Schooling, Medical Decisions and Guardianship in the UAE
Private family-law enquiry
Request a Consultation
Tell us briefly about your family-law matter and how we may contact you. Your details are handled under the Privacy Policy. Sending this form does not create a lawyer–client relationship.
Please do not upload passports, Emirates IDs, children’s identity documents, intimate evidence, complete financial records or original documents. If a document is needed to understand your enquiry, attach one only, and send anything further through a secure route agreed with the office.
Schooling, medical decisions and guardianship in the UAE do not always belong to the parent with whom the child spends the most time. Custody concerns day-to-day care, while guardianship or joint legal custody can govern major decisions. The applicable result depends on the family-law route, the current judgment and the particular decision: school enrolment, elective treatment, an emergency, therapy, passport renewal and management of a child’s property may each require a different authority.
Mr AlBalooshi assists parents with educational-guardianship applications, school disputes, access to records, medical-consent disagreements, urgent orders and drafting clear decision-making terms. Use the inquiry form with your name, mobile, email, emirate, child’s age, current school or provider, existing custody order, proposed decision, deadline and the other parent’s response. Attach only the operative order, relevant school or medical recommendation and concise correspondence. For intake, WhatsApp +971 50 627 5196.
An inquiry does not create a lawyer-client relationship or authorise treatment, school transfer or court action. It does not preserve an admission, appeal, treatment or hearing deadline. Identity, conflicts, jurisdiction, scope and engagement must be confirmed before legal work begins. In a medical emergency, contact emergency services and the treating facility immediately.
Custody, guardianship and joint legal custody are distinct concepts
Under Federal Decree-Law No. 41 of 2024, custody is the child’s care, upbringing and welfare in a manner that does not conflict with guardianship. Guardianship over the person involves general supervision of the minor without displacing the custodian’s authority over the child’s day-to-day affairs. Guardianship over property concerns the child’s assets and is subject to separate safeguards and court supervision.
The same law makes a specific exception for education: a custodial mother has educational guardianship in a manner serving the child’s interest. It also creates routes for the urgent-matters judge to decide disagreements or transfer educational guardianship where the child’s interest requires it.
Under the federal civil personal-status regime, joint custody is the starting point for eligible non-Muslim parents. Cabinet Resolution No. 122 of 2023 allows either parent to ask the court to resolve an issue related to joint custody. The court may select the course serving the child.
The Abu Dhabi Civil Family Court describes joint legal custody as authority shared by both parents over major matters such as medical care, education and religious upbringing, unless a parent waives joint custody or the court orders another arrangement.
These regimes should not be merged. A label on a foreign order or school form does not decide which UAE law applies. Review residence, nationality, religion where legally relevant, marriage route, court jurisdiction and every existing order.
The distinction is set out at length on Custody vs Guardianship, and the civil position on Joint Custody.
Educational guardianship under the federal Personal Status Law
Article 112 of the 2024 Personal Status Law is central in many Muslim personal-status cases and other matters within that law. It recognises the guardian’s role in the child’s affairs and education but grants educational guardianship to the custodial mother as an express exception, subject to the child’s interest and the statutory court process.
Educational guardianship can affect decisions such as:
- initial school or nursery enrolment;
- transfer between schools;
- curriculum or educational track;
- access to the parent portal and reports;
- special educational needs assessment;
- tutoring or learning support;
- school transport and practical attendance matters; and
- approvals required for ordinary educational administration.
The exact scope of an order and the school’s regulatory requirements still matter. Educational guardianship does not automatically decide child maintenance, compel a school to accept an application, authorise foreign travel or transfer guardianship over property.
If parents disagree about what serves the child, the law permits referral to the urgent-matters judge. The court can consider the guardian’s financial capacity while preserving the statutory educational-guardianship rule, and it may transfer educational guardianship where the child’s interest requires it.
Civil joint custody requires a workable major-decision process
For federal civil or Abu Dhabi civil-family cases, both parents ordinarily participate in major education and health decisions while joint legal custody continues. Shared authority should not become an indefinite veto.
