Money questions after a separation are rarely abstract. They are usually about rent due this month, school fees next term, or an order that is not being paid. These answers deal with the questions that come up first, and each group links to the guide that sets out the evidence and procedure.
No page can calculate what a court will award from an income figure. What it can do is explain which factors are relevant, what evidence tends to matter and what can be sought while a case is running.
One warning before the answers. The UAE runs more than one family-law framework, and they must not be read as a single system: Muslim personal status; the federal civil personal-status regime for those within its scope; the Abu Dhabi civil-family route, which is a local framework with its own eligibility and procedure; onshore court procedure, which is separate again from the substantive law; and cross-border recognition and enforcement, which depends on both countries involved. A rule from one does not carry across to another.

What does maintenance include under UAE family law?
Under the Federal Personal Status Law, maintenance covers necessities and basic needs such as food, clothing, housing, medical treatment and education in accordance with custom. The exact recoverable components depend on who claims, the applicable regime and evidence. Civil post-divorce alimony is assessed under different provisions and should not be treated as the same claim.

Is a wife entitled to maintenance during marriage?
Federal Decree-Law No. 41 of 2024 provides for a husband’s maintenance of his wife within a valid marriage, subject to statutory conditions. The wife’s income does not alone dispose of the issue. The amount and period require evidence of circumstances, need, customary standard, capacity and payments already made.
Does spousal maintenance continue indefinitely after Muslim divorce?
No. The Personal Status Law has specific rules for waiting-period maintenance, housing and compensation in defined circumstances. The type and date of divorce, pregnancy and other legal conditions matter. These rights should be distinguished from unpaid maintenance during marriage, dowry, child maintenance and civil-law post-divorce alimony.
Can a non-Muslim divorcee seek alimony?
An eligible divorced woman under Federal Decree-Law No. 41 of 2022 may apply for alimony after the divorce judgment. The marriage contract, Executive Regulations and statutory assessment factors matter. Abu Dhabi has a separate civil-family financial-order route. Eligibility and jurisdiction should be confirmed before filing.
How is civil post-divorce alimony calculated?
There is no fixed public percentage. The federal civil law identifies factors including marriage duration, age, financial position, conduct, harm, financial damage and custody-related circumstances. An accounting expert may assess the parties’ economic positions. The contract can also affect the claim.
Who pays child maintenance?
Under the Federal Personal Status Law, the father bears maintenance of a young child without sufficient property, subject to the statutory rules. Other provisions address the child’s resources, adult children and the mother’s position if the father is absent or unable to pay. Civil joint-custody cases require analysis under their separate regime.
Are school fees separate from monthly child support?
They may be ordered or agreed separately. The budget should show school tuition, transport, books and activities with fee schedules and invoices. If school costs are paid directly, do not count the same sums again inside a general monthly figure. The order should say when, to whom and in what proportion payment is made.
Can I obtain temporary maintenance before final judgment?
Temporary relief may be available under the applicable regime. Provide a focused budget, income evidence, current payments, housing and child needs, and why the matter cannot wait. The court decides whether and what to order. An interim order is enforceable according to its terms unless varied or stayed.
Can past maintenance be claimed?
The available past period is limited by the governing law and support category. Federal Decree-Law No. 41 of 2024 contains different limits for wife’s and child maintenance claims. Prepare an instalment-by-instalment schedule with payments credited. Prompt advice is important because delay may affect recoverability.

Child Maintenance
What does child maintenance cover in the UAE?
Under the Personal Status Law, maintenance includes basic needs such as food, clothing, housing, medical treatment and education, as applicable. The order depends on evidence and law.

Is there a fixed UAE child-support calculator?
Do not rely on a universal percentage. Courts assess statutory responsibility, needs, means, circumstances and proof under the applicable regime.
Who pays child maintenance under the Personal Status Law?
The law places responsibility for a young child without property primarily on the father within its terms and addresses when a solvent mother may be responsible.
Does child support automatically end at 18?
Not necessarily under every provision. The law addresses girls, boys and an adult son unable to earn. Obtain advice before stopping payment.
Can school fees be ordered separately?
They may form part of the child’s education needs. Provide the school contract, invoices, established curriculum and proof of mandatory costs.
Can health insurance and medical bills be claimed?
Potentially, subject to necessity, coverage, documents and the applicable order. Distinguish premiums, co-payments and exceptional treatment.
Is custody housing part of child maintenance?
The Personal Status Law contains a rent provision for the custodian’s residence with statutory exceptions. It is distinct from property ownership and spousal claims.
Can temporary maintenance be requested?
Potentially. The available interim route depends on the court and regime. Provide immediate needs, current payments and supporting documents.
How far back can child maintenance be claimed?
Under the current Personal Status Law, a claim from the father is not heard for more than one year before the judicial claim. Other regimes and accrued judgment debts require separate analysis.

