Nafaqah means maintenance or financial support. In UAE Muslim personal-status law, the term can concern a wife, a woman in a legally defined waiting period, children, parents or relatives, depending on the statutory conditions. It is not one undivided payment and should not be confused with mahr, matrimonial compensation, property ownership or a voluntary gift.
Federal Decree-Law No. 41 of 2024 is the current federal Personal Status Law. Article 95 defines the components of maintenance, and Article 96 directs the court to consider the payer’s means, the recipient’s condition and the economic circumstances of the relevant time and place. Later provisions address spouse maintenance, temporary maintenance, waiting-period support, child maintenance and other family support duties.
Mr AlBalooshi assists with maintenance claims, responses, interim applications, budgets, arrears, variation, enforcement and cross-border issues. Use the inquiry form with the marriage or birth records, case numbers, existing orders, income evidence, child expenses, payment history, current addresses and any urgent need. You may also WhatsApp +971 50 627 5196.
Submitting an inquiry does not file a claim, secure an interim order, stop a deadline or create a lawyer-client relationship. Identity, conflicts, court competence, scope, fees and formal engagement must first be confirmed.
Nafaqah is an umbrella term with separate legal categories
The first question is not simply “How much maintenance?” It is “Whose maintenance, for what period and under which legal regime?” Common categories include:
- wife’s maintenance during a valid marriage;
- temporary maintenance while a case is pending;
- maintenance and housing during iddah in the circumstances defined by law;
- child maintenance;
- custodian’s wage where the statutory conditions apply;
- parents’ maintenance; and
- relatives’ maintenance.
Each category has different entitlement facts, duration and evidence. A claim should identify the category and components requested instead of presenting one unexplained total.
Maintenance can include more than food
Article 95 of the Personal Status Law defines maintenance broadly. The statutory concept includes essentials such as food, clothing, housing, medical treatment and education according to custom, together with matters treated as necessary under the law and circumstances.
A practical schedule may separate:
| Component | Examples of evidence |
|---|---|
| Food and daily living | Household budget, supermarket and recurring expense records |
| Clothing | Age-appropriate and reasonable periodic expenditure |
| Housing | Tenancy, mortgage occupancy facts, utilities, family size and location |
| Healthcare | Insurance, uncovered treatment, medicine and therapy invoices |
| Education | Fees, transport, books, uniforms, devices and supported activities |
| Childcare | Nursery, nanny or other care where legally and factually justified |
| Residence and administration | Visa, Emirates ID or related recurring charges where relevant |
Not every claimed lifestyle expense will be treated as legally necessary. Equally, reducing the claim to food alone understates the statutory concept. The budget must be reasonable, documented and tied to the correct recipient.
The court balances needs, means and economic conditions
Article 96 states that assessment considers the payer’s financial wellbeing, the condition of the person supported and the economic situation at the relevant time and place. Maintenance may be provided in cash, and the law also recognises provision in kind or by making property or a benefit available in appropriate circumstances.
The analysis commonly requires:
- reliable current income, not only a self-selected basic salary figure;
- allowances, bonuses, commissions, investment and business income;
- necessary liabilities and existing support duties;
- the recipient’s actual needs and circumstances;
- the family’s prior arrangements where legally relevant;
- children’s ages, health, education and care requirements;
- direct payments already made; and
- current prices and housing conditions.
The purpose is a lawful, evidence-based assessment. A high gross income does not make every claimed cost reasonable, and an unemployed status does not prove an inability to pay if other income or assets exist.
Wife’s maintenance during marriage has its own statutory basis
Article 99 provides that a husband shall maintain his wife, even if she is financially solvent, in accordance with a valid marriage contract. The article also addresses when entitlement may be affected and states that the wife’s right is not extinguished except by payment or discharge.
The law places a time boundary on retrospective spouse-maintenance litigation: a claim for the wife’s maintenance is not heard for a period exceeding two years before the filing date. That does not mean every claimant automatically receives two years of arrears. She must prove entitlement, the unpaid period and amount; the respondent may prove payment, discharge or another legal defence.
Create a month-by-month schedule showing the amount alleged due, direct payments, housing or benefits provided in kind, and the balance claimed. This is more reliable than multiplying a current monthly request across a historical period without checking what actually occurred.
Temporary maintenance can address needs while the case is pending
Article 100 permits the court, during a maintenance case and upon the wife’s request, to decide temporary maintenance for her and her children. Interim relief is intended to address the period before final determination; it is not a guaranteed preview of the final award.
A focused interim application should provide:
- the legal relationship and pending case;
- immediate needs for the wife and each child;
- current income and payment evidence;
- essential housing, school and medical commitments;
- the amount requested and calculation; and
- the consequences of delay.
Do not inflate the interim budget with disputed capital purchases or unrelated debt. An urgent judge needs a clear explanation of what cannot reasonably wait.
Iddah support is not indefinite former-spouse alimony
Article 101 addresses maintenance and housing for a woman in the waiting period. Entitlement depends on the type of divorce and circumstances defined by the law, including pregnancy where relevant. Iddah is a distinct legal period; it should not be used as a general label for all post-divorce support.
