Tell us briefly about your family-law matter and how we may contact you. Your details are handled under the Privacy Policy. Sending this form does not create a lawyer–client relationship.
Please do not upload passports, Emirates IDs, children’s identity documents, intimate evidence, complete financial records or original documents. If a document is needed to understand your enquiry, attach one only, and send anything further through a secure route agreed with the office.
A family dispute with criminal proceedings in the UAE usually involves at least two distinct legal tracks. Police and Public Prosecution investigate possible offences under criminal law. A family court determines divorce, custody, contact, maintenance, guardianship, travel and related personal-status remedies under the law applicable to that family. One set of events can be relevant to both tracks, but a filing in one does not automatically produce an order in the other.
Early coordination matters. A message written for a custody dispute can affect a cybercrime investigation; a restraining order can alter child handovers; a criminal hearing may occur before the family court has considered temporary arrangements. Each statement, deadline and order should be mapped to the correct file.
Mr AlBalooshi assists complainants, accused family members and parents managing parallel UAE criminal and family proceedings. Use the inquiry form to provide the police or prosecution reference, family case number, current orders and next deadline, or WhatsApp +971 50 627 5196.
If anyone faces immediate danger, call UAE Police on 999 or Ambulance on 998. Legal coordination should follow, not delay, emergency protection.
A criminal complaint and a family case ask different questions
A criminal authority may consider whether evidence supports an offence, who is responsible and what procedural or penal consequence follows. A family court may consider where a child should live, how contact can occur safely, what maintenance is due or whether urgent protective directions are required.
The distinction affects both evidence and remedies:
- a police report records an allegation; it is not itself a finding of guilt;
- a prosecution decision concerns the criminal file; it may not resolve custody or divorce;
- a restraining order has its own terms and duration; it does not replace a parenting order;
- a family interim order protects a temporary position; it does not convict anyone;
- a final criminal judgment may be relevant in family proceedings, but its legal effect must be assessed from the judgment, finality and issue decided; and
- withdrawal, reconciliation or closure in one process does not necessarily dispose of every other claim.
Parties should avoid describing every family disagreement as criminal. Equally, conduct involving violence, threats, child abuse, coercion or cyber offences should not be treated as a private parenting disagreement merely because the parties are related.
Common areas where family and criminal law overlap
Parallel proceedings may arise from:
- physical or sexual violence within a family relationship;
- threats, intimidation or pressure to withdraw a report;
- stalking, repeated harassment or breach of a restraining order;
- cyberextortion, account intrusion or publication of private material;
- alleged child abuse, neglect or exploitation;
- removal or withholding of a child in breach of an operative arrangement;
- forgery or disputed use of family, financial or identity documents;
- damage, taking or concealment of property; and
- alleged false reports, fabricated evidence or unlawful publication.
The correct classification depends on the facts and current law. A missed contact visit is not automatically kidnapping. A disputed bank transfer is not automatically theft. An allegation that later fails is not automatically a false-report offence. Mr AlBalooshi can identify what should be reported, what belongs in the family file and what evidence is missing.
Accurate classification also protects the credibility of genuine complaints and prevents procedural energy being diverted into issues that the selected authority cannot decide.
The criminal process has its own authorities and stages
Federal Decree-Law No. 38 of 2022 governs UAE criminal procedure within its scope. A matter may begin with a police report or another competent reporting channel. Police collect initial information and evidence; the Public Prosecution directs or conducts investigation and decides the next procedural step within its powers; the criminal court determines charges referred to it.
The route can vary with the emirate, offence, urgency and evidence. A person should keep:
- the report or case reference number;
- the authority, station and date of every attendance;
- summonses, release conditions and orders;
- copies or receipts for submitted devices and documents;
- the name and contact details of counsel where permitted;
- hearing dates and decisions; and
- proof of any appeal or finality status.
Do not assume that an online report alone has opened every required family or protection process. Confirm the official status and next step through the competent authority.
Domestic-violence proceedings include specific protection mechanisms
Federal Decree-Law No. 13 of 2024 is the current federal domestic-violence framework. Article 4 defines qualifying domestic violence across physical, psychological, sexual and economic harm within covered family relationships. Article 5 gives the victim a reporting right and sets prompt reporting duties; physical or sexual violence requires police notification in accordance with the law.
The Public Prosecution may issue a restraining order under Article 8, and Articles 9 to 11 address duration, court powers and permitted protective measures. Depending on the issued terms, protection can address contact, approach to specified places, safe placement and other statutory measures.
Obtain the written order. Note protected people, prohibited conduct, locations, communication channels, start date, expiry and extension route. A private understanding does not vary an official order. Article 23 addresses breach, Article 24 contains confidentiality protections and Article 25 addresses force or threats intended to compel withdrawal of a report.
Family-court relief usually requires a separate application
While criminal proceedings continue, the competent family court may need to consider:
- divorce or separation;
- temporary and final custody;
- supervised, structured or suspended contact;
- protected child handovers;
- urgent maintenance, housing or medical expenses;
- passports and child travel restrictions;
- school and medical decision authority; and
- enforcement or variation of an existing family judgment.
