With that said: urgent family situations have legal options, and knowing which ones exist before the pressure builds is worth a great deal. These answers cover protective and interim applications, what evidence tends to matter, and how family and criminal processes can run alongside each other.
Two practical points run through all of it. Preserve evidence lawfully — do not obtain material you are not entitled to. And think about the device you are reading this on: if someone else has access to your phone or email, use a safer route to make contact.
One warning before the answers. The UAE runs more than one family-law framework, and they must not be read as a single system: Muslim personal status; the federal civil personal-status regime for those within its scope; the Abu Dhabi civil-family route, which is a local framework with its own eligibility and procedure; onshore court procedure, which is separate again from the substantive law; and cross-border recognition and enforcement, which depends on both countries involved. A rule from one does not carry across to another.

What should I do first if I am in immediate danger in the UAE?
Call Police on 999 or Ambulance on 998 and move to a safe place if possible. Do not wait for a lawyer to return a message.

Is domestic violence limited to physical assault?
No. The 2024 federal law covers qualifying physical, psychological, sexual and economic harm arising from acts, omissions, statements, threats, neglect or exploitation within its family scope.
Can a restraining order prohibit messages and approaching my home?
The competent prosecution or court may include contact and distance restrictions and other statutory protection measures. The exact issued terms control.
Does a police report automatically give me child custody?
No. A report and a family-court custody order are different. The family court assesses the governing law, evidence and child’s interests.
Can I leave the UAE with my child for safety?
Do not assume you may travel unilaterally. Existing custody, guardianship, travel-ban and consent requirements need urgent review.
Can the court order urgent maintenance?
Interim or urgent maintenance may be available under the applicable route. Provide evidence of relationship, need, income, expenses and interrupted support.
What if my passport or Emirates ID is being withheld?
Tell the police or protection service if the withholding creates immediate danger and ask Mr AlBalooshi about the appropriate order or document-recovery process.

Domestic Violence Protection
Which law governs domestic violence in the UAE?
Federal Decree-Law No. 13 of 2024 is the current federal domestic-violence framework and replaced the 2019 decree-law.

Can psychological or economic abuse be domestic violence?
Yes, qualifying psychological and economic harm fall within the statutory definition, as do physical and sexual harm. The facts and family relationship still need assessment.
Where should physical or sexual violence be reported?
The 2024 law requires police notification where the act constitutes physical or sexual violence. Call 999 if danger is immediate.
Who can request a Public Prosecution restraining order?
The prosecution can act on its initiative or following a request by the victim or specified competent protection bodies under Article 8.
How long can a prosecution restraining order last?
The initial period may not exceed 30 days and can be extended twice for similar periods. Further extension is for the competent court under the statute.
Can an order stop online contact?
An order can prohibit contact as specified. Ensure the authority knows about messaging apps, email, third-party messages and other channels used.
Does domestic violence automatically end a marriage?
No. Protection and criminal processes do not themselves complete a divorce. A separate family-law application and the applicable regime may be required.

Emergency Interim Orders
What is an emergency family court order?
It is time-sensitive interim relief intended to protect a defined position while the main family case continues. The available order depends on jurisdiction and law.

Can I apply without an existing family case?
Some forms of urgent or petition-based relief may be available before or alongside a main claim, while others require a pending case. The route must be checked.
How quickly will a judge decide?
Timing depends on the court, application, evidence and service requirements. Abu Dhabi’s official interim-measure page describes next-working-day consideration for its service, but other routes differ.
Can an urgent order give me temporary custody?
Temporary custody or care directions may be available where the applicable law, jurisdiction and evidence support the request.
Can the court stop a child from travelling?
A competent court can consider travel restrictions under the relevant procedure. The applicant must provide accurate identity and risk evidence and complete implementation steps.
Can the court order surrender of a passport?
Passport-delivery or preservation directions may be available. The requested order should identify the document, holder, recipient, deadline and purpose.
Is interim maintenance final?
No. Interim maintenance is temporary and may be reconsidered when fuller evidence is available or circumstances change.

Coercive Control, Threats and Digital Abuse
Is coercive control a separate offence in the UAE?
The label should not replace legal analysis. Particular conduct may fall within the 2024 domestic-violence definition, the Cybercrime Law, the Crimes and Penalties Law or another provision.

Can psychological abuse be domestic violence without physical injury?
Yes. The statutory definition includes qualifying psychological harm as well as physical, sexual and economic harm within covered family relationships.
Can controlling money amount to domestic violence?
Qualifying economic exploitation or harm may fall within the law. Specific conduct and consequences must be proved; an ordinary financial dispute is not automatically abuse.
Is threatening to publish private images a cybercrime?
It may engage Article 42 on cyberextortion and threats and privacy provisions, depending on the demand, technology, material and evidence. Report urgent threats promptly.
Can I secretly access my spouse’s account to collect proof?
Do not assume marriage authorises account access. Unauthorised access or copying can create cybercrime and privacy exposure. Preserve only material held lawfully and obtain advice.
May I record a private conversation?
Recording and disclosure can engage UAE privacy and cybercrime rules. Obtain case-specific advice before recording; do not publish private material.
Should I block the person immediately?
Safety comes first, but blocking can affect evidence or trigger escalation. Use a safe device and seek police or specialist guidance where risk is high.

