A power of attorney (POA) is a legal instrument by which a principal authorises an agent to perform specified legal acts in the principal’s name and for the principal’s account. In UAE family-law, inheritance and related proceedings, it may authorise a lawyer or another permitted representative to file documents, attend hearings, receive notices, negotiate, sign defined applications or implement estate and property steps.

The current federal Civil Transactions Law is Federal Decree-Law No. 25 of 2025, which entered into force on 1 June 2026 and repealed the former 1985 Civil Transactions Law. Article 866 defines agency; Article 867 states that the agency must follow the form required for the legal act being delegated. The law distinguishes general, special, conditional and deferred agency, and requires specific authority for acts beyond ordinary management and preservation.

A broad label such as “family matters” may be insufficient for a court, bank, notary or land authority. Conversely, unnecessary powers to settle, waive rights, receive money or dispose of assets can create risk. Mr AlBalooshi can match the wording to the actual case and receiving authority. Use the inquiry form or WhatsApp +971 50 627 5196.

A POA creates agency, not ownership or a result

The principal remains the person whose legal affairs are affected. The agent acts only within the authority granted and applicable law. A POA does not transfer ownership of the principal’s property, make the agent a beneficiary or promise that a court or institution will accept every requested act.

The receiving authority checks the document, identity, validity, scope and formalities. A court may still require the principal’s personal attendance, testimony, oath, medical examination, settlement confirmation or other act that cannot properly be delegated. A bank, land department or company may use its own form or compliance review.

The document should identify both parties accurately and state the transaction, case or category of affairs with enough precision to be usable and safe.

General and special powers serve different purposes

A general POA can authorise routine management within its wording and the law. It should not be treated as authority for every high-impact act. The current Civil Transactions Law states that an act outside management and preservation requires a special agency.

A special POA identifies the particular legal act or class of acts. Family and succession matters often need express language for powers such as:

  • filing or defending a divorce, maintenance, custody or personal-status case;
  • appointing advocates or legal representatives and substituting them where permitted;
  • signing pleadings, applications and procedural requests;
  • receiving notices, judgments and certified copies;
  • settling, admitting, waiving, discontinuing or accepting a claim;
  • appealing or waiving an appeal;
  • receiving money, cheques, property or estate distributions;
  • selling, transferring, mortgaging or relinquishing an asset;
  • applying for probate, an inheritors notification or estate liquidation; and
  • dealing with a specific bank, land authority, company or free zone.

These powers should not be inserted automatically. The principal should understand each one and grant only what is needed.

Family-court representation requires a case-specific powers audit

Civil procedure, court practice and the substantive family regime determine what a representative may do. A POA for an onshore Dubai family case should identify the competent courts and procedural powers. An Abu Dhabi civil-family matter, DIFC probate application or ADGM estate case may require different wording and portal access.

The substantive regime also remains separate. A POA does not decide whether Muslim personal status, federal civil personal status or Abu Dhabi civil-family law applies. It authorises representation after that classification is made.

Before signing, create a list of anticipated acts: counselling or reconciliation steps, claim filing, interim applications, evidence, expert appointments, settlement, appeals, execution and receipt. Draft powers to that list rather than copying a commercial POA.

Divorce powers can be especially sensitive

Divorce may involve personal declarations, consent, settlement and procedural acts. Under some routes, the court may accept representation for filing and attendance but require the party personally for a particular confirmation. Under another route, an express special power may be necessary for the representative to pronounce, accept, request or record a form of divorce.

Do not assume that a POA authorising “all court cases” includes every personal-status act. It may need specific language on divorce, reconciliation, dowry, maintenance, financial claims, settlement and appeals, tailored to the applicable law.

If spouses are negotiating a settlement, authority to negotiate is not necessarily authority to sign, waive and receive. Separate those decisions in the drafting.

Children-related powers do not replace the court’s welfare role

A parent can authorise representation in custody, guardianship, contact, travel or maintenance proceedings, but cannot use a POA to predetermine the court’s decision or remove mandatory child-protection controls. A representative acts in the case; the court applies the governing law and considers the child’s circumstances.

Travel consents, school or medical permissions and litigation powers are different documents or clauses. A custody-case POA should not be presented to an airline or school as if it were a parental travel consent unless that institution confirms acceptance.

Where an urgent travel restriction or protective order is involved, confirm whether the principal must attend or provide a separate verified statement.

Inheritance and estate POAs need an asset-by-asset design

An heir abroad may appoint an agent to obtain documents, apply for proof of heirs, participate in probate or liquidation, deal with banks and sign transfers. Each stage can require specific powers. Authority to apply for a succession certificate may not include authority to sell inherited property or receive the sale proceeds.

Consider separate or controlled powers for:

  • obtaining death and civil-status records;
  • applying for a will search or probate;
  • identifying heirs and estate assets;
  • representing the heir in liquidation proceedings;
  • accepting or contesting an inventory;
  • settling estate disputes;
  • receiving an inheritance share;
  • selling or transferring real estate or company shares; and
  • appointing another agent.

