This UAE maintenance guide explains how to organise income, needs, child expenses, direct payments and supporting documents before seeking advice. It is a written guide, not a form: nothing on this page collects a figure or totals one. Spousal maintenance, child maintenance, temporary support, civil financial orders, arrears and variation are different questions, and treating them as one number is the most common preparation mistake.

Use the Child Maintenance Budget Worksheet to put these figures in order. It is a private, browser-based organisational worksheet: you enter recurring expenses monthly or annually and it converts them into transparent monthly and annual totals, keeps one-off costs separate, and lists the evidence that supports the categories you used. Everything stays in your browser and nothing is sent anywhere. It does not predict, recommend or calculate a legally recoverable maintenance award, applies no percentage of income and no court formula, and does not replace review by a qualified UAE lawyer.

Whatever you assemble, do not use it as a demand, a court valuation or a substitute for legal advice. No total on a spreadsheet establishes a legal entitlement.

Identify the type of financial issue

More than one may apply at once. Keep the totals for each of them separate.

Spousal maintenance

Spousal maintenance concerns support claimed by one spouse under the governing personal-status regime. Entitlement, amount and duration are not uniform. The marriage status, applicable law, means, needs, conduct where legally relevant, prior agreement and other statutory factors may matter.

Child maintenance

Child maintenance concerns the child’s legally recognised needs and the responsible parent’s duty under the applicable law. It can involve food, clothing, housing, education, health care, transport and other supported needs. It belongs to the child and should not be used as payment for contact.

Temporary or urgent support

Interim maintenance may address immediate needs while a case continues. The application should show current circumstances, what stopped, the shortfall, supporting documents and the specific temporary order requested.

Arrears, enforcement or variation

Arrears are based on an existing obligation, payment history and operative dates. Enforcement seeks compliance with an order. Variation asks the court to change an obligation because of a legally relevant change. These are not the same calculation.

Identify the family-law framework before entering figures

Choose Muslim personal status, federal civil personal status, Abu Dhabi civil-family rules or not yet known. If uncertain, use the Which Law Applies? Navigator.

Federal Decree-Law No. 41 of 2024 governs Muslim personal-status matters within its scope and contains maintenance provisions. Federal Decree-Law No. 41 of 2022 and Cabinet Resolution No. 122 of 2023 create a different civil framework for qualifying non-Muslims, including financial consequences of divorce. Abu Dhabi’s Civil Family Court has its own local framework and forms, including a post-divorce application for a financial order.

The guide does not merge these regimes into one formula. It stores the selected route and labels the result “route to be confirmed” until the legal documents are reviewed.

Record monthly household needs using actual categories

Work in monthly amounts. Where an expense is annual or charged by term, keep the original amount and its frequency alongside the monthly equivalent rather than only the converted figure, because the original is what the invoice shows. The legal treatment of a cost may still differ from its arithmetic.

Housing and household costs

Account for rent or mortgage occupancy cost, service charges where relevant, electricity, water, cooling, essential communications, domestic help actually used and routine household supplies. State whose name is on the tenancy or title and who currently pays.

Do not place the full mortgage principal into a maintenance total without advice. Ownership, debt repayment and housing support may be distinct. If a spouse provides a residence directly, record that as a direct benefit rather than counting rent that is not paid.

Personal living costs

Account for food, necessary clothing, local transport, medical insurance, treatment, medication and other regular personal needs. Keep a one-off legal, travel or luxury cost apart from the recurring figures. Watch your own working for round numbers with nothing behind them and for a sudden departure from the recent household pattern: both are the first things a court or an opponent will test.

Child-specific expenditure

Create a separate record for each child: food, clothing, share of suitable housing, school tuition, transport, books, uniform, health insurance, medical treatment, childcare and established activities. Add special educational or medical needs with a note and evidence.

Do not duplicate an expense paid directly by the other parent. If school fees are paid to the school, record the total and identify the direct payer.

Record income and financial resources accurately

Enter salary, allowances, bonuses, commission, dividends, regular drawings, rental income, investment income, pension, end-of-service payment received, benefits in kind and other recurring support. Mark each entry gross or net and attach the period it covers.

A bank deposit is not always income; it may be a transfer, loan or reimbursement. Likewise, a low declared salary may not show all resources where a person controls a business. Use evidence and explain non-recurring items.

For the person seeking support, include available income and resources. For the proposed payer, enter only figures supported by lawful information. Do not access private accounts without permission or invent an estimate. Where a figure is genuinely unknown, write “not known” against it rather than entering a zero: a zero reads as a finding, and an open question reads as an open question.

Separate business turnover from personal means

Business-owner cases require a bridge from company records to personal resources. Company turnover, profit, cash and shareholder value are different. Enter salary, dividends, director or shareholder loan movements, personal expenses paid by the company and benefits separately.

