Family Lawyer for Women in Dubai and the UAE
Private family-law enquiry
Request a Consultation
Tell us briefly about your family-law matter and how we may contact you. Your details are handled under the Privacy Policy. Sending this form does not create a lawyer–client relationship.
Please do not upload passports, Emirates IDs, children’s identity documents, intimate evidence, complete financial records or original documents. If a document is needed to understand your enquiry, attach one only, and send anything further through a secure route agreed with the office.
A family lawyer for women in Dubai should give clear, case-specific advice rather than broad claims about what a wife or mother will receive. A woman’s legal options depend on the applicable personal-status regime, the marriage documents, the facts relied on, the children’s needs, the available evidence and the court with jurisdiction. Muslim personal-status proceedings, federal civil divorce for qualifying non-Muslims and Abu Dhabi civil-family proceedings must be kept legally distinct.
Mr AlBalooshi assists women seeking practical UAE family-law support with divorce, dowry, spousal maintenance, child maintenance, custody, guardianship questions, urgent protection, evidence, settlement and enforcement. Send a short account through the inquiry form, including any immediate deadline or safety concern, or contact WhatsApp on +971 50 627 5196.
Women’s family-law rights begin with the correct UAE legal route
Federal Decree-Law No. 41 of 2024 is the current federal Personal Status Law. It governs Muslim personal-status matters within its scope. Federal Decree-Law No. 41 of 2022 and Cabinet Resolution No. 122 of 2023 establish a different civil personal-status framework for qualifying non-Muslims. Abu Dhabi also has a Civil Family Court and local civil-marriage and divorce rules. The choice of route can affect the divorce basis, procedure, financial claim and child arrangements.
The first assessment should record:
- the citizenship, religion where legally relevant, residence and domicile of each spouse;
- the marriage date, place and form, and whether the certificate is registered and usable in the UAE;
- any marriage-contract conditions, dowry terms or financial agreement;
- where each child lives, attends school and receives medical care;
- the family’s income, housing and routine expenses;
- any existing UAE or foreign case, judgment, police report or protection measure; and
- whether there is an immediate risk involving safety, a child, travel, housing or assets.
Do not select a remedy from social-media descriptions of another case. The correct route must be matched to the woman’s facts. See divorce in the UAE for the starting distinctions.
Preparing for divorce without damaging the case
Early preparation can preserve options. Obtain lawful copies of the marriage certificate, Emirates ID and passport details, children’s birth certificates, tenancy or title documents, school and medical records, bank statements available to you, salary evidence and relevant written communications. Create a dated chronology of the marriage, separation, important financial events, caregiving and any alleged misconduct. Keep fact and interpretation separate.
Do not access an account without permission, install surveillance software, publish accusations or edit messages. A screenshot may omit context; preserve the complete conversation and original device where possible. Do not remove a child from the UAE or retain a passport merely because a dispute is expected. Travel, custody and guardianship consequences require advice before action.
For Muslim divorce, the legal basis, attempts at reconciliation where required, dowry and maintenance issues need to be pleaded under the 2024 Personal Status Law. Civil divorce is not the same route and should not be described as proof that either spouse committed fault. Read divorce for Muslims and no-fault divorce as separate guides.
Dowry and marriage-contract rights require the original wording
For a Muslim marriage, the marriage contract may record prompt and deferred dowry and additional conditions. Whether an amount is due, returned or affected by the type of dissolution depends on the contract, the legal route and the facts. The court needs the authentic document or an officially usable copy, not an informal translation or family recollection.
Prepare proof of any payment, jewellery transfer, waiver or settlement said to affect the dowry. Distinguish dowry from gifts, household purchases, personal loans and jointly acquired assets. A bank transfer alone may not show its legal purpose; messages and the contract may supply context.
Never sign an Arabic waiver, settlement, receipt or power of attorney without understanding its effect. A document presented as a procedural form may release financial rights. Mr AlBalooshi can review the text, legal route and implementation steps before signature.
Spousal maintenance and financial support are evidence-based claims
Spousal maintenance is not decided by a slogan about husbands or wives. The applicable family regime, marriage status, means, needs, conduct where legally relevant and specific statutory factors can all matter. Temporary support during proceedings and final financial relief should also be distinguished.
A useful maintenance file includes a realistic monthly budget, housing documents, utility and transport costs, medical needs, salary or business-income evidence, bank statements and proof of the standard of living. Separate the woman’s own expenses from each child’s expenses. Identify expenses paid directly by the other spouse and those that stopped after separation.
