Disputes about children raise the questions parents most want a straight answer to, and the ones where a wrong assumption does the most damage. These answers are deliberately short. Each group links to the full guide, which sets out the procedure, the evidence and the official sources.

One idea is worth holding on to throughout: the everyday word “custody” covers several different legal roles in the UAE, and the one you need may not be the one you asked about. Day-to-day care, guardianship, decision-making, travel consent and maintenance can sit differently and be decided separately.

One warning before the answers. The UAE runs more than one family-law framework, and they must not be read as a single system: Muslim personal status; the federal civil personal-status regime for those within its scope; the Abu Dhabi civil-family route, which is a local framework with its own eligibility and procedure; onshore court procedure, which is separate again from the substantive law; and cross-border recognition and enforcement, which depends on both countries involved. A rule from one does not carry across to another.

Child Custody & Guardianship

Who normally gets child custody after divorce in the UAE?

There is no reliable answer without identifying the legal route. The Personal Status Law uses custody and guardianship concepts and a statutory framework; the federal civil and Abu Dhabi civil-family routes begin with joint custody for eligible cases. The court considers the applicable law, evidence and the child’s interests.

This is set out at length on Child Custody Lawyer UAE.

Is the mother automatically entitled to custody?

Do not treat custody as automatic. The Personal Status Law recognises an order of entitlement and conditions, but competing claims and the child’s interests can require a court decision. Civil joint-custody regimes use a different starting point.

Does the father lose all rights if the mother has day-to-day custody?

No. Custody, guardianship, contact and maintenance are separate. The exact rights and duties depend on the governing law and operative judgment. A day-to-day custodian does not necessarily hold every guardianship power.

What is the difference between custody and guardianship?

Custody generally concerns preservation, upbringing and daily care. Guardianship may concern general legal supervision over the child and, separately, management of the child’s property. The meaning and allocation must be read under the applicable regime.

Custody vs Guardianship

Are custody and guardianship the same in UAE law?

No. Under the Personal Status Law, custody concerns preservation, upbringing and care, while guardianship concerns general supervision over the minor and, separately, property. Civil regimes use joint legal and physical custody concepts.

For the detail behind this, see Custody vs Guardianship in UAE Family Law.

What does hadana mean?

*Hadana* refers to the child’s custody: practical preservation, upbringing and daily care in accordance with the child’s interests and the governing law.

What does wilaya ala al-nafs mean?

It means guardianship over the person—general supervision over the minor in a way that does not conflict with the lawful authority of the custodian.

What does wilaya ala al-mal mean?

It is guardianship over the minor’s property and financial affairs. It is separate from the child’s residence and from ordinary maintenance payments.

Custody Rules After 2025

When did the new UAE Personal Status Law take effect?

Federal Decree-Law No. 41 of 2024 took effect on 15 April 2025, six months after its Official Gazette publication date recorded on the legislation portal.

UAE Custody Law After 2025 covers this in full.

At what age does custody now end?

For cases governed by the current Personal Status Law, custody ordinarily ends at 18 Gregorian years. Special circumstances, including relevant health needs, may require further legal analysis.

Can a child choose a parent at age 15?

The law allows a child who has reached 15 to choose to reside with one parent unless the child’s interests require otherwise. The court retains a protective role.

Does the child’s choice decide guardianship too?

No. The statutory choice concerns residence. Guardianship over the person, property authority, support and travel are separate questions.

Full detail: the custody rules that now apply.

Joint Custody

Is joint custody automatic in the UAE?

It is the statutory starting point in eligible federal civil personal-status cases and under Abu Dhabi’s civil-family framework. It is not the universal rule for every UAE family case.

The complete treatment is on Joint Custody in the UAE.

Does joint custody always mean exactly equal nights?

No. Joint physical custody may involve equal or close-to-equal time, but the court can approve a practical schedule serving the child’s interests.

What is joint legal custody?

It is both parents’ participation in major decisions such as education, medical care and religious upbringing under the civil framework.

What is joint physical custody?

It concerns where the child lives and how parenting time is divided between the parents.

Full detail: how joint custody works.

Mothers’ Rights

Does a mother automatically receive custody in the UAE?

Under the Personal Status Law the mother is first in the statutory order after separation, but she must meet the conditions and the court considers the child’s interests. Civil regimes begin with joint custody.

More detail, and the sources behind it, on Mothers’ Rights in UAE Child Custody Cases.

Until what age can a mother have custody?

Under Federal Decree-Law No. 41 of 2024, custody ordinarily ends at 18 Gregorian years. Existing orders and special circumstances require review.

Can a 15-year-old choose to live with the mother?

The child may choose residence with one parent from 15 unless the child’s interests require otherwise. The court determines the issue and the choice does not decide every guardianship or support matter.

Does a custodial mother have guardianship too?

Not automatically. Custody, guardianship over the person and property guardianship are separate under the Personal Status Law.

Full detail: Mothers’ Rights.

Fathers’ Rights

Do fathers have custody rights in the UAE?

Yes. The nature of the right depends on the legal route. A father may have guardianship, contact and potential custody rights under the Personal Status Law, or joint custody under an eligible civil regime.