Upload only records lawfully available: payslips, employment contract, dividend vouchers, personal statements, audited accounts or management accounts already provided. Do not take customer databases, privileged legal advice or an entire office server.

Where income fluctuates, work out a 12-month average yourself for planning and keep each month’s figure beside it. That average is not a legal assessment. Seasonality, one-off distributions, debt and retained working capital require explanation. See the financial disclosure checklist.

Show direct payments, benefits and shared expenses

Keep a separate list of expenses paid straight to a provider — school, rent, insurance, medical bills, transport — recording payer, recipient, amount, frequency, date and proof. This prevents the same need appearing both as an unpaid cash request and a paid benefit.

Shared household costs should be allocated transparently, and you should show the working. Nothing on this site allocates a share between two people, and a court is not bound by any allocation you propose. A child’s housing need cannot always be reduced to a simple percentage of rent, and an adult’s ownership interest cannot be resolved through a maintenance worksheet.

If payments stopped, record the last payment date and the reason given. Preserve messages and bank records without provoking contact.

Distinguish an expense total from a legal claim

Four figures are worth setting out separately in your own note:

  1. declared monthly personal needs;
  2. declared monthly child needs, by child;
  3. known direct payments and benefits; and
  4. the declared monthly shortfall after those payments.

Work them out yourself. The Child Maintenance Budget Worksheet will convert the child-cost figures you enter into a monthly and annual view and total them, but it does not separate personal from child needs, does not deduct direct payments and does not produce a shortfall. These figures describe entries, not legal entitlement. The applicable law may treat categories differently, require proportionality to means, allocate responsibility in a particular way or consider a marital agreement and other statutory factors. The court may accept, reduce, reject or reclassify an item.

Describe every figure as declared, documented or unverified. Nothing on this site will tell you what you will receive, state a minimum award or put a probability on success, and a preparation note you write yourself should not either.

Score evidence readiness without scoring the merits

Against each entry, note what supports it: an invoice or official statement, bank proof, a contract or fee notice, a written communication, an estimate only, or no document at all. Then mark the entry yourself as one of four states:

  • documented: amount and payment are supported;
  • partly documented: amount is supported but payer, frequency or purpose is unclear;
  • estimate: reasonable description exists but no current record is attached; or
  • missing: entry needs clarification before it can be relied on.

The Child Maintenance Budget Worksheet lists the evidence to gather for the categories you used; it does not score how well documented an entry is. That judgement is yours. It measures organisation, not whether a judge will award the expense. Authenticity, relevance, translation and lawful collection still need review. Use evidence in UAE family court for the next step.

Prepare a temporary-maintenance request around the immediate shortfall

For an interim issue, record the date support changed, the cash currently available for essential needs, the obligations falling due before the next hearing and any payments the other spouse is still making. Prioritise housing, food, health, education and child safety. Separate disputed historic spending from the urgent current need.

Add the marriage certificate, case number, budget, income evidence, recent payment record and notices for imminent rent, school or medical costs. Explain why the request cannot wait. Do not inflate a temporary budget to create negotiation room; inconsistencies can undermine credibility.

Nothing on this site selects an interim legal remedy; that depends on the competent court and route. If it is the order of events that matters, the Family Case Timeline Planner will put entries you type into date order in your own browser.

Calculate arrears from the operative order, not memory

For arrears, work from the exact order terms: amount, currency, first due date, frequency, direct-payment duties and any adjustment clause. Then list every payment with date, amount, method and allocation. Subtracting proved payments from scheduled amounts is bookkeeping, and nothing more than bookkeeping.

Do not include an expense that the order did not require without identifying it separately. Do not ignore partial payments. If there is disagreement about whether a transfer was maintenance, preserve the reference and communications.

Interest, penalties, execution costs and currency conversion require legal analysis; the guide does not add them automatically. Once the schedule is complete, review family judgment enforcement.

A variation request needs proof of a material change

Select the event said to justify change: income loss, new employment, altered school fees, medical need, changed care arrangement, relocation, payment made directly or another circumstance. Record the date and the supporting document.

An existing order remains operative until changed or otherwise dealt with through the proper process. Do not reduce payment unilaterally because your own figures show a lower current shortfall. A voluntary resignation, asset transfer or unsupported claim of reduced income may attract scrutiny.

Compare the budget and income at the time of the order with current figures using the same categories. This makes the alleged change visible without pretending the arithmetic answers the legal test.

Civil financial orders require regime-specific factors

The federal civil personal-status decree-law and its executive regulation provide a framework for financial consequences of divorce for qualifying non-Muslims. Abu Dhabi’s official Civil Family Court guidance identifies a post-divorce financial-order application where settlement is not reached. The timing and factors must be taken from the route that applies.

A civil financial claim may involve more than monthly support. The law, marriage duration, spouses’ financial positions, contributions and other prescribed considerations may be relevant. Do not convert a Muslim maintenance budget into a civil compensation or financial-order calculation.