A practical order or parenting plan can require:
- written notice identifying the proposed decision;
- the school, doctor or therapist’s supporting information;
- a reasonable response period based on urgency;
- direct access for both parents to neutral professional advice;
- an interim arrangement that preserves safety and continuity; and
- court determination if agreement is not reached.
Routine choices made while a child is staying with one parent are different from a major school transfer, non-urgent surgery, long-term therapy programme or permanent change of residence. The plan should define categories without requiring joint approval for every meal, homework method or ordinary clinic visit.
Use the Parenting Plans guide to integrate major decisions with residence, holidays and handovers.
A school-change dispute should be decided on child-focused evidence
Arguments about schools often combine education, money, residence and parental identity. Separate them. Compare:
- curriculum and language;
- continuity with the current school;
- academic and pastoral record;
- special educational support;
- distance from each home;
- school transport and traffic;
- fees and proven affordability;
- admission deadlines and availability;
- sibling placement;
- activities and community ties;
- effect on the parenting schedule; and
- the child’s needs and views where appropriately considered.
School prestige alone is not a complete analysis. The most expensive option is not automatically in the child’s interest, and the cheapest option may be unsuitable if it disrupts established support. A parent seeking urgent enrolment should show the admission deadline, available place and consequences of delay.
Do not withdraw the child, cancel a place or enrol abroad simply to create a fait accompli. If time is short, seek a defined interim decision.
School fees and authority to choose a school are separate
An order requiring one parent to pay school fees does not necessarily give that parent exclusive educational authority. Conversely, educational guardianship does not determine who must pay or whether a new fee is recoverable under an existing maintenance judgment.
When proposing a change, identify:
- current fee order or settlement;
- registration and deposit dates;
- tuition, transport, books, uniform and support costs;
- refund and withdrawal rules;
- each parent’s financial evidence where relevant;
- whether prior agreement is required for extraordinary expenses; and
- the legal route for variation if the current order is insufficient.
Do not withhold school records or attendance because adults dispute payment. Use the proper maintenance or enforcement process. The Child Maintenance guide covers financial obligations separately.
Parent access to school information should follow the order and privacy rules
A school may request a custody judgment, educational-guardianship order, Emirates ID, passport, birth certificate or authorised contact form before changing access. Parents should provide the complete operative document, not a selective screenshot.
A decision protocol can state whether both parents receive:
- report cards and attendance notices;
- parent-portal access;
- meeting invitations;
- behaviour or safeguarding notifications;
- learning-support plans;
- trip and activity forms; and
- emergency communications.
Access to information is not necessarily authority to make the final decision. Schools should not be asked to interpret a disputed order beyond its wording or mediate the parents’ litigation. If the document is unclear, seek a clarification or specific court direction.
Medical consent depends on the decision, urgency and legal authority
Healthcare providers must follow applicable federal law, local health-regulator standards, their consent policies and any court order. A routine consultation, vaccination, elective procedure, psychiatric admission, clinical trial and life-threatening emergency do not use one identical consent rule.
The Abu Dhabi Department of Health Patient Consent Standard defines consent by a competent patient or an authorised substitute or legal guardian. It addresses minors, informed consent, emergencies and conflicts between potential substitute decision-makers. Other emirates and providers may apply their own current regulatory standards within federal law.
Before a non-urgent procedure, a parent should obtain:
- the diagnosis and clinical recommendation;
- material benefits, risks and alternatives;
- consequences of delay or refusal;
- expected recovery and follow-up;
- provider’s written consent requirement;
- insurance approval and cost;
- the current custody or guardianship document; and
- the other parent’s position where joint authority applies.
Do not ask a doctor to decide a legal custody dispute. The provider addresses clinical care and consent compliance; the family court determines parental authority where necessary.
Emergency treatment should not wait for strategic agreement
Where there is a genuine life-threatening or urgent condition, seek immediate medical help. Federal medical-liability law and regulator standards recognise circumstances in which treatment or resuscitation cannot wait for ordinary consent processes. The treating professionals determine clinical urgency under the applicable rules.
