Family Guidance is the court-connected process used to explore an amicable resolution of many UAE personal-status disputes before or alongside referral to the competent court. A family counsellor helps the parties identify the dispute, understand family rights and obligations and consider settlement. The counsellor does not decide contested facts or impose a divorce, custody transfer or financial award as a judge would.

Article 8 of Federal Decree-Law No. 41 of 2024 on the Promulgation of the Personal Status Law provides the current federal statutory basis for referral to the Family Guidance Department or Section before a case reaches the competent court. If reconciliation is achieved, it is recorded in a signed report and dealt with under the applicable procedure. If no resolution is achieved, the dispute can proceed to the court. Federal Judicial Council Resolution No. 67 of 2025 further regulates family guidance at federal courts and, according to the Ministry of Justice, gives qualifying agreements the force of an executive deed.

The exact route varies by judicial authority and legal regime. Dubai Courts, Abu Dhabi Judicial Department and the federal courts have their own service channels and administrative requirements. Civil personal-status divorce can also follow a different route. A party should confirm the competent authority before filing or relying on an earlier process.

Mr AlBalooshi assists with preparing for family guidance, identifying urgent issues, evaluating settlement language and moving unresolved claims into the correct court procedure. Submit the inquiry form with the marriage document, a short chronology and any current order, or WhatsApp +971 50 627 5196.

Family Guidance is a resolution gateway, not a court judgment

Family guidance is designed to reduce conflict and help parties resolve appropriate disputes without a contested hearing. It may address marriage and separation, maintenance, accommodation, mahr, custody, contact and other family obligations, depending on the competent authority and the claim. Abu Dhabi Judicial Department’s official Family Guidance page, for example, lists marital disputes, divorce, divorce-related rights, custody, visitation and maintenance among its services.

The process should not be confused with private counselling or therapy. It is connected to the judicial system, and what the parties sign can have legal consequences. Nor is it a fact-finding trial. A counsellor may explain options and record agreement, but disputed evidence, witness credibility, expert issues and contested legal remedies ordinarily belong before the competent judge.

A session is not proof that either party has admitted fault. Attendance should be approached seriously, but the goal is to identify what can safely and lawfully be agreed and what remains for judicial determination.

Article 8 and the current federal family-guidance framework

Under Article 8 of Federal Decree-Law No. 41 of 2024, the supervising judge may refer the parties to the Family Guidance Department or Section before sending the case to the competent court. The wording matters: the procedural treatment depends on the claim, the court and the applicable rules rather than a universal assumption that every family filing follows an identical mandatory sequence.

The Ministry of Justice announced Federal Judicial Council Resolution No. 67 of 2025 on the Family Guidance Regulation in November 2025. The official announcement states that the regulation broadens counsellors’ role in amicable resolution and gives their agreements the force of an executive deed. This is significant: a settlement is not merely an informal promise when it is recorded and approved through the authorised process.

Local judicial authorities may operate their own family-guidance services. Their electronic portals, appointment systems, forms and referral practices should be checked on the filing date. A procedure described for Abu Dhabi should not be presented as the Dubai or federal-court procedure without verification.

Claims that may be discussed during guidance

The issues taken to family guidance can include:

  • reconciliation or an agreed divorce route;
  • current and past spousal or child maintenance;
  • family accommodation and custody housing;
  • mahr and other financial rights arising from marriage or divorce;
  • custody, visitation, hosting and child handover arrangements;
  • school, health, passport or travel arrangements where settlement is legally possible;
  • the practical terms of separation; and
  • agreed declarations or obligations accepted by the relevant authority.

Not every matter is suitable for compromise. A party cannot lawfully waive a child’s independent rights merely to secure a quick divorce. A settlement cannot authorise conduct prohibited by law, bind a person who was not a party, or confer jurisdiction on a court that lacks it. Rights over a child’s welfare, a minor’s property or urgent protection may require judicial scrutiny even where the adults agree.

The federal Civil Personal Status Law has an express exception for divorce proceedings within its scope. Article 3 of Federal Decree-Law No. 41 of 2022 excludes those civil-divorce proceedings from referral to family guidance. That civil exception should not be imported into a Muslim personal-status claim.

From registration to a remote or in-person session

The practical steps usually begin with registration through the competent authority’s approved service channel. The applicant may need UAE Pass, identity records, the marriage certificate, contact details for the other party and a clear description of the claims. Foreign documents may require legalisation or apostille where accepted and a legal Arabic translation.