Where a spouse owns a business or receives irregular income, the analysis may require company accounts, dividends, benefits, shareholder loans and personal expenses paid through the company. Turnover is not personal income, but declared salary may not be the entire picture. See alimony and maintenance in the UAE for the evidential framework.
Child maintenance belongs to the child’s legal needs
Child maintenance can involve food, clothing, suitable housing, education, medical treatment, transport and other reasonable needs under the governing law and order. It should not be used as leverage over contact, and contact should not be withheld merely because support is disputed. Each issue requires its own lawful remedy.
Prepare a child-specific schedule supported by invoices, school fee notices, insurance details, prescriptions and proof of recurring activities. Explain exceptional needs rather than hiding them in a rounded total. Where fees are paid directly, the order or settlement should state the institution, due dates, extras and what happens when fees change.
If an order already exists and is not paid, preserve the judgment, proof of service or finality where relevant, payment history and current arrears calculation. Enforcement is different from asking the court to establish or vary support. The child maintenance guide explains these stages.
A mother is not automatically guaranteed every custody outcome
UAE law distinguishes day-to-day custody from guardianship or decision-making functions, although the terminology and allocation differ between Muslim and civil regimes. The court’s assessment is child-focused. The child’s age, care, safety, schooling, health, stability and each parent’s ability to meet legal responsibilities may be relevant.
A mother seeking custody should present a practical care plan: residence, school travel, working arrangements, health care, family support, contact with the other parent and travel safeguards. Evidence of routine care is more useful than general criticism. School messages, appointment records, calendars and neutral witnesses may demonstrate who has done what.
Federal civil personal-status rules can provide joint custody following divorce for qualifying non-Muslims. Abu Dhabi’s Civil Family Court also operates within its local framework. Those rules must not be imported into a Muslim custody case without legal analysis. Compare mothers’ rights with custody versus guardianship.
Passports, travel consent and relocation need advance planning
International families often face urgent questions about a child’s passport, residence visa, holiday travel or permanent relocation. Custody does not necessarily give one parent unlimited authority to change the child’s country of residence. A travel ban, existing order, guardianship rule or foreign custody order can alter the position.
Before booking or refusing travel, collect the child’s passports, nationalities, visa status, itinerary, proposed address, school calendar, consent history and every existing order. If relocation is proposed, prepare a plan for schooling, housing, health care, costs and meaningful contact. If return is feared, identify objective evidence rather than making a general allegation based only on nationality.
Do not sign a consent letter that is broader or longer than intended. Do not attempt airport travel in defiance of an order. Use the passport and travel-consent guide for the documents and urgent questions.
Domestic violence and coercive control require a safety-first response
Federal Decree-Law No. 13 of 2024 concerns protection against domestic violence. Official UAE legislation recognises a victim’s right to report an incident. Protection may involve police, prosecution, social-support and court processes distinct from the divorce case. The facts and urgency determine the correct route.
If anyone is in immediate danger in the UAE, call Police on 999. The Dubai Foundation for Women and Children lists its official helpline as 800111. This website and its inquiry form are not emergency services. A person using a monitored device should consider a safer device and follow official safety instructions.
Where it is safe and lawful, preserve photographs, medical reports, police references, threats, witness details and a dated incident log. Do not provoke contact to create evidence. Digital monitoring, account control, threats involving children, financial restriction or coercive behaviour may require tailored legal and safety assessment; labels alone do not establish a court finding. Read domestic violence protection, emergency orders and coercive control and digital abuse.
Evidence must be authentic, relevant and lawfully obtained
The strongest case file is organised around disputed propositions. For each allegation, identify what happened, when, who was present, which original record supports it and what order is requested. Preserve full message threads and metadata where possible. Translate foreign-language documents through the required official process and arrange legalisation or attestation when necessary.
Secret recordings, account access, location tracking and publication can raise privacy, cybercrime and admissibility issues. Get advice before collecting or using such material. Do not assume that evidence accepted abroad will be accepted or given the same weight in a UAE proceeding.
Where a document is held by a bank, school, employer or government authority, lawful production procedures may be available. A targeted request is usually more effective than an indiscriminate file dump. See evidence in family court.
Negotiated settlement can protect rights without concealing trade-offs
Settlement can address divorce, dowry, maintenance, housing, child expenses, custody, contact, travel, property and implementation. It must use precise language and comply with mandatory law. A private promise may not create the same enforcement route as a court-approved agreement or judgment.