The parent present should provide accurate history, allergies, medication and insurance information. Notify the other parent promptly where safe and possible, state the facility and treating contact, and share the discharge plan. Do not use an emergency to obtain unrelated legal concessions.
Afterwards, preserve the clinical record and any consent form. If parents dispute ongoing treatment, obtain the treating recommendation and seek a targeted decision rather than stopping necessary care without advice.
Therapy and mental-health decisions need privacy and continuity
Counselling, psychological assessment and psychiatric treatment can be especially sensitive. The plan should distinguish school counselling, an assessment, ongoing therapy, medication and inpatient or compulsory treatment. Federal mental-health legislation gives additional protections to minor psychiatric patients.
Parents should address:
- clinical purpose and provider qualifications;
- consent authority under the order and health rules;
- frequency, duration and cost;
- how necessary information is shared;
- limits of confidentiality and safeguarding duties;
- the child’s age-appropriate involvement;
- continuity between homes; and
- how reports may be used in court.
Therapy should not be commissioned solely to produce partisan evidence. Do not coach the child, demand disclosure of every private statement or circulate reports to unrelated people. If an independent custody assessment is required, use the court-approved process.
Recurring decisions are easier to manage when they are written down in advance: see Parenting Plans. The wider overview is on Child Custody and Guardianship. For a disputed decision, set up a consultation.
Special educational and health needs require one coordinated record
A child with a disability, chronic condition, neurodevelopmental need or individual learning plan may require consistent routines across homes. Prepare a neutral care file containing:
- diagnosis and current professional reports;
- medication and emergency plan;
- school accommodation or individual education plan;
- therapy timetable;
- equipment and safe transfer instructions;
- insurance and authorisation details;
- named treating and school contacts;
- transport requirements; and
- review dates.
Both parents should understand the care plan to the extent permitted by the governing order. A dispute over custody should not interrupt essential medication, therapy, school support or assistive equipment.
The UAE Child Rights Law protects health, education, development and safety without discrimination. Child welfare is not an optional clause in a settlement.
Guardianship over the person and property should not be confused
The 2024 Personal Status Law distinguishes guardianship over the person from guardianship over property. A school or medical dispute usually concerns the child’s person, care or education. Managing a minor’s bank account, inheritance, company share, settlement proceeds or real estate concerns property guardianship and can require court supervision or permission.
A parent who may make a school decision is not therefore free to dispose of the child’s assets. Similarly, a guardian managing property may not displace the custodian’s day-to-day care or the custodial mother’s statutory educational guardianship without the required order.
If school fees are to be paid from the child’s own assets, obtain advice on whether court permission or a minors’ affairs procedure is required.
When court intervention may be proportionate
Court intervention may be needed where:
- a school place will be lost by a fixed deadline;
- the child has no enrolment or attendance is at risk;
- parents cannot agree on necessary treatment;
- a parent refuses access to essential records;
- a proposed school change conceals relocation;
- the existing order assigns authority but is ignored;
- a child-protection concern requires urgent action; or
- a lasting change to legal custody or guardianship is sought.
The requested order should be specific. Ask who may complete a named enrolment, consent to a defined procedure, receive records or make a time-limited decision. A narrow decision can solve the problem without converting every disagreement into a sole-custody claim.
Under the federal Personal Status Law, education disputes can use the statutory urgent-matters route. Under federal civil joint custody, Cabinet Resolution No. 122 of 2023 permits either parent to ask the competent court to decide a disputed issue in the child’s interest. Abu Dhabi Civil Family Court publishes a child-custody dispute application and interim-order route for matters within its jurisdiction.
Evidence for an education or healthcare application
Build an indexed, issue-specific file:
- birth certificate and child identity records;
- current custody, guardianship and divorce orders;
- school offer, deadline, fee schedule and reports;
- comparison of current and proposed schools;
- attendance and special-support records;
- medical diagnosis and treating recommendation;
- consent form and provider policy where relevant;
- insurance authorisation and costs;
- dated proposals and responses between parents;
- evidence of urgency or harm from delay;
- child’s actual routine between homes; and
- a precise draft of the requested decision.
