Estate questions in the UAE turn on two things people rarely think about until it matters: which regime applies to the estate, and where the asset actually sits. A property in one emirate, a company share in a free zone and a bank account abroad may not all be dealt with the same way.

These answers cover intestacy, wills and the registration options, and what a family typically has to do after a death. Guardianship of minor children is included, because it is the point most often left out of a will and most urgently needed.

One warning before the answers. The UAE runs more than one family-law framework, and they must not be read as a single system: Muslim personal status; the federal civil personal-status regime for those within its scope; the Abu Dhabi civil-family route, which is a local framework with its own eligibility and procedure; onshore court procedure, which is separate again from the substantive law; and cross-border recognition and enforcement, which depends on both countries involved. A rule from one does not carry across to another.

Inheritance & Estate Planning

Which inheritance law applies to an estate in Dubai?

It depends on religion, nationality and residence, the will route, asset location, family structure and the competent court. A route review should precede any share calculation.

Inheritance Lawyer Dubai covers this in full.

Does UAE Sharia inheritance apply to every expatriate?

No. Muslim succession, the federal civil personal-status regime for qualifying non-Muslims, local Abu Dhabi rules, DIFC wills and foreign-law issues must be kept distinct.

Can a non-Muslim leave all UAE property by will?

Article 11 of the federal Civil Personal Status Law permits a qualifying testator to leave the entire UAE property to a chosen beneficiary, subject to the Executive Regulations and proper registration.

What happens if a qualifying non-Muslim dies without a will?

Under the federal civil default, the spouse receives half and the children share the other half equally. Different parent and sibling rules apply if there are no children.

Is a home-country will automatically valid for UAE assets?

Do not assume so. Validity, choice of law, authentication, Arabic translation, local probate and asset-transfer requirements need case-specific review.

What is the difference between a DIFC Courts Will and an onshore civil will?

They arise from different legal and registration frameworks and have different probate procedures and scope. The instrument should be chosen after mapping eligibility and assets.

Can heirs withdraw money as soon as someone dies?

Normally they should first obtain the authority required by the bank and succession process. Unauthorised withdrawals can prejudice creditors and other heirs.

Are debts paid before inheritance is distributed?

Estate liabilities and administration must be addressed before beneficiaries receive the net estate under the applicable legal order.

Sharia Inheritance

Does Sharia inheritance apply to every person who dies in the UAE?

No. This page concerns Muslim succession under the federal Personal Status Law. Civil non-Muslim, Abu Dhabi, DIFC and foreign-law routes require separate analysis.

The complete treatment is on Sharia Inheritance UAE.

Is inheritance calculated before debts are paid?

No. The net estate is established after applicable liabilities, expenses and valid prior dispositions are dealt with in the legal order.

Does every male heir receive twice every female heir?

No. The two-to-one relationship applies in specified residuary configurations. Fixed shares and exclusion rules produce many other outcomes.

What does a husband inherit from his wife?

Generally one-half if she leaves no inheriting descendant and one-quarter if she does, subject to the complete estate facts and applicable law.

What does a wife inherit from her husband?

Generally one-quarter if he leaves no inheriting descendant and one-eighth if he does; multiple wives collectively share the prescribed spousal fraction where applicable.

Can a daughter inherit one-half?

A sole daughter without a son can have a fixed one-half share, subject to other heirs and the complete statutory calculation.

Do two daughters inherit two-thirds?

Two or more daughters without a son can collectively receive a two-thirds fixed share, subject to the remaining family configuration.

Do grandchildren automatically take a predeceased parent’s share?

Not automatically. Heirship and the compulsory-will provisions must be analysed under the current law.

Non-Muslim Inheritance

Do non-Muslims have civil inheritance rules in the UAE?

Yes. Federal Decree-Law No. 41 of 2022 creates a civil personal-status framework for persons and matters within its defined scope.

More detail, and the sources behind it, on Non-Muslim Inheritance UAE.

Can a non-Muslim leave all UAE assets to chosen beneficiaries?

Article 11 permits a qualifying testator to leave the entire UAE property by will, subject to the Executive Regulations and proper registration.

What if there is no registered civil will?

The applicable intestacy route must be established. Under the federal civil default, a spouse receives half and children share the other half equally.

Do sons and daughters inherit equally under federal civil intestacy?

Yes, the children’s half is divided equally without gender differentiation under Article 11’s spouse-and-children default.

What if the deceased had no children?

Article 11 provides a different order involving parents and, in specified circumstances, siblings. The complete family tree must be applied.

Does an unmarried partner inherit automatically?

Do not assume so. Intestacy recognises legal categories; a registered will should address an intended benefit to a partner.

Can an heir request the deceased foreigner’s national law?

Article 11 addresses a foreigner’s heir requesting applicable inheritance law under the UAE legal framework, subject to a registered will and other legal limits.

Is a foreign will enough to release a Dubai bank account?

Not necessarily. Proof, authentication, translation, UAE authority and the bank’s implementation requirements may still be needed.

How many properties can a Property Will cover?

Dubai Courts Wills

Is there a non-Muslim wills register at Dubai Courts?

For the detail behind this, see Dubai Courts Wills.

Is a Dubai Courts will the same as a DIFC Courts Will?

No. They use distinct registration and probate frameworks, even though both operate in Dubai for non-Muslim succession.

Yes, applicable estate expenses and enforceable debts must be addressed before net distribution.

Can jointly owned assets be included in full?

Only the deceased’s proven interest ordinarily enters the estate; the co-owner’s property must be separated.

Can parents appoint a guardian in a UAE will?

Available UAE will routes can record guardian nominations, subject to the governing law, registration requirements and court approval.

The complete treatment is on Guardianship of Minors in UAE Wills.

Does the nominated guardian receive custody automatically?

What is an interim guardian?

An interim guardian is intended to provide immediate temporary care, especially while a permanent overseas guardian completes legal and travel steps.

Can the same person manage the child’s inheritance?

Potentially, but personal care and financial administration are separate responsibilities and may justify different appointees.

What is a DIFC Guardianship Will?

It is a registered DIFC Courts Will focused on qualifying guardian appointments rather than general asset distribution.

Before relying on any of this

Succession questions are unusually sensitive to facts that seem incidental: where an asset is held, how it is titled, whether a nomination exists, and which framework applies to the family. An answer that is right for one arrangement can be wrong for the next, and estate planning built on a general answer is the kind that fails at the moment it is needed.

Use these answers to frame the questions, then take advice on the actual holdings and documents.