The file should establish the divorce date and form, whether the divorce is revocable or irrevocable, pregnancy if relevant, the applicable waiting period, housing facts and payments made. See Iddah for the specific concept once that page is available in the site sequence.
Federal civil and Abu Dhabi civil-family statutes have separate post-divorce alimony frameworks. Their support should not be described as iddah maintenance unless the applicable Muslim personal-status rules actually govern.
Child maintenance is a right focused on the child
Article 106 provides that a young child without sufficient property is maintained by the father, subject to the detailed statutory rules on duration and capacity. The law addresses sons and daughters, adult children unable to earn because of disability or another recognised reason, education and circumstances where another person may temporarily carry the burden.
A child-maintenance claim should be built child by child. For each child, record:
- age, school year and living arrangement;
- school or nursery fees and payment dates;
- transport, uniform, books and device costs;
- health insurance and uncovered care;
- housing share and utilities;
- food, clothing and ordinary daily needs;
- therapy, disability or special educational needs;
- childcare and supervision needs; and
- payments made directly by either parent.
The law places a separate retrospective boundary on a claim for child maintenance from the father: the claim is not heard for a period exceeding one year before filing. As with spouse maintenance, that is a maximum look-back rule, not an automatic award.
Read Child Maintenance for a fuller child-support preparation guide.
Custody time and financial responsibility are related but not identical
A parent should not stop paying a court-ordered amount because contact was missed, nor deny contact solely because support is unpaid. Custody, visitation and maintenance have distinct legal bases and enforcement mechanisms.
The Personal Status Law also addresses a custodian’s wage. Entitlement depends on statutory conditions, including whether the custodian remains the wife of the child’s father or is in a waiting period during which maintenance is due. A claim for a custodian’s wage should therefore be pleaded separately from reimbursement of the child’s actual expenses.
Use Custody vs Guardianship to understand decision-making roles and Visitation Rights for contact issues.
Maintenance may be increased or decreased when circumstances change
Article 97 addresses increasing and decreasing maintenance. A variation is not justified merely because a party dislikes the existing figure. The applicant should prove a legally material change, such as:
- a sustained change in income or employment;
- a child entering a different school stage;
- a new documented medical or special-care requirement;
- a significant housing change;
- the end of an expense included in the existing order;
- inflation or another relevant economic change; or
- discovery that the earlier decision relied on materially incomplete financial information.
Prepare a comparison table showing the circumstances and amounts at the date of the existing order and now. Separate temporary volatility from an enduring change. A respondent alleging inability to pay should provide full evidence of income, job loss efforts, assets and necessary liabilities.
Payment evidence should identify the obligation satisfied
Maintenance disputes often arise because transfers are undocumented or ambiguous. A bank payment described only as “family” may be disputed as a gift, loan, mahr, property contribution or support.
For each payment, preserve:
- date and amount;
- sender and recipient accounts;
- transfer description;
- month and maintenance component covered;
- whether it was under an order or voluntary arrangement;
- any direct payment to a school, landlord or insurer; and
- any acknowledgment or contemporaneous message.
Avoid cash where a traceable lawful method is available. If cash is necessary, obtain a clear receipt stating the amount, date, period and purpose. Do not sign a receipt for a larger amount or broader release than was actually received.
Arrears require an order-by-order calculation
A maintenance-arrears schedule should start with the operative order or agreement, not a remembered figure. Record each due date, ordered component, adjustment, payment, credit and remaining balance. If several orders exist, identify when each replaced or modified the earlier one.
Common errors include:
- claiming the same school fee as monthly cash and direct reimbursement;
- ignoring a later variation order;
- applying an annual increase that the order did not provide;
- converting foreign-currency payments inconsistently;
- treating voluntary gifts as ordered support without evidence; and
- failing to credit a payment made directly to a service provider.
See Maintenance Arrears and Family Judgment Enforcement for the next procedural steps.
Enforcement should be lawful and proportionate
Once an enforceable order exists, the creditor may use the competent court’s enforcement procedures. Available measures depend on the order, assets, service, current law and enforcement judge’s directions. A debtor who cannot comply should not simply ignore the order; a variation request does not necessarily suspend existing obligations.
An enforcement file may require:
- the enforceable judgment or authenticated settlement;
- proof of service and finality where required;
- a certified arrears calculation;
- debtor identity, address and employer information;
- known bank, salary, company or property details; and
- evidence of partial payments and prior enforcement steps.
Do not threaten criminal consequences or travel restrictions as a marketing claim. The court determines the lawful measure on the evidence and applicable procedure.