The authority schedules a session and notifies the parties through its system. Abu Dhabi Judicial Department states that its sessions may be held remotely by videoconference and that the assigned employee coordinates appointment changes. Other authorities can use different platforms or attendance rules, so parties should rely on the notice they receive.

At the session, the counsellor normally identifies each issue, hears the parties’ positions and explores whether any or all claims can be settled. The parties may reach:

  1. a complete agreement resolving the dispute;
  2. a partial agreement, leaving defined issues for the court; or
  3. no agreement, followed by referral or permission to proceed under the applicable process.

Missing a session can delay referral or trigger another procedural consequence. A party who cannot attend should request an authorised change rather than simply failing to appear.

A counsellor can facilitate agreement but cannot decide contested rights

The family counsellor’s role is neutral and settlement-focused. The counsellor may clarify obligations, test whether proposals are workable and record agreed terms. The counsellor does not replace each party’s lawyer and cannot give one side confidential strategic advice.

Where facts are disputed, the counsellor does not usually conduct the full evidential exercise that a court performs. Allegations of harm, hidden income, non-payment, unsafe parenting or unlawful removal may require documents, witnesses, experts or official records. If agreement is not appropriate, the unresolved issues should be defined accurately for the court.

Parties should avoid using a session to threaten, publish accusations or pressure a vulnerable spouse into an unclear waiver. A calm written proposal, backed by documents and separated into adult financial rights and child-related arrangements, is more useful than a long unstructured narrative.

A signed settlement may become directly enforceable

A family-guidance settlement needs careful drafting because it can become enforceable. Terms should identify the parties, amounts, due dates, payment method, accommodation, child arrangements, travel consent, document delivery and the consequences of non-compliance with sufficient precision.

Common drafting problems include:

  • using “reasonable expenses” without defining amount or calculation;
  • failing to state when maintenance begins or how arrears are treated;
  • combining spouse and child rights into one undifferentiated waiver;
  • overlooking school, medical, housing or transport costs;
  • granting broad travel consent without destinations, dates or return arrangements;
  • omitting how passports or original documents will be exchanged;
  • writing a contact schedule that cannot work with school and employment; and
  • releasing unknown claims more widely than either party understood.

Before signing, read the Arabic record and any translation. Confirm that the text matches the actual agreement. An oral side promise should not be assumed to alter an authenticated settlement.

The procedure is described in full on Family Guidance and Reconciliation, and the document itself in the glossary entry for a reconciliation agreement.

Documents that make the session more productive

The useful bundle depends on the dispute, but it commonly includes:

  • passports, Emirates IDs and current addresses;
  • the marriage certificate and legal Arabic translation if required;
  • children’s birth certificates, IDs and passports;
  • prior judgments, settlement records and execution-file details;
  • a concise chronology with the requested outcome;
  • salary certificates, bank records and proof of regular expenses for maintenance;
  • tenancy, school, medical and childcare documents where relevant;
  • a schedule of payments made or missed;
  • proposed custody, contact, travel or handover terms; and
  • a draft settlement organised by issue.

Bring complete documents rather than selected screenshots that distort the conversation. Preserve original digital records. Family guidance is not the place to upload every message exchanged during the marriage; select material that explains the claim or supports a settlement figure.

Urgent safety, child and asset issues need separate attention

Family guidance is not an emergency service. If anyone faces immediate physical danger, contact UAE Police on 999 or the appropriate protection authority. A website inquiry or scheduled counselling session cannot issue a protection order.

Urgent judicial relief may be needed for immediate maintenance, child travel, passport delivery, school or medical decisions, preservation of money or another time-sensitive issue. Whether an urgent application can proceed before guidance ends depends on the competent procedure. Do not remove a child, seize documents, empty accounts or breach an existing order based on the expectation that the counsellor will approve the action later.

For time-sensitive court measures, review urgent interim applications and emergency family orders.

Muslim and civil-family routes must remain separate

For a Muslim personal-status dispute under Federal Decree-Law No. 41 of 2024, Article 8 and the relevant court’s family-guidance practice must be considered. Reconciliation may also interact with specific divorce provisions, including harm-based judicial separation and arbitral reconciliation.

For an eligible non-Muslim case under Federal Decree-Law No. 41 of 2022, Article 3 expressly excludes civil divorce proceedings from family-guidance referral. That does not mean every related financial or child application follows the same simplified path.

Abu Dhabi’s Civil Family Court applies its local civil-family framework within its jurisdiction. Its no-fault divorce, joint-custody and post-divorce financial processes are distinct from the general Abu Dhabi Family Guidance service. Eligibility, residence, nationality, religion, marriage type and prior orders should be checked before selecting the channel.