Avoid unrelated marital allegations. Do not alter reports, access a private patient or school portal without authority, or publish a child’s records. Certified Arabic translation may be required for court documents in another language.
A decision-responsibility table can prevent repeat disputes
A parenting order or agreement can allocate responsibilities without oversimplifying the law. Useful rows include:
| Decision | Routine authority | Major-decision authority | Notice | Emergency rule | Records access |
|---|---|---|---|---|---|
| Daily homework | Parent caring for child | Not applicable | As needed | Not applicable | Both receive reports if authorised |
| School change | Current arrangements continue | Person(s) authorised by law or order | Written proposal with deadline | Court if urgent | School documents shared |
| Routine clinic visit | Caring parent, subject to order | Provider and order requirements | Prompt factual notice | Immediate care if urgent | Relevant record shared lawfully |
| Elective procedure | No unilateral commitment where joint authority applies | Legal guardian or joint decision as required | Clinical information and response time | Court if unresolved | Consent and discharge record |
| Therapy programme | Routine support continues | Authority stated by route or order | Provider plan and privacy terms | Safeguarding overrides ordinary delay | Proportionate clinical information |
The same table can be extended to cover school, health, therapy, religion, activities, travel and property, with a row for each and a note of who currently decides it and whether that is disputed. Setting the questions out in this way organises them. It does not determine who holds legal authority over any of them.
If a particular decision is in dispute and you would like it considered for a consultation, describe it and the documents you hold through the inquiry form. The scope of any assistance is confirmed after review.

Frequently asked questions
What is educational guardianship in the UAE?
It is legal authority relating to a child’s education. Under the current federal Personal Status Law, the custodial mother has educational guardianship subject to the child’s interest and the law’s court procedures.
Is educational guardianship the same as physical custody?
No. Physical custody concerns care and residence. Educational guardianship concerns education decisions. A parent may hold one role without every other parental authority.
Can a custodial mother change the child’s school?
Her authority depends on the governing route, current order and child’s interest. Admission, fee and court-dispute requirements still apply, and a civil joint-custody case is different.
What happens if parents under civil joint custody disagree about school?
Either parent may ask the competent court to decide the issue. A focused comparison of continuity, needs, location, cost and support is more useful than general criticism.
Does paying school fees give a parent the right to choose the school?
Not automatically. Financial responsibility and educational decision authority are separate questions governed by the law and order.
Can both parents receive school reports?
Access depends on the order, educational authority, school policy and privacy rules. A clear parenting order can specify portal, report and meeting access.
Who consents to a child’s medical treatment after divorce?
The answer depends on the family-law route, guardianship or joint legal custody, the treatment, urgency, provider rules and any specific court order.
Can a hospital treat a child in an emergency without ordinary consent?
Emergency and life-saving care is governed by medical law and regulator standards that recognise circumstances where treatment cannot wait. Contact the facility immediately rather than delaying for a family dispute.
What if one parent refuses recommended treatment?
Obtain the treating recommendation, risks, alternatives and urgency. Where the dispute cannot be resolved and delay may harm the child, seek a targeted court decision promptly.
Is consent from both parents always required for therapy?
Not in every legal route or service. The custody order, provider’s current consent policy, type of therapy and any joint-legal-custody requirement must be checked.
Can a parent access the child’s medical portal without permission?
Only through lawful authority and the provider’s access rules. Do not use another person’s credentials or obtain private records through unauthorised access.
How are special educational needs handled in a custody plan?
The plan should preserve assessments, accommodations, therapies, medication, equipment and communication across homes, with responsibilities assigned under the correct legal authority.
Does a school decide which parent has guardianship?
No. The school applies official documents and its policies. The family court determines disputed custody or guardianship authority.
Can guardianship over a child’s property be used to pay school fees?
Property guardianship is separately regulated and may require court oversight or permission. Do not use the child’s assets without confirming lawful authority.
What evidence is needed for an urgent school or medical order?
Provide the current judgment, professional recommendation, fixed deadline, risks of delay, parents’ proposals and a precise order requested, with certified translation where required.