Federal and Abu Dhabi civil-family maintenance are separate regimes
The same English word—maintenance or alimony—appears in different UAE frameworks:
| Regime | Primary source | Key distinction |
|---|---|---|
| Muslim personal status | Federal Decree-Law No. 41 of 2024 | Includes spouse, iddah, child and other nafaqah categories |
| Federal civil personal status | Federal Decree-Law No. 41 of 2022 and Cabinet Resolution No. 122 of 2023 | Separate post-divorce alimony and child-finance framework for persons within its scope |
| Abu Dhabi civil-family law | Abu Dhabi Law No. 14 of 2021 and Decision No. 8 of 2022 | Local post-divorce financial orders, provisional alimony, housing and child expenses |
Do not import a two-year spouse-maintenance look-back from the Personal Status Law into an Abu Dhabi civil claim without legal basis. Do not describe Abu Dhabi lump-sum compensation as mahr. The marriage, parties and jurisdiction determine the route.
Cross-border maintenance needs recognition and collection planning
A UAE court may have jurisdiction while the payer, child or assets are abroad. A foreign maintenance order may also need recognition or enforcement in the UAE. The analysis can involve treaties, reciprocity, finality, jurisdiction of the issuing court, service, public order, currency and proof of arrears.
Collect the complete judgment, reasons if issued separately, service proof, finality certificate, payment ledger and certified translation. Check the UAE Ministry of Justice international agreements directory for official treaty materials and obtain destination-country advice. Do not assume that an attested order is automatically enforceable.
Read Recognition of Foreign Judgments and Enforcing UAE Orders Abroad for cross-border planning.
Maintenance examples that separate the calculations
Example 1 — spouse arrears: A wife claims 18 months of unpaid maintenance during marriage. She prepares a monthly needs schedule and bank records. The husband produces rent and household payments. The court must determine entitlement and credit proved payments; the two-year rule does not decide the amount by itself.
Example 2 — school fees: An order requires the father to pay tuition directly and a separate monthly child amount. The arrears schedule should show tuition against invoices and monthly support against its own due dates, without combining them twice.
Example 3 — income reduction: A payer seeks a reduction after losing employment. A termination letter alone may be insufficient; the court may need bank records, end-of-service benefits, assets, new employment efforts and proof that the change is genuine and continuing.
Example 4 — foreign order: A parent brings an overseas maintenance order to the UAE. The case requires recognition and enforcement analysis before collection measures are requested.
Prepare a maintenance case file
A nafaqah file is easier to advise on when needs, means and payments are recorded separately. Gather:
- marriage, divorce and birth records;
- the existing order or agreement;
- a one-page chronology;
- separate budgets for the spouse and each child;
- salary, bank, business and asset evidence;
- invoices for housing, school, medical care and childcare;
- a complete payment ledger;
- evidence of any material change;
- current addresses and employer information; and
- every UAE or foreign proceeding and enforcement step.

Frequently asked questions
What does nafaqah mean?
Nafaqah means maintenance or support. Under UAE personal-status law it can concern a wife, children, a woman in iddah, parents or relatives, subject to different statutory conditions.
What expenses can maintenance include?
Article 95 includes essentials such as food, clothing, housing, medical treatment and education according to custom, together with other necessary items recognised by law and circumstances.
How does the court calculate maintenance?
Article 96 directs attention to the payer’s means, the recipient’s condition and the economic situation at the relevant time and place. The court evaluates evidence rather than applying one universal percentage.
Is a husband required to maintain a financially independent wife?
Article 99 states that the husband shall maintain the wife even if she is solvent, subject to a valid marriage and the article’s other entitlement provisions and defences.
Can a wife claim historical maintenance?
The law states that a wife’s maintenance claim is not heard for more than two years before filing. She must still prove entitlement, non-payment and amount for the claimed period.
Can a child claim historical maintenance?
The law provides a separate maximum look-back of one year for a child-maintenance claim against the father. Proof of needs, liability and payments remains necessary.
Can temporary maintenance be requested during a case?
Yes. Article 100 permits temporary maintenance for the wife and children on the wife’s request while the maintenance case is being heard, subject to the court’s assessment.
Is iddah maintenance the same as permanent alimony?
No. It is support connected with a legally defined waiting period and depends on the divorce type and facts. Other civil-family regimes use different post-divorce concepts.
Who normally pays child maintenance?
Article 106 places maintenance of a young child without property on the father, subject to the detailed statutory rules on duration, ability and exceptional circumstances.
Does equal custody eliminate child maintenance?
Not automatically. Custody time and financial support are separate questions. The court considers the child’s needs, each obligation and payments under the applicable regime.
Can maintenance be increased or reduced?
Yes, where the statutory requirements are met and a material change is proved. A comparison of the circumstances at the earlier order and at the new application is important.
Do direct school or rent payments count?
They may count toward the specified obligation if proved and legally attributable to it. The order’s wording and payment purpose determine the appropriate credit.
What if maintenance was paid in cash?
Cash can be difficult to prove. Receipts, acknowledgments, messages and a consistent payment record may be relevant, but the court decides evidential weight.
Can a foreign maintenance order be enforced in the UAE?
Potentially, subject to UAE recognition and enforcement requirements, any applicable treaty, service, finality, jurisdiction, public order and accurate arrears evidence.
What should I send Mr AlBalooshi for a maintenance review?
Send the operative order, marriage or birth documents, budgets, income evidence, bank records, invoices, payment ledger, change-of-circumstances evidence and all case deadlines.
