A family with connections to more than one country faces a different first question from everyone else. Not “what is the law?” but “whose law, which court, and will the result be worth anything where the other party or the assets actually are?”
These answers deal with jurisdiction, applicable law, proof of foreign documents, recognition and enforcement, and the position when a child is taken across a border. Treaty questions are the most commonly mishandled of all, and are addressed directly below.
One warning before the answers. The UAE runs more than one family-law framework, and they must not be read as a single system: Muslim personal status; the federal civil personal-status regime for those within its scope; the Abu Dhabi civil-family route, which is a local framework with its own eligibility and procedure; onshore court procedure, which is separate again from the substantive law; and cross-border recognition and enforcement, which depends on both countries involved. A rule from one does not carry across to another.
International Family Law
Can I file for divorce in Dubai if I married abroad?
Possibly. UAE jurisdiction, valid proof of marriage, residence, nationality, religion and existing foreign cases must be assessed.
The full explanation is on International Family Lawyer Dubai.
Does my nationality decide which family law applies?
Not by itself. Religion, residence, domicile, court, issue, choice-of-law rules and mandatory UAE provisions can all matter.
Can non-Muslim expatriates use UAE civil divorce?
Qualifying non-Muslim residents may fall within Federal Decree-Law No. 41 of 2022, subject to its scope and any properly raised foreign-law position.
Is Abu Dhabi’s Civil Family Court available to everyone in the UAE?
No. Its statutory eligibility and jurisdictional connections must be established.
Will the UAE recognise my foreign divorce?
It may, subject to the recognition route, finality, jurisdiction, notice, public policy and absence of conflicting UAE orders.
Will a foreign custody order operate automatically in Dubai?
Do not assume so. Recognition or a fresh UAE order may be required, especially where the child is in the UAE.
Can I take my child abroad while a dispute is pending?
Check custody, guardianship, consent, passport and travel-ban rules before departure. Unilateral travel can create serious consequences.

Which Law Applies to Me? (Signature)
Does my passport decide which UAE family law applies?
No. Nationality is one factor alongside religion, residence, domicile, court, issue, agreements and conflict-of-laws rules.
This is set out at length on Which Family Law Applies in the UAE?.
Does marrying abroad prevent a UAE divorce?
Not necessarily. UAE jurisdiction and proof of a legally valid marriage must be assessed.
Which law applies to Muslim spouses in the UAE?
The 2024 federal Personal Status Law is the current core statute within its scope, with foreign-party and conflict issues assessed separately.
What is the federal non-Muslim civil regime?
Federal Decree-Law No. 41 of 2022 provides civil rules for qualifying non-Muslim citizens and residents.
Can a non-Muslim expatriate ask for home-country law?
Article 1 preserves that possibility in specified matters, but the law, proof, UAE conflict rules and court decision control.
Is Abu Dhabi Civil Family Court the same as Dubai Courts?
No. Abu Dhabi has a distinct local civil-family framework and eligibility requirements.
Can I choose Abu Dhabi because its rules seem preferable?
Preference alone is insufficient. Statutory jurisdiction and eligibility connections must exist.

Enforcing Foreign Judgments in UAE
Can a foreign court judgment be enforced automatically in the UAE?
No. A competent UAE court ordinarily must recognise or order enforcement under the Civil Procedure Code, an applicable treaty or another valid route.
For the detail behind this, see Enforcing Foreign Judgments in the UAE.
What conditions apply to enforcing a foreign judgment?
The court examines jurisdiction, valid notice and representation, finality, conflict with UAE judgments and UAE public order, among other statutory requirements.
Can the UAE recognise my overseas divorce?
Potentially. The court will review the issuing court’s jurisdiction, service, finality, relevant personal-status regime and public-policy considerations.
Does recognition of divorce enforce custody and maintenance too?
Not necessarily. Marital status, child arrangements, maintenance and property provisions may require separate analysis or applications.
Can a foreign custody order be used in Dubai?
It may be relevant, but the child’s location, welfare, guardianship position, notice, later orders and the precise local relief must be reviewed.
Will the UAE enforce a foreign child-maintenance order?
It may if the applicable legal requirements are met. Provide finality evidence, an arrears calculation, payment history and details of UAE income or assets.
Is a default judgment enforceable?
Possibly, but official proof of valid service and a fair opportunity to participate is especially important.
Full detail: Enforcing Foreign Judgments in UAE.
Enforcing UAE Orders Abroad
Is a UAE court order automatically enforceable abroad?
No. The destination country applies its recognition law, treaties and procedure to the particular UAE judgment and remedy.
Enforcing UAE Court Orders Abroad covers this in full.
What documents do I need first?
Start with the complete certified judgment, appeal decisions, finality certificate, service proof, identity records and details of the destination-country result.
Can I register a UAE divorce in another country?
Possibly. The foreign civil-status or court process may examine jurisdiction, finality, notice, authenticity and local public policy.
Does recognition of my UAE divorce enforce maintenance too?
Not necessarily. Divorce status and payment enforcement can use different foreign procedures.
Can a UAE custody order control a child living abroad?
It may be recognised, mirrored or considered as evidence, but the foreign court may apply its own child-welfare and jurisdiction rules.
Does a UAE travel ban work at foreign airports?
Do not assume so. UAE travel controls do not automatically appear in another country’s border systems.
Can UAE maintenance arrears be collected from overseas salary?
Potentially, through a treaty, reciprocal mechanism or domestic recognition route where the payer or income is located.

