule or treaty. If substituted service was authorised, include the authorising order and compliance evidence.
Email delivery, a messaging screenshot or knowledge of the dispute may not prove formal service. Conversely, a party who participated through counsel may not be able to deny awareness merely because a preferred method was not used. The UAE judge will assess the official record.
Where the defendant alleges fraud, concealment or inability to participate, preserve the originating claim, summons, affidavits, hearing notices, attendance records and reasons for judgment. A one-page final order rarely contains enough procedural history.
Finality and res judicata need official proof
The court needs reliable evidence that the foreign judgment has the required binding effect. Provide a certificate of finality, no-appeal certificate or equivalent official confirmation from the issuing court, together with an explanation of any remaining appeal or variation rights.
Family orders can be unusual because child arrangements or ongoing maintenance may remain modifiable. That does not necessarily make every part ineffective, but the applicant must identify which provisions are final, accrued and presently enforceable.
If an appeal is pending, say so. If only part of the judgment was appealed, identify that part. Concealing procedural status can undermine the application and create inconsistent orders.
UAE public policy is a substantive enforcement safeguard
The UAE court can refuse a result that conflicts with public order or morals. Public policy is not a general invitation to retry the foreign case, but it is a mandatory safeguard. Its application can be especially important in personal-status, child, guardianship and succession matters.
The analysis should distinguish the foreign court’s reasoning from the specific remedy to be recognised. A severable financial paragraph may be treated differently from a child or status provision. The competent court decides whether any part can operate consistently with UAE mandatory rules.
Do not promise recognition because the overseas case was fully contested or decided by a respected court. Procedural fairness does not remove the public-policy test.
Authentication confirms the document chain, not the merits
Foreign judgments commonly require certification, legalisation or attestation and certified Arabic translation. The exact chain depends on the issuing country and any applicable convention or bilateral arrangement. The UAE Ministry of Foreign Affairs provides the current attestation service for documents intended for use in the UAE.
Attestation verifies signatures or seals in the document chain; it does not prove that the judgment satisfies the Civil Procedure Code. Translation likewise communicates the document but does not establish jurisdiction, finality or valid service.
Names, dates, case numbers and operative terms must match across the source and translation. Correct discrepancies before filing and retain the complete source-language judgment.
The correct UAE court depends on the connection and remedy
The competent court may depend on the defendant’s domicile or residence, the place of execution, asset location, subject matter and local judicial system. Dubai, Abu Dhabi and the federal courts have different portals and procedural practices even when federal legislation supplies the core test.
Abu Dhabi Judicial Department publishes a specific request form for foreign-judgment enforcement. Its existence does not establish that Abu Dhabi is competent in every case. Similarly, DIFC and ADGM courts have their own jurisdictional regimes and are not general substitutes for UAE onshore family courts.
Before filing, identify the UAE person, asset, record or conduct to be affected and explain the court’s territorial and subject-matter competence.
A recognition file should answer every statutory condition
Prepare a structured bundle containing:
- the complete certified foreign judgment and all operative schedules;
- proof that it is final, binding and enforceable in the country of origin;
- the originating claim, summons and official service evidence;
- attendance or representation records for every party;
- the marriage, birth and identity documents relevant to status or children;
- a certified Arabic translation of each relied-on document;
- the authentication or attestation chain;
- a calculation of money due, payments, interest and currency conversion;
- all UAE and foreign judgments involving the same parties or issues; and
- evidence locating the defendant, child, asset or record in the UAE.
The application should state the exact relief requested and address each possible conflict. Do not submit hundreds of unindexed messages when the court first needs jurisdiction, service, finality and operative terms.
Objections can arise before and during execution
The respondent may challenge recognition or raise an execution objection. Common issues include exclusive UAE jurisdiction, defective notice, lack of finality, inconsistent judgments, public policy, payment, variation, identity or an order directed at property outside the respondent’s ownership.
An objection should identify the legal ground and supporting document. Disagreement with the foreign court’s fact-finding is not automatically a permitted rehearing. Equally, the applicant should not describe every objection as delay; the Civil Procedure Code contains real safeguards.
Urgent asset-protection requests, travel restrictions or child measures have separate legal thresholds. They should not be presented as automatic consequences of filing a recognition application.
Mr AlBalooshi’s foreign-judgment review focuses on enforceable outcomes
Mr AlBalooshi can assess the judgment provision by provision, identify the competent UAE route, coordinate authentication and translation, prepare the the Civil Procedure Code evidence matrix, respond to objections and plan execution against identifiable UAE assets or records.
The first review should answer three practical questions: what part of the foreign decision can be recognised, what can be enforced in the UAE, and what new UAE relief may still be required. This prevents a status order, custody direction and money award from being treated as if they have identical legal effects.
Set out the foreign judgment and where it was given through the inquiry form. The scope of any assistance is confirmed after review. Upload the full order, proof of finality and service, a one-page chronology and details of the UAE connection. For legal intake, WhatsApp +971 50 627 5196.
Frequently asked questions
Can a foreign court judgment be enforced automatically in the UAE?
No. A competent UAE court ordinarily must recognise or order enforcement under the Civil Procedure Code, an applicable treaty or another valid route.
What conditions apply to enforcing a foreign judgment?
The court examines jurisdiction, valid notice and representation, finality, conflict with UAE judgments and UAE public order, among other statutory requirements.
Can the UAE recognise my overseas divorce?
Potentially. The court will review the issuing court’s jurisdiction, service, finality, relevant personal-status regime and public-policy considerations.
Does recognition of divorce enforce custody and maintenance too?
Not necessarily. Marital status, child arrangements, maintenance and property provisions may require separate analysis or applications.
Can a foreign custody order be used in Dubai?
It may be relevant, but the child’s location, welfare, guardianship position, notice, later orders and the precise local relief must be reviewed.
Will the UAE enforce a foreign child-maintenance order?
It may if the applicable legal requirements are met. Provide finality evidence, an arrears calculation, payment history and details of UAE income or assets.
Is a default judgment enforceable?
Possibly, but official proof of valid service and a fair opportunity to participate is especially important.
Do I need a certificate showing the judgment is final?
Usually, reliable official evidence of finality and enforceability is central to the application. The required document varies by issuing court.
Must the foreign judgment be translated into Arabic?
UAE court use ordinarily requires certified Arabic translations of relied-on foreign-language documents, while retaining the complete originals.
Is MOFA attestation enough to make the judgment enforceable?
No. Attestation authenticates the document chain; the UAE court still examines the Civil Procedure Code, any treaty and the judgment’s legal effect.
Can a treaty make enforcement easier?
A relevant bilateral or regional treaty may provide a specific route, but its country, court, subject-matter and date coverage must be verified.
Can the UAE court refuse a judgment for public-policy reasons?
Yes. The court may refuse a result that conflicts with UAE public order or morals, particularly where mandatory family-law protections are engaged.
Which UAE court should receive the application?
Competence depends on the emirate, respondent, asset or place of execution, subject matter and the applicable judicial system.
Can I freeze assets as soon as I file?
Do not assume so. Interim measures have separate jurisdictional and evidential requirements and are decided by the competent court.
What should I send Mr AlBalooshi for an initial review?
Send the full judgment, finality certificate, originating papers, service proof, translations, related orders, a chronology and the UAE asset or status connection.