Family Disputes with Criminal Proceedings
Does a police report automatically prove an allegation in family court?
No. It proves that a report exists. The family court assesses the evidence, stage and legal relevance under the governing family-law test.

Does a criminal complaint automatically stop child contact?
No. Seek an urgent family or protection order if contact is unsafe. Follow any existing order until it is lawfully varied, unless emergency authorities direct otherwise.
Can a restraining order include online contact?
It can include specified prohibited-contact measures. The written terms should identify relevant accounts, intermediaries, locations and necessary exceptions.
Can a family court grant a criminal conviction?
No. Criminal responsibility is determined through the criminal process. The family court determines relief within its jurisdiction.
Can a criminal court decide final custody?
Criminal proceedings may generate protection relevant to a child, but final custody generally requires the competent family-law process.
What if the family and restraining orders conflict?
Do not ignore either. Seek urgent clarification or variation and propose a practical handover and communication method consistent with safety.
Should I give the family court the criminal case number?
Yes, where relevant. State the allegation, authority, stage and orders accurately without presenting an allegation as a conviction.

Travel Bans on Children
What is a child travel ban in the UAE?
It is a legal restriction intended to prevent a child’s departure. Its source, wording, duration and conditions must be confirmed from the court or competent authority.

Is refusing to hand over a passport the same as a travel ban?
No. Passport possession, consent to travel and an official departure restriction are separate matters, although they may arise in the same case.
Can a custodial parent travel without the other parent’s consent?
Under the current Personal Status Law, foreign travel by a custodial parent requires written approval of the other parent or guardian, or court authorisation under the statutory conditions.
Can a UAE court authorise 60 days of travel?
The law allows court-authorised travel for a period or periods totalling no more than 60 days in a year, subject to the provision and the child’s circumstances. Approval is not automatic.
Who may keep the child’s passport?
The Personal Status Law contains a guardian passport rule, delivery for authorised travel and power for the court to order otherwise. The judgment and applicable regime must be checked.
What evidence helps an urgent travel-ban request?
Provide the custody order, child identifiers, confirmed itinerary, relevant messages, passport information, residence and school evidence, prior breaches and a clear explanation of non-return risk.
Is a foreign passport enough to obtain a ban?
Not by itself. The court considers evidence concerning the child and proposed trip. Nationality can be relevant but should not replace proof of a real risk.

Urgent and Interim Family Applications
What makes a UAE family application urgent?
The applicant must show a time-sensitive risk or need that cannot adequately wait for ordinary proceedings and request a legally available temporary measure supported by evidence. The court decides whether urgency and the remedy are established.
Must I complete family guidance before seeking an interim order?
Not necessarily. Federal Decree-Law No. 41 of 2024 excludes urgent and temporary cases and specified urgent orders from family-guidance referral. The precise route still depends on the remedy and competent court.
Can I obtain temporary maintenance before final divorce judgment?
A provisional maintenance application may be available where its legal and evidential conditions are met. Entitlement, category, amount, jurisdiction and proof require individual assessment.
Can an urgent custody order decide permanent custody?
An interim order ordinarily addresses the immediate position and does not necessarily determine final custody. The substantive case may require fuller evidence and a final judgment.
Can I request an urgent visitation arrangement?
Potentially. ADJD identifies child visitation among examples of interim-order matters. The existing order, interruption, child’s circumstances, proposed schedule and jurisdiction should be documented.
Can the court decide an interim petition without a hearing?
Some petition procedures allow the judge to decide on the filed documents without an ordinary hearing. The court may grant, reject, narrow or require further material, and an objection route may exist.
Does filing an objection automatically stop the order?
Do not assume so. ADJD states that interim orders are in principle immediately enforceable and that suspension may require a separate request subject to judicial discretion. Check the actual order and applicable route.

If the situation is urgent right now
This page is written for planning, and planning is the wrong activity in an emergency. If anyone is in immediate danger, contact the emergency services first; the legal steps follow afterwards and are not diminished by having done so.
Where the risk is real but not immediate, two things help more than reading further. Put somewhere safe whatever you would need if you had to leave quickly — identity documents, a phone charger, access to money, and the details of anyone who would help. And record what has happened, with dates, in a place the other person cannot reach, because an account written contemporaneously carries weight that one reconstructed later does not.
Keeping a record safely
If you are keeping notes of what has happened, keep them somewhere the other person cannot reach — not on a shared device, a shared account or a phone that is sometimes handed over.