Recognition of Foreign Marriages and Divorces
Is a foreign marriage automatically valid in the UAE?
Not automatically for every purpose. The place and date of marriage, substantive and formal validity, parties’ status, applicable special law, documents and UAE public-order rules must be reviewed.
The complete treatment is on Recognition of Foreign Marriage and Divorce in UAE.
Does MOFA attestation prove that I am legally divorced?
No. Attestation verifies signatures and seals. Finality, jurisdiction, service and the required UAE status or recognition process remain separate.
Can I use an overseas divorce certificate without the judgment?
Sometimes a certificate is sufficient for a limited administrative purpose, but a court may require the complete judgment, reasons, service proof and finality evidence.
What is the UAE Civil Procedure Law?
It provides the principal onshore framework for executing foreign judgments and orders, subject to its conditions and any applicable treaty.
Will the UAE court re-decide my foreign divorce case?
An execution application normally focuses on recognition gateways rather than re-trying the merits, but separate UAE family issues may still require substantive determination.
Can an ex parte foreign divorce be recognised?
It may be possible, but lawful notice and opportunity to participate are central. Provide the complete service record, foreign findings and finality evidence.
Is a religious divorce issued abroad recognised in Dubai?
It depends on the issuing authority’s power, governing foreign law, registration, finality and the UAE route. A foreign-law explanation may be required.

International Child Abduction: UAE Options
Is the UAE a party to the 1980 Hague Child Abduction Convention?
The official HCCH status table reviewed on 1 September 2026 does not list the UAE among Contracting Parties. Verify the table again when action is required and assess any separate treaty or domestic route.
More detail, and the sources behind it, on International Child Abduction UAE.
Can I use the Hague Convention if my child was taken from the UAE?
Do not assume so. The Convention must be in force for the relevant country relationship, and the UAE is not listed as a Contracting Party on the reviewed table. Foreign domestic remedies may still be available.
What if my child was brought to Dubai under a foreign custody order?
Obtain the complete order, proof of notice and enforceability, certified translation and urgent UAE advice. A foreign order may be important but is not automatically executable merely because it exists.
Can a UAE judge order a child not to leave the country?
A competent court may grant proportionate travel or passport measures where the legal threshold and evidence are met. Filing a request is not the same as an implemented restriction.
Is keeping a child after a holiday wrongful retention?
It can be, depending on the consent, return date, custody rights, governing law and facts. Preserve the original consent, itinerary and communications.
Can the police return the child to me immediately?
Police respond to emergencies and suspected offences within their powers. They do not replace the family court or automatically resolve competing international custody claims.
Will an embassy collect or return my child?
Generally no. Consular officials may offer assistance within their powers, but they cannot decide custody or override UAE or foreign court orders.

Choice of Law for Expatriate Families
Do expatriates automatically use their national law in a UAE divorce?
No. UAE jurisdiction, the applicable personal-status route, the current conflicts rules, any properly invoked law, proof, public order and issue type must all be assessed.
The full explanation is on Choice of Law for Expatriate Families in UAE.
Does living in Dubai make UAE law apply to everything?
No. Residence may support jurisdiction, while foreign law can potentially govern a substantive issue. UAE procedure and UAE immovable property have separate rules.
Did the UAE conflict-of-law rules change in 2026?
Yes. Federal Decree-Law No. 25 of 2025 took effect on 1 June 2026 and repealed the 1985 Civil Transactions Law. Transitional analysis remains important.
Which law governs marriage validity under the current general rule?
Article 12 points substantive validity to the law of the country where the marriage was concluded, subject to UAE-national, special-law, treaty, public-order and transition issues.
Which law governs divorce under the current general rule?
Article 13 points to the law of the country of marriage for divorce, judicial divorce and separation, subject to the statutory exceptions and special frameworks.
What if one spouse is a UAE national?
Article 14 can require UAE law for the Article 12 and 13 matters, apart from marriage capacity. Nationality dates and retention must be proved.
Can a non-UAE citizen ask for their own law?
Article 1 of the 2024 Personal Status Law allows a statutory request in defined terms, but permission, timing, proof, special law and public order require legal assessment.

International Child Abduction
What is international child abduction?
It commonly describes an unauthorised cross-border removal or retention of a child. The legal test and remedy depend on parental rights, residence, orders, countries and treaties.
This is set out at length on International Child Abduction and the UAE.
Is keeping a child after an agreed holiday a possible retention case?
Yes. A trip may begin lawfully and become disputed when the child is not returned on the agreed date. Preserve the consent and return evidence.
Does the Hague Child Abduction Convention apply to the UAE?
The UAE was not listed in the HCCH status table checked on 30 August 2026; that table displayed a 14 November 2022 update date. Verify the official current status for both countries when the case starts.
Can I still seek return if the Hague Convention does not apply?
Potentially. UAE and destination-country domestic remedies, recognition proceedings, protective orders or negotiated return may be available.
Is a foreign custody order automatically effective in the UAE?
Not necessarily. Recognition or enforcement may require an application under UAE procedure and satisfaction of statutory or treaty conditions.
What should I do if departure is imminent?
Obtain urgent advice, preserve the confirmed itinerary and orders, and seek the appropriate protective relief from the competent authority. Filing does not itself confirm activation.
Can an embassy recover my child?
An embassy may provide consular information within its role, but it is not a family court and generally cannot replace judicial return or custody proceedings.

A note on cross-border answers
Every answer on this page has a second half that this page cannot supply: what the other country does. Recognition, enforcement and the effect of an order abroad are questions for the law of the place where they arise, and an answer that is correct about the UAE position tells you only half of what you need.
Treat these as the UAE half, and pair each with advice in the other jurisdiction before relying on it.