Separate each obligation: amount, currency, payer, recipient, date, account, proof, review mechanism and default step. For children, state the practical schedule, handover, holidays, communication, passports and emergency decisions. Avoid trading child contact for unpaid maintenance or making a child’s legal rights the price of a property concession.
Before signing, test whether the proposed term can actually be registered, transferred and enforced. Foreign assets may need local instruments or foreign counsel. Arabic and translated versions must be checked for consistent legal effect.
Enforcement and variation are different from starting a claim
After judgment, keep a certified copy, finality evidence where required, payment record and communication about compliance. If money is unpaid or contact is obstructed, use the competent execution or family process. Do not retaliate through self-help, public accusation, unauthorised asset seizure or removal of a child.
An existing order may need variation if circumstances materially change. A new job, changed school, relocation, medical issue or altered care arrangement does not automatically rewrite the order. Record the change and seek the appropriate decision. Foreign judgments require recognition and execution analysis under UAE civil procedure and any applicable treaty; translation alone is not enforcement.
How Mr AlBalooshi assists women seeking legal support
Mr AlBalooshi’s first task is to classify the legal regime, court, urgency and evidence. The engagement may then include advice on divorce route, contract and dowry, maintenance, child arrangements, protection measures, settlement drafting, court documents, hearings, enforcement and coordination with foreign or specialist counsel.
The opening inquiry should state the spouses’ nationalities, religion where relevant, marriage place, children’s locations, any case number, next hearing, existing order and immediate concern. Upload only the most important documents initially, such as the marriage certificate, relevant order and a short chronology. Conflict checks and a formal engagement are required before legal advice or representation begins.
Speak with the family-law team about your UAE family matter
Use the inquiry form with your name, mobile number, email, message and optional document upload. State immediately if there is a hearing, travel date, protection concern or limitation deadline. For WhatsApp intake, contact +971 50 627 5196. If there is immediate danger, contact Police on 999 rather than waiting for a website response.
Frequently asked questions
Which UAE law applies to a woman’s divorce?
It depends on citizenship, religion where legally relevant, residence, the marriage and the court route. Muslim personal status, federal civil personal status and Abu Dhabi civil-family rules require separate analysis.
Can a woman obtain a divorce without proving fault?
Qualifying non-Muslims may use a civil no-fault route. A Muslim divorce proceeds under different statutory grounds and procedures. The correct route must be confirmed before filing.
Is a wife always entitled to spousal maintenance?
No automatic universal outcome should be assumed. Entitlement, amount and duration depend on the applicable regime, facts, evidence, means and statutory factors.
Can temporary maintenance be requested while a case continues?
Interim financial relief may be available in an appropriate case. The application should identify urgent needs, current payments, income evidence and the requested amount.
How is a deferred dowry claimed?
The authentic marriage contract, dissolution route, payment evidence and any waiver or settlement must be reviewed. Dowry should not be confused with gifts or ordinary property disputes.
Does a mother automatically keep the children after divorce?
No result is guaranteed. The applicable law and the child’s welfare, stability, care and circumstances guide the court’s decision.
What is the difference between custody and guardianship?
Custody commonly concerns daily care, while guardianship can concern legal or financial authority. Exact functions differ between Muslim and civil regimes and must be checked in the relevant case.
Can child maintenance be withheld when contact is refused?
Support and contact are separate legal duties. A parent should use enforcement or variation procedures rather than retaliatory non-payment or self-help.
May a mother travel abroad with a child?
Travel depends on passports, consent, guardianship, existing orders and any travel ban. Obtain advice before booking or travelling where consent is disputed.
Can a mother relocate permanently with a child?
Relocation can affect custody and contact and may require consent or a court decision. A detailed child-focused plan and cross-border enforceability assessment are important.
What should a woman do in immediate danger?
Call UAE Police on 999. DFWAC lists 800111 as its official helpline. A law-firm inquiry form is not an emergency channel.
Can threatening messages be used as evidence?
They may be relevant if authentic and lawfully obtained. Preserve the full exchange and device; obtain advice before recording, accessing accounts or publishing material.
Can a foreign divorce or custody order be used in the UAE?
Possibly, but recognition and execution conditions apply. Obtain the final order, service evidence, legalisation where required and certified Arabic translation for assessment.
Should a woman sign a settlement drafted by her spouse?
Only after independent review of its meaning, legal effect and implementation. Particular care is needed with waivers, Arabic documents, child terms, property transfers and enforcement.
What should be uploaded with the first inquiry?
Start with the marriage certificate, relevant judgment or hearing notice, a concise chronology and the document proving the urgent issue. Do not upload an unnecessary complete personal archive.