The full explanation is on Fathers’ Rights in UAE Child Custody Cases.

Is a father automatically the legal guardian?

The Personal Status Law contains guardianship rules, but the exact holder, scope and any exception must be confirmed from the law and judgment. Do not treat the title as unlimited authority.

Can a father receive day-to-day custody?

Potentially, where the statutory framework, evidence and child’s interests support it. Guardianship alone does not automatically transfer physical custody.

Does a father have a right to see the child?

The current Personal Status Law recognises the other parent’s right to visit and take the child when one parent has custody, subject to the lawful arrangement or order.

Full detail: Fathers’ Rights.

Child Maintenance

What does child maintenance cover in the UAE?

Under the Personal Status Law, maintenance includes basic needs such as food, clothing, housing, medical treatment and education, as applicable. The order depends on evidence and law.

This is set out at length on Child Maintenance in the UAE: Legal Guide.

Is there a fixed UAE child-support calculator?

Do not rely on a universal percentage. Courts assess statutory responsibility, needs, means, circumstances and proof under the applicable regime.

Who pays child maintenance under the Personal Status Law?

The law places responsibility for a young child without property primarily on the father within its terms and addresses when a solvent mother may be responsible.

Does child support automatically end at 18?

Not necessarily under every provision. The law addresses girls, boys and an adult son unable to earn. Obtain advice before stopping payment.

Travel Bans on Children

What is a child travel ban in the UAE?

It is a legal restriction intended to prevent a child’s departure. Its source, wording, duration and conditions must be confirmed from the court or competent authority.

For the detail behind this, see Child Travel Bans in the UAE: Legal Guide.

Is refusing to hand over a passport the same as a travel ban?

No. Passport possession, consent to travel and an official departure restriction are separate matters, although they may arise in the same case.

Can a custodial parent travel without the other parent’s consent?

Under the current Personal Status Law, foreign travel by a custodial parent requires written approval of the other parent or guardian, or court authorisation under the statutory conditions.

Can a UAE court authorise 60 days of travel?

The law allows court-authorised travel for a period or periods totalling no more than 60 days in a year, subject to the provision and the child’s circumstances. Approval is not automatic.

Full detail: Travel Bans on Children.

Parenting Plans

What is a parenting plan in the UAE?

It is a written arrangement dealing with a child’s residence, time with each parent, holidays, handovers, decisions, travel, communication and practical care after separation.

Parenting Plan UAE covers this in full.

Is a signed parenting plan automatically enforceable?

Not always. Its effect depends on the legal route, wording and whether it has been approved or incorporated into an executable settlement or court order.

Does a parenting plan create joint custody?

No. Joint custody arises under the applicable law or order. The plan explains how the rights and duties recognised by that route will operate.

Must shared parenting mean exactly equal nights?

No universal percentage applies to every child. Under civil joint custody, time may be shared through different patterns, and the court selects arrangements serving the child’s interest.

Passports, Travel Consent and Child Travel Bans

Can one parent travel abroad with a child from the UAE after divorce?

Travel requires the authority prescribed by the applicable family-law route, usually written consent or court permission. Existing custody and travel-ban orders must also be checked.

The complete treatment is on Child Travel Consent and Passports UAE.

Is a WhatsApp message valid travel consent?

It may be evidence, but ambiguity about sender, child, destination or dates can create a dispute. A clear signed consent meeting court and destination requirements is safer.

Can the court permit up to 60 days of travel?

Under the federal Personal Status Law, the court may authorise one or more periods totalling up to 60 days per year under the statutory conditions and may exceed that period in specified circumstances. Permission is discretionary.

Who keeps the child’s passport under UAE Personal Status Law?

The law permits the guardian to retain it subject to the travel provisions and requires handover for authorised travel, with power for the court to order a different custody arrangement where justified.

Full detail: Passports, Travel Consent and Child Travel Bans.

Visitation & Access Rights

What are visitation rights in the UAE?

They concern a child spending time or communicating with a parent or other person entitled under the applicable law and order. Civil cases may frame this as joint physical custody.

More detail, and the sources behind it, on Visitation and Access Rights in the UAE.

Does the non-custodial parent have a right to see the child?

The Personal Status Law provides for visitation of a child in custody, subject to statutory rules and the child’s interests. Review the exact judgment.

Can visitation include taking the child away from the handover place?

It may, depending on the law and order. The terms should specify location, duration, travel area and return.

Are overnight visits automatic?

No. Overnights depend on the legal route, child’s needs, prior care, accommodation, schedule and any proven risk.

Full detail: Visitation & Access Rights.

Paternity & Parentage

How is paternity established in the UAE?

The route may involve marriage, lawful acknowledgment, evidence and a court determination under the applicable Personal Status or civil regime.

The full explanation is on Paternity and Parentage Cases in the UAE.

Is a private DNA test legally conclusive?

Not necessarily. The court may require an authorised test with verified identities, chain of custody and admissible reporting.

Can the court order DNA testing?

Scientific testing may be ordered or considered under the governing parentage rules. The court controls necessity, procedure and legal effect.

Can a husband deny paternity?

The Personal Status Law provides a specific, restricted procedure and conditions. Obtain immediate advice because timing and prior acknowledgment may matter.