Maintenance Arrears and Enforcement
What counts as maintenance arrears?
An arrear is an amount already due under an enforceable maintenance obligation that remains unpaid after crediting valid payments and adjustments.
Can I enforce a private WhatsApp promise to pay maintenance?
Messages may be evidence, but they are not automatically an execution writ. The agreement may first require a substantive claim, approval or other legal step.
How should arrears be calculated?
Use a due-date ledger showing the ordered amount, category, payment received, payment reference, credit and running balance, with each line linked to evidence.
Can I include unpaid school or medical bills?
Only if the operative order or enforceable settlement covers them and any conditions, such as invoices or approval, are met. Do not add unawarded expenses to execution.
What if the payer says cash was given?
The court may examine receipts, messages, witnesses, payment pattern and other evidence. Record the disputed credit openly rather than ignoring or accepting it without proof.
Does an appeal stop maintenance enforcement?
Do not assume so. The effect of appeal and any stay depends on the instrument, law and court order. Continue to follow the executable terms unless the competent authority changes them.
Can the execution judge increase monthly maintenance?
Execution ordinarily implements the current order. An increase generally requires the proper substantive variation claim supported by changed circumstances and evidence.
Can salary be deducted for unpaid maintenance?
A salary-related enforcement request may be available subject to statutory limits and the execution judge’s decision. Accurate employer information and an executable balance are important.
Can bank accounts or property be attached?
The execution court may consider legally available asset measures based on the instrument, balance, ownership, evidence and applicable protections. No particular measure is automatic.

Financial Settlements
Are assets automatically divided 50/50 after divorce in the UAE?
No universal rule automatically divides every asset equally in every UAE divorce. The court must identify the applicable legal regime, ownership, agreements, contributions and the nature of each claim. Abu Dhabi civil-family financial orders and federal civil claims must also be kept distinct from Muslim personal-status rights. Obtain advice before assuming that a foreign community-property concept applies to UAE assets.

Does the name on the title deed decide everything?
Registered title is important, but it may not answer every contribution, contract or beneficial assertion. The evidence may include purchase funding, mortgage payments, written promises and the purpose of transfers. The available remedy depends on applicable law and procedure. Do not attempt a transfer or restriction without advice and the required registry or lender process.
Can I claim money paid towards a property in my spouse’s name?
A claim may be possible depending on the legal route, agreement, purpose of payment and proof. Federal Personal Status Law recognises separate financial identity and addresses participation in developing property or building a home. Prepare bank records, invoices, messages, title and loan documents. The court will not necessarily treat ordinary household spending as acquisition of an ownership share.
Is maintenance part of the property settlement?
It should be analysed separately. Wife’s maintenance, civil post-divorce alimony, child maintenance, housing, arrears and property ownership have different legal bases. A settlement may resolve several categories, but it should allocate amounts clearly so that duration, variation, tax or enforcement issues are not obscured.
How are business interests handled?
Review the shares, company records, valuation, income and any contribution claim. Company property usually belongs to the company, not directly to a shareholder. A settlement might transfer shares, arrange a buyout or use other assets, but corporate approvals, restrictions and creditor rights must be respected.
Can my spouse hide money in a company?
Do not assume concealment merely because funds move through a business. Identify the specific company, account, transaction or missing disclosure and explain its relevance. Lawful disclosure, accounting records and an expert process may be needed. Unauthorised access to business systems can create separate legal and evidential problems.
What happens to a joint mortgage?
The lender’s contract continues unless the lender releases or replaces a borrower. A divorce agreement between spouses does not itself remove liability to the bank. Address refinancing, transfer, payment proof, default and sale arrangements. Obtain the lender and registry requirements before making the settlement conditional on a transfer that may not be approved.
Can we agree a settlement privately?
Spouses can negotiate, but enforceability and implementation depend on the terms, applicable law and asset. Some terms may need court approval, notarisation, company action, lender consent or registration. Child-related terms remain subject to applicable protections. Have the final document reviewed before signing or withdrawing proceedings.
Will a prenuptial agreement be followed?
Its effect depends on the legal regime, drafting, consent, scope, public order and the specific claim. Federal civil law expressly permits contractual terms concerning rights during marriage and after divorce. Abu Dhabi publishes a prenuptial template. Do not assume a foreign agreement is automatically effective without a UAE and cross-border review.

Nafaqah (Maintenance)
What does nafaqah mean?
Nafaqah means maintenance or support. Under UAE personal-status law it can concern a wife, children, a woman in iddah, parents or relatives, subject to different statutory conditions.

What expenses can maintenance include?
Article 95 includes essentials such as food, clothing, housing, medical treatment and education according to custom, together with other necessary items recognised by law and circumstances.
How does the court calculate maintenance?
Article 96 directs attention to the payer’s means, the recipient’s condition and the economic situation at the relevant time and place. The court evaluates evidence rather than applying one universal percentage.
Is a husband required to maintain a financially independent wife?
Article 99 states that the husband shall maintain the wife even if she is solvent, subject to a valid marriage and the article’s other entitlement provisions and defences.
Can a wife claim historical maintenance?
The law states that a wife’s maintenance claim is not heard for more than two years before filing. She must still prove entitlement, non-payment and amount for the claimed period.
Can a child claim historical maintenance?
The law provides a separate maximum look-back of one year for a child-maintenance claim against the father. Proof of needs, liability and payments remains necessary.
Can temporary maintenance be requested during a case?
Yes. Article 100 permits temporary maintenance for the wife and children on the wife’s request while the maintenance case is being heard, subject to the court’s assessment.
Is iddah maintenance the same as permanent alimony?
No. It is support connected with a legally defined waiting period and depends on the divorce type and facts. Other civil-family regimes use different post-divorce concepts.
Who normally pays child maintenance?
Article 106 places maintenance of a young child without property on the father, subject to the detailed statutory rules on duration, ability and exceptional circumstances.