The applicable family-law regime must be identified first. Federal Decree-Law No. 41 of 2024, Federal Decree-Law No. 41 of 2022 on Civil Personal Status and Abu Dhabi’s civil-family rules are not interchangeable. Their custody structures, eligibility requirements and procedures differ.
A family application should explain the criminal file accurately: allegation, reference number, stage, orders issued and evidence available. Avoid stating that the accused has been “convicted” before a conviction exists or that a closed report proves the underlying conduct never occurred.
A protection order and a child-contact order must operate together
Conflicting or incomplete orders create practical risk. A restraining order may prohibit direct communication, while a family judgment requires a handover. A custody order may identify a home, while a safety plan protects the address. The solution is not to ignore either order.
Ask for directions that can be followed in practice, such as:
- handover through school, an approved third party or a protected venue;
- communication only through counsel or a designated parenting channel;
- no disclosure of a protected address;
- supervised contact with a named provider or approved adult;
- staggered arrival and departure times;
- emergency medical communication rules; and
- a method for changing a visit without direct prohibited contact.
Provide every current order to each legal team. If terms conflict, seek urgent clarification or variation from the competent authority rather than improvising.
Evidence should be preserved once and presented appropriately in each file
Create a master chronology with separate columns for the event, criminal reference, family relevance, source document and next action. Preserve original material and prepare tailored extracts for each authority.
Potential evidence includes:
- police, prosecution and court records;
- restraining and family orders;
- medical reports, prescriptions and photographs;
- complete messages, emails, call logs and account alerts;
- original audio, video or digital files held lawfully;
- school, nursery, building-security or workplace records;
- bank statements and expense evidence;
- witness details and what each person directly observed; and
- proof of service, breach or compliance.
Do not edit metadata, crop away context, create transcripts that change words or circulate evidence through family groups. Retain a working copy and preserve the source. A translated exhibit should be linked clearly to the original.
Evidence collection must itself be lawful. The Cybercrime Law addresses unauthorised access, cyber threats and privacy invasion. Do not enter another person’s account, install surveillance software, impersonate a party or publish private communications in the name of proving the case.
Digital communications can generate a second criminal issue
Family litigation often produces angry messages, recordings and social-media posts. Article 42 of Federal Decree-Law No. 34 of 2021 addresses cyberextortion and cyber threats. Article 44 addresses specified privacy-invasion and secret-revealing conduct through technology.
After a complaint begins:
- stop direct contact if an order or police direction prohibits it;
- do not threaten exposure, employment consequences or immigration action;
- do not post accusations or documents;
- do not ask relatives to pressure the other party;
- do not delete accounts or messages; and
- do not send repeated explanations that can be interpreted as harassment.
Use the lawful channel identified by the order, authority or lawyer. Litigation is not permission to publish personal data or allegations.
Children need protection from repeated interviews and adult pressure
Wadeema’s Law requires children to be protected from psychological harm during evidence collection, investigation and trial. A child may be a victim, witness or subject of the family orders at the same time.
Adults should not ask the child to rehearse events, choose a parent, record a home or repeat what was said in an interview. Note spontaneous words accurately and let trained specialists conduct formal questioning. Tell the authorities if the child has already been interviewed so unnecessary repetition can be avoided.
A coordinated plan may cover safe residence, school collection, therapy, medical care, siblings, device access, contact and travel. Criminal investigators and family courts have different roles, so the child’s practical arrangements should not be left unresolved while evidence is gathered.
Medical evidence should document health, not decide the entire case
Seek treatment promptly when required. Tell the clinician what happened, when symptoms began and any earlier relevant condition. Retain reports, images, prescriptions, referrals and receipts.
A medical report can document findings and treatment, but legal causation, credibility and criminal responsibility are determined by the competent authorities. A report without visible injury does not necessarily resolve allegations of psychological, sexual or economic harm. Conversely, a symptom does not by itself identify who caused it.
If sexual violence is alleged, obtain prompt police and medical guidance about forensic preservation. Avoid washing, deleting messages or handling items in a way that may compromise evidence if it is safe not to do so.
Reconciliation and withdrawal require careful legal advice
Article 13 of the 2024 domestic-violence law provides a family-reconciliation process where the statutory conditions and both sides’ consent are present. It is not offered where the act constitutes a felony. Article 14 addresses penal reconciliation in legally permissible cases and includes safeguards, particularly where a child is involved.
Not every criminal offence is withdrawable or resolved by a private settlement. A complainant should not promise closure that only the prosecution or court can determine. An accused person should never use threats, children, money, visa pressure or family members to secure withdrawal.
Any settlement should specify which civil, family or financial issues it addresses. A criminal reconciliation does not automatically settle custody, maintenance, divorce or property. A family agreement does not automatically terminate public criminal proceedings.