If a minor or protected person is an heir, the adult agent cannot bypass guardianship and court approval requirements.

A lawyer’s litigation authority is different from unrestricted personal authority

A principal may authorise a lawyer for defined legal proceedings without giving the lawyer control over unrelated property or personal affairs. Litigation powers should be proportionate to strategy and current procedural needs.

Some authorities distinguish between the named agent and advocates whom the agent may appoint. If substitution is intended, say so in a controlled way. If it is prohibited, the POA should be consistent with how the legal team will actually file and appear.

Receipt powers deserve particular caution. Authority to receive a judgment or document is not the same as authority to receive settlement funds. Specify the intended channel and require transparent accounting.

Form must follow the delegated act

Article 867 of the current Civil Transactions Law connects the form of the agency to the form required for the underlying legal act. This is why an informal email may not authorise a notarised property transfer or a court act requiring a formally authenticated POA.

For UAE use, a POA is commonly notarised or authenticated through the competent UAE notary or judicial department. The Ministry of Justice operates an E-Notary system, while local judicial departments publish their own notary services. The Abu Dhabi Judicial Department’s official service states that its POA service covers all types of powers of attorney and identifies online channels and required documents.

The correct notary depends on jurisdiction, language, identity, signing location and document type. Verify the live service before execution.

Drafting should begin with the receiving authority

Ask the court, bank, land department, free zone, company, registry or foreign authority what it requires. Some bodies demand:

  • a recent or still-valid POA;
  • a specific Arabic form or bilingual text;
  • exact case, property, licence or account identifiers;
  • express powers for sale, settlement, waiver or receipt;
  • a certified copy or digitally verifiable original;
  • proof that the agent is permitted to act;
  • an attestation and translation chain; or
  • separate portal registration of the representative.

Drafting without this check can produce a valid agency that is operationally rejected because it does not satisfy the institution’s process.

Signing inside the UAE

For a UAE-issued POA, the principal generally proves identity and signs or confirms the instrument through the competent notarial channel. Digital processes may allow remote identity verification, document review and video confirmation, subject to current service rules.

Prepare the principal’s passport, Emirates ID where applicable, the agent’s correct identity details, the draft POA and supporting documents for the delegated transaction. A company principal may need a trade licence, constitutional documents and evidence that the signatory has authority to issue the POA.

Do not sign a blank or incomplete power. Review the Arabic text, because it may be the text applied by the receiving authority. Use a legal translator where needed.

Signing outside the UAE

A foreign-issued POA normally needs a legally recognised authentication chain before UAE use. The exact route depends on the issuing country and receiving authority. It may involve local notarisation, authentication by the foreign authority, UAE embassy or consulate authentication, UAE Ministry of Foreign Affairs attestation and legal Arabic translation.

The UAE Ministry of Foreign Affairs provides an official Attestation of Official Documents and Certificates service. Its current instructions, eligible document types, digital-verification rules and fees should be checked immediately before submission.

An apostille is not automatically a substitute for every UAE attestation step. Treaty status, document origin and the receiving body’s practice must be verified. Read Legalisation and Attestation for the document chain.

Language and translation can change the granted power

The Arabic and English versions should express the same authority. A translation that turns “represent me in an estate application” into “dispose of all my property” is not a minor linguistic issue.

Use consistent names, passport numbers, case references and property descriptions. If the POA is signed in another language, the receiving UAE authority may require a legal Arabic translation by an approved translator. Preserve the original, authentication pages and seals as one chain.

When bilingual versions differ, seek legal review rather than assuming the more convenient text controls.

Duration, termination and revocation should be deliberate

A POA can state a fixed end date, end upon completion of a defined transaction or remain effective until terminated under the law. The current Civil Transactions Law contains rules on expiry and termination of agency. Death, incapacity, completion, revocation and other events can affect authority, subject to the instrument and mandatory provisions.

Revocation should be documented through the appropriate notarial or judicial channel. The Abu Dhabi Judicial Department publishes a Cancel POA service. Notice should also be given to the agent and every court, bank, registry or institution that may rely on the old document.

Simply destroying the principal’s copy does not reliably notify third parties. Keep proof of cancellation and delivery.

An agent must stay within authority and account for actions

An agent should act within the POA, follow lawful instructions, avoid unauthorised conflicts and account for documents, funds and property handled. The principal should request copies of filings, receipts and transaction records.

Controls can include limiting substitution, requiring two agents to act jointly for a sale, excluding receipt of funds, naming a specific account for distributions and setting a defined expiry. Joint action can improve control but may reduce speed, so it should reflect the actual transaction.

Never give a stranger or unverified intermediary a broad POA merely to “speed up” a family or inheritance matter.

Remote representation has limits

A valid POA can allow much of a case to proceed while a client is abroad, including document filing, procedural attendance and coordination. It does not guarantee that the client will never need to appear. Courts may require personal testimony, oath, identity confirmation, medical or expert participation, settlement approval or another personal act.