Preparing for Family Guidance in Dubai covers what to take with you. To prepare for a session with advice, book a consultation.

Hypothetical example: partial agreement, defined dispute

Assume spouses agree that their child will remain in the current school and that temporary maintenance will be paid on a specified date, but they cannot agree on permanent custody or international travel. A useful family-guidance record can state the agreed school and payment terms precisely and identify custody and travel as unresolved.

The court then receives a narrower dispute. The example does not predict that every partial agreement will be recorded or that a court will accept the parties’ characterisation. It shows why separating issues can protect immediate stability while preserving contested claims for judicial determination.

How Mr AlBalooshi can assist before and after guidance

Mr AlBalooshi can identify the competent authority and legal regime, organise claims and evidence, prepare realistic settlement proposals, explain the effect of waivers, advise on urgent relief, review the official settlement text and prepare the next court stage where no agreement is reached. He can also assist with enforcement if an authenticated obligation is not performed.

Request a case review through the inquiry form. Include the session date, referral or file number, a one-page chronology, the orders you seek and any draft agreement. For a prompt response, WhatsApp +971 50 627 5196. An inquiry does not create a lawyer-client relationship; conflict checks, agreed scope and formal engagement are required.

Frequently asked questions about UAE Family Guidance

1. What is Family Guidance in the UAE?

It is a court-connected process in which a family counsellor helps parties explore an amicable resolution of personal-status disputes. If agreement is reached, it can be formally recorded. If not, the unresolved dispute can proceed to the competent court under the applicable procedure.

2. Is Family Guidance the same as marriage counselling?

No. It may include reconciliation discussion, but it is part of the judicial dispute-resolution framework. The counsellor addresses legal and practical family obligations and may record a binding settlement; private therapy has a different purpose.

3. Must every divorce case go through Family Guidance?

Not every case follows the same rule. Article 8 governs referral under the federal Personal Status Law, while Article 3 of the federal Civil Personal Status Law excludes qualifying civil-divorce proceedings from family-guidance referral. Local procedures and urgent exceptions must also be checked.

4. What happens if the other spouse refuses to settle?

No party can be forced to accept settlement terms. If reconciliation or agreement is not achieved, the dispute can be referred or released to the competent court in accordance with the authority’s procedure.

5. Can the counsellor order divorce or custody?

The counsellor facilitates agreement but does not determine contested claims as a judge does. A divorce, custody transfer or contested financial order requires the legally appropriate agreement, declaration or court judgment.

6. Is a Family Guidance agreement enforceable?

An agreement recorded and approved through the authorised process can have executory force. Federal Judicial Council Resolution No. 67 of 2025 strengthened this position at federal courts. The exact record and authority should be checked before enforcement.

7. Can only part of a dispute be settled?

Yes, where the authority accepts the terms. A partial settlement should state exactly what is resolved and what remains disputed so that no one later mistakes silence for a waiver.

8. Can a child’s maintenance be waived to obtain divorce?

Child rights require separate protection and cannot safely be treated as a bargaining asset belonging entirely to a parent. Any settlement affecting a child must comply with the applicable law and the child’s interests.

9. Are Family Guidance sessions remote?

Some authorities provide remote sessions. Abu Dhabi Judicial Department describes videoconference sessions in its current procedure. The platform, identity verification and attendance rules should be confirmed from the actual notice.

10. Can a lawyer attend the session?

Representation and attendance arrangements depend on the authority, the type of session and any accepted power of attorney. Even where personal attendance is expected, legal advice before the session can protect against unclear admissions or waivers.

11. What documents should I take?

Take identity records, the marriage certificate, child documents, relevant orders, a short chronology, proof of income and expenses, payment records and a structured proposal. Foreign records may need authentication and legal Arabic translation.

12. What if there is domestic violence or immediate danger?

Family guidance is not an emergency service. Contact Police on 999 where danger is immediate and seek advice about protection or urgent court measures. Do not wait for an ordinary counselling appointment to address an active safety threat.

13. Does missing a session end the case?

Not necessarily, but absence can delay the matter or have procedural consequences. Use the authority’s approved channel to request rescheduling or explain an inability to attend rather than ignoring the notice.

14. What happens after a failed reconciliation attempt?

The authority records that settlement was not reached and the dispute proceeds under the applicable referral or court-registration route. The claimant must still plead the correct remedy and provide the evidence required for it.

15. Can a Family Guidance settlement be changed later?

Variation may require agreement, a new authenticated record or a court application, depending on the term and legal basis. Child arrangements remain subject to the child’s interests, while accrued financial obligations may require enforcement rather than informal rewriting.