Travel restrictions, bail and immigration consequences are distinct
A criminal file may involve arrest, release conditions, a travel restriction or later sentencing consequences. A family court may separately consider a child travel ban or passport order. These measures protect different interests and should not be described as interchangeable.
Before travel, verify current status through the competent authority. A party should not rely on an airline booking, verbal assurance or absence of an alert in a different system. Where expatriate status is involved, obtain specific advice on immigration and any possible deportation consequence from the actual charge and judgment; do not assume every family-related complaint produces deportation.
A restriction on an adult does not automatically establish custody of a child. The family court may need an interim order addressing daily care, schooling, medical decisions and contact while a parent cannot travel or is detained.
Responding to a complaint without worsening the position
An accused person should preserve the complete conversation and timeline, including adverse material. Obtain the summons, report details and every order through lawful channels. Attend when required and arrange an interpreter or counsel where available and needed.
Do not contact the complainant to demand withdrawal, approach a protected location, delete data, coach a child, fabricate an alibi, transfer property or recruit witnesses to agree on a story. Compliance with an interim order is not an admission and does not prevent a lawful challenge.
A focused response may address identity, attribution, context, chronology, authenticity, consent, lawful access, self-defence or another legally relevant issue. The available defence depends on the actual allegation and evidence, not a generic family-law narrative.
Coordinating the two cases through one action plan
For each proceeding, record:
- Authority and number: police, prosecution, criminal court, family court or execution file.
- Issue: alleged offence, protection, custody, contact, maintenance, travel or enforcement.
- Current order: exact operative terms and expiry.
- Next date: interview, submission, hearing, review or appeal deadline.
- Evidence: originals held, certified records needed and translation status.
- Communication rule: who may contact whom and through which channel.
- Child arrangement: residence, school, medical care, handover and travel.
- Responsible lawyer: who is handling the criminal and family work and how information is shared.
This prevents inconsistent statements and missed deadlines. It also helps distinguish an urgent safety decision from the final merits of either case.
How Mr AlBalooshi can assist with parallel proceedings
Mr AlBalooshi can review the criminal and family files together, identify the competent remedies, reconcile overlapping orders, prepare lawful evidence bundles and coordinate urgent protection, custody, contact, maintenance and criminal-response steps. He can also identify when separate criminal-defence, immigration, cybercrime or foreign counsel is needed.
Describe both sets of proceedings and how they overlap through the inquiry form. The scope of any assistance is confirmed after review. Provide the latest order from each file, reference numbers, next dates and a two-page chronology. You may also WhatsApp +971 50 627 5196. Legal representation cannot guarantee a charge, dismissal, protection order, custody outcome or timetable.
Frequently asked questions
Does a police report automatically prove an allegation in family court?
No. It proves that a report exists. The family court assesses the evidence, stage and legal relevance under the governing family-law test.
Does a criminal complaint automatically stop child contact?
No. Seek an urgent family or protection order if contact is unsafe. Follow any existing order until it is lawfully varied, unless emergency authorities direct otherwise.
Can a restraining order include online contact?
It can include specified prohibited-contact measures. The written terms should identify relevant accounts, intermediaries, locations and necessary exceptions.
Can a family court grant a criminal conviction?
No. Criminal responsibility is determined through the criminal process. The family court determines relief within its jurisdiction.
Can a criminal court decide final custody?
Criminal proceedings may generate protection relevant to a child, but final custody generally requires the competent family-law process.
What if the family and restraining orders conflict?
Do not ignore either. Seek urgent clarification or variation and propose a practical handover and communication method consistent with safety.
Should I give the family court the criminal case number?
Yes, where relevant. State the allegation, authority, stage and orders accurately without presenting an allegation as a conviction.
Can I submit screenshots from a spouse’s private account?
Do not assume access was lawful. Unauthorised access may create cybercrime exposure. Obtain advice and preserve only lawfully held material.
What happens if a restraining order is breached?
Preserve objective evidence and report through the competent channel. Article 23 of the domestic-violence law addresses violation of a restraining order.
Can a domestic-violence case be reconciled?
The 2024 law permits family or penal reconciliation only within statutory conditions, with consent and safeguards. Family reconciliation is not offered for a felony.
Can someone pressure the complainant to withdraw?
No. Article 25 addresses force or threats used to compel withdrawal. Do not use relatives, children, money or immigration pressure.
Should a child write a statement for the case?
Do not coach or repeatedly question a child. UAE child-rights law requires protection from psychological harm during evidence and proceedings.
Does withdrawal of a family case close the criminal file?
Not automatically. The prosecution or court controls the criminal process according to the offence and law.
Can a criminal travel restriction stop a parent travelling with a child?
It may restrict the adult, but child travel consent, passport control and family travel bans remain separate matters requiring their own review.
What documents should Mr AlBalooshi receive first?
Send the police or prosecution reference, family case number, all current orders, the next deadlines, a concise chronology and the key original evidence.