Technology and service channels also vary by emirate and case type. Confirm hearing method, UAE Pass access, representation registration and original-document rules. Read Remote Representation and Family Law POA for the procedural route.

A POA is not a will or advance inheritance transfer

A POA operates during the principal’s lifetime and ordinarily ends or changes effect upon death under the applicable law. A Civil Will expresses testamentary intentions for after death. The two instruments should not be confused.

An elderly parent may appoint an agent to manage assets, but that does not make the agent an heir or permit gifts to themselves outside the granted authority and law. Estate planning, capacity planning and lifetime agency require separate safeguards.

Practical powers checklist

Before drafting, answer:

  1. Who is the principal and who is the agent?
  2. What exact case, estate, asset or institution is involved?
  3. Which law, court and emirate apply?
  4. Is filing authority enough, or are settlement and appeal powers needed?
  5. May the agent receive money or original documents?
  6. May the agent sell, transfer, mortgage or waive anything?
  7. May the agent appoint another lawyer or sub-agent?
  8. What acts require the principal personally?
  9. When should the POA expire?
  10. Where will it be signed, authenticated, translated and used?

The safest useful POA is specific enough to be accepted and limited enough to match informed instructions.

Practical example: a parent abroad in a UAE family case

Assume a parent living abroad needs representation in a Dubai maintenance and parenting case. The POA may authorise case filing, notices, procedural hearings, evidence applications, appeals and agreed settlement steps. It should not automatically grant power to sell the parent’s property or receive unrelated funds.

The signing country determines the authentication chain. The Dubai court may still require personal testimony or confirmation. The representative should verify the case route and exact wording before the principal completes foreign notarisation. This example is illustrative only.

Documents to prepare for a POA review

Prepare:

  • principal’s passport, Emirates ID and contact details;
  • agent’s complete identity and professional details;
  • case number, court and current orders if proceedings exist;
  • relevant marriage, divorce, child or estate records;
  • property, account or company identifiers for asset powers;
  • the receiving authority’s form or written requirements;
  • any earlier POA and cancellation record;
  • the country and city of signature; and
  • the intended expiry, substitution and receipt limits.

Do not send banking passwords, UAE Pass credentials or blank signed forms.

How Mr AlBalooshi can assist with a family-law POA

Mr AlBalooshi can classify the case and forum, identify the necessary procedural and special powers, remove unnecessary disposal or receipt authority, coordinate the appropriate UAE or foreign signing route, review Arabic and English text, arrange court representation within the agreed scope and advise on amendment or revocation.

Submit the inquiry form with the case type, court or emirate, your location, intended agent and acts to be authorised, or WhatsApp +971 50 627 5196. An inquiry does not create a lawyer-client relationship; conflict checks, scope and written terms must be completed.

Frequently asked questions about UAE powers of attorney

1. What is a power of attorney under UAE law?

It is an agency instrument authorising an agent to perform specified legal acts in the principal’s name and for the principal’s account.

2. Which Civil Transactions Law now applies?

Federal Decree-Law No. 25 of 2025 entered into force on 1 June 2026 and repealed the former 1985 law. Article 866 defines agency and Article 867 addresses form.

3. What is the difference between general and special POA?

A general agency covers management within its lawful wording. Acts beyond management and preservation require specific authority under the current law.

4. Can a POA authorise a divorce case?

It can authorise defined representation, but divorce-related powers may need express wording and the court may require the principal for particular personal acts.

5. Can it cover custody and child maintenance?

Yes, with appropriate case powers, but it does not replace the court’s legal duties or decide the child’s arrangements.

6. Can I appoint a lawyer while outside the UAE?

Usually, subject to the issuing country’s formalities, authentication, UAE MOFA attestation, legal translation and the receiving court’s requirements.

7. Does a POA mean I never attend court?

No. The court may require personal testimony, oath, identity verification, settlement confirmation or another non-delegable act.

8. Must the POA be notarised?

Many UAE court, property, banking and estate uses require a notarised or authenticated POA. The form follows the delegated act and receiving authority.

9. Is an English POA accepted?

It may need an Arabic or bilingual version and legal translation. Some UAE services offer English notarisation, but the receiving authority’s current rules control.

10. Can the agent settle or waive my rights?

Only if the POA and law give the required special authority. These high-impact powers should be expressly considered, not included by default.

11. Can the agent receive settlement or inheritance money?

Only if receipt authority is clearly granted and accepted. Consider directing funds to the principal’s verified account rather than granting broad cash-receipt powers.

12. Can the agent appoint another agent?

Substitution depends on the POA and the law. State clearly whether and how the agent may appoint a lawyer or sub-agent.

13. How is a POA revoked?

Use the appropriate notarial or judicial cancellation process, notify the agent and inform every institution that might rely on the document. Keep proof.

14. Does a POA continue after death?

Do not rely on it for post-death authority. Death affects agency under the law, while executors and heirs act through the applicable estate process.

15. What should I provide for drafting?

Provide identities, exact case or asset details, receiving authority, intended powers, excluded powers, substitution, receipt limits, signing country and expiry.