Keep any marital agreement, settlement proposal, asset schedule and divorce judgment separate, and take them to a lawyer for review. None of them yields a figure by arithmetic.

Child maintenance and parenting time must remain separate

Contact, custody and maintenance are separate legal issues. A parent should not stop support because contact is obstructed, and the other parent should not withhold contact to enforce payment. Each problem has a court process.

Record how nights and daily care affect the actual expenses, in your own note. Nothing on this site prices time with a child. A joint-custody schedule may affect practical allocation without removing either parent’s duties under the governing law.

For school, medical and activity costs, state whether consent is required, who chose the provider and whether the order addresses changes. See child maintenance and parenting plans.

Protecting privacy while you prepare

Use initials for children in whatever you write, whether that is a notebook, a spreadsheet or the browser-based worksheet linked above. Keep bank passwords, full card numbers, medical detail beyond what is necessary and unrelated third-party information out of it entirely. Where a statement has to be shown, redact the account number and keep the name, date, amount and transaction context, which are the parts that carry the meaning.

Household figures are more sensitive than people expect, particularly while both parties still share a home or a device. Keep the working somewhere only you can reach.

When you are ready to send anything to the firm, the enquiry form on this page is the route, and it is a separate step you take deliberately. Limit an attachment to the current order, a key fee notice or a concise budget. Sending an enquiry is intake, not instruction: a conflict check and an accepted engagement are required before Mr AlBalooshi can advise on entitlement, amount, filing or enforcement.

What a good preparation note contains

Whatever you produce, on paper or in the worksheet, is worth checking against this list:

  • selected legal route, marked provisional until confirmed;
  • issue type: spouse, child, interim, arrears or variation;
  • declared personal and child expense totals;
  • direct payments and the arithmetic shortfall;
  • income categories and unknown figures;
  • evidence-readiness by category;
  • urgent due dates and current order details; and
  • questions requiring legal advice.

None of it is a maintenance calculation in the sense of predicting an award, and it should not be presented as one. Its purpose is to make the consultation and the court preparation more accurate.

Ask Mr AlBalooshi to assess the maintenance position

Use the inquiry form to send the preparation summary with your name, mobile number, email, message and optional document upload. State any current order, case number, next hearing and missed-payment date. For WhatsApp intake, contact +971 50 627 5196.

Frequently asked questions

Is this a UAE child maintenance calculator?

It totals figures entered by the user, but it does not calculate a legal award. The court applies the governing law to proved needs, means and other relevant facts.

Is spousal maintenance automatic after divorce?

No universal entitlement should be assumed. The legal regime, marriage status, facts, means, needs and statutory factors must be assessed.

Which expenses can be entered for a child?

Enter supported food, clothing, housing, education, health, transport, childcare and established special needs. Legal treatment depends on the applicable law and order.

Should annual school fees be divided by twelve?

The Child Maintenance Budget Worksheet shows a monthly equivalent beside an annual figure you enter. Keep the original invoice and the due dates with your own records; the worksheet does not hold them. A court or settlement may require direct term payments instead.

Can rent and mortgage payments be treated the same way?

Not automatically. Housing need, property ownership, debt repayment and direct provision of accommodation can raise different legal questions.

Does company turnover show a business owner’s income?

No. Turnover, profit, company cash and personal income are different. Salary, dividends, benefits, drawings and lawful company records require separate analysis.

What proof supports a maintenance budget?

Use current invoices, contracts, fee notices, bank payments, salary records, insurance, medical documents and an accurate payment history.

Can temporary maintenance be requested during the case?

Interim relief may be available in an appropriate case. The urgent shortfall, needs, means and supporting evidence should be clearly presented.

Can maintenance be stopped when visitation is refused?

Support and contact are separate. Continue complying with the order and use the competent enforcement or variation process for the contact dispute.

How should maintenance arrears be calculated?

Start from the operative order and due dates, then credit every proved payment. Disputed transfers and items outside the order should be listed separately.

Does a lower salary automatically reduce an existing order?

No. The order remains effective until changed through the proper process. A genuine material change must be proved and legally assessed.

Are federal civil financial orders the same as Muslim maintenance?

No. They arise under distinct statutory frameworks and can use different concepts and factors. The routes must not be blended.

Can I rely on figures taken from my spouse’s private account?

Only lawfully obtained evidence should be used. Do not access accounts without authority; ask about lawful disclosure or court production procedures.

Is a preparation summary confidential legal advice?

No. Whatever you assemble, on paper or in the browser-based worksheet, is preparation. Confidential legal advice requires conflict clearance, scope confirmation and formal engagement.

What should I send for Mr AlBalooshi’s first review?

Start with the maintenance or financial order, a concise monthly budget, key income proof, payment schedule and the document showing any urgent due date.
