The Court of Appeal is the onshore court level that reviews an appeal from a qualifying first-instance judgment. In a UAE family case, the appeal court can consider the challenged judgment within the grounds and relief properly brought before it, applying the governing personal-status law and procedural rules to the existing record and admissible appeal material.
An appeal is not a general request for sympathy and should not be treated as a blank new case. The appellant identifies specific errors in the first-instance judgment, explains how those errors affected the result and asks for defined relief. The respondent then has the opportunity to answer through the authorised procedure.
Article 9 of Federal Decree-Law No. 41 of 2024 states that the period for appeal and cassation in personal-status judgments under that law is 30 days. The start, calculation, type of judgment, formal notification and any different rule for a particular order require file-specific verification. An appeal tests an identified first-instance decision
The appeal court reviews a judgment or order that the law allows to be appealed. The appellant should identify the case number, judgment date, challenged provisions and exact amendment or reversal requested. A vague statement that the judgment is “unfair” is not an effective substitute for organised grounds.
Family judgments may contain several components: divorce status, dowry, maintenance, arrears, housing, custody, guardianship, contact, travel restrictions, school or medical costs and costs. A party may accept some components and challenge others. The appeal statement must make that scope clear so that no important part is accidentally left outside the request.
The respondent should conduct the same exercise. Even where the desired result is simply to uphold the judgment, the response should answer each material ground and preserve any procedural position available under the applicable rules.
Courts of Appeal form the second onshore litigation level
The Abu Dhabi Judicial Department describes its system as first instance, appeal and cassation, and states that Courts of Appeal use circuits of three judges to decide appeals from first-instance courts. Dubai and the federal judicial system have their own competent appeal courts and service channels.
The appeal venue follows the court system that issued the first-instance decision. A Dubai onshore case does not move to Abu Dhabi because one party relocates there after judgment. A federal-system case does not become a local Dubai appeal merely because assets are in Dubai.
DIFC and ADGM proceedings have separate appellate rules and court structures. Their terminology and deadlines should not be imported into an onshore personal-status case.
The 30-day personal-status period demands early action
Federal Decree-Law No. 41 of 2024, Article 9, provides 30 days for appeal and cassation in personal-status judgments under that law. Civil Procedure contains the general appellate framework, but the controlling deadline and start event must be established from the specific file.
Official electronic notification can be decisive. Do not wait for a paper copy if the court record shows valid digital service, and do not assume the period starts when a party discusses the judgment with a relative. Obtain the official notification log and full signed judgment.
Some urgent, interim, procedural or enforcement decisions may have a different challenge route or period. The title placed on an application does not control; its legal nature and the operative order do.
Strong grounds link error, record and requested relief
An appeal may challenge the application or interpretation of law, factual findings, treatment of evidence, procedure, reasons or the remedy ordered, within the powers granted by law. Each ground should be structured around four points:
- what the first-instance court decided;
- what legal or factual error is alleged;
- where the supporting material appears in the record; and
- what precise order the appeal court is asked to make.
For example, a maintenance appeal should not merely state that the amount is high or low. It should identify the legal criteria, evidence of income and needs, disputed calculation, and revised figure or method requested. A parenting appeal should address the governing child-related standards and the factual record, not use the appeal as a forum for personal accusations unrelated to the order.
New evidence may be considered, but an appeal is not unlimited
Federal Civil Procedure allows the appeal court to hear the case on the basis of material submitted at first instance together with new evidence, pleas and defences permitted at appeal. This can matter where a document clarifies income, residence, schooling, medical needs or a procedural event.
That does not mean any new claim or late document is automatically accepted. Relevance, authenticity, translation, procedural fairness and the boundaries of the original dispute remain important. The other party must have a fair opportunity to answer admissible new material.
Before filing, distinguish evidence that existed but was omitted, evidence that arose after judgment, and a truly new cause of action. Each category can require a different procedural response. See Evidence in UAE Family Cases for preservation and presentation principles.
The appeal statement should be exact, not encyclopaedic
A useful appeal statement identifies the parties and judgment, confirms admissibility and time, summarises the relevant history, states numbered grounds, cites the applicable law and ends with clear requests. It should attach or reference the required judgment, notification and evidence according to the court’s filing system.
Copying every first-instance paragraph can obscure the actual errors. Equally, a one-page assertion may fail to explain them. The aim is a complete but disciplined document in the court language and required format.
Where a party acts through a representative, the power of attorney must cover the intended litigation and appeal acts. Foreign-issued powers and documents may require authentication and certified Arabic translation.
Responding to an appeal requires its own strategy
The respondent should not assume that a favourable first-instance judgment will defend itself. Review the appellant’s requests, admissibility, notification and grounds; identify evidence that supports the judgment; correct misleading chronology; and state the desired order on each challenged issue.
If the respondent also seeks a change, counsel should consider whether the procedural rules require a separate or responsive appeal step and whether it is in time. A response that merely asks for a larger award may not create jurisdiction to change an unappealed part of the judgment.
Keep proof of filing and service. Court portals can show deadlines and hearing updates, but the official case record governs.
The governing family regime must remain distinct
Muslim personal-status cases, federal civil personal-status cases for qualifying non-Muslims and Abu Dhabi civil-family cases are governed by different substantive frameworks. The appeal court reviews the first-instance judgment against the correct regime.
Nationality, religion, domicile, marriage route, election of law and jurisdiction can affect the classification. A ground based on a civil no-fault divorce rule cannot simply be applied to a Muslim personal-status dispute, and an Abu Dhabi civil-family provision should not be presented as a general federal rule.
In cross-border cases, the appeal may also involve proof and application of foreign law, jurisdiction, foreign documents or recognition. Those issues need official texts, properly authenticated material and accurate translations.
Enforcement may continue while an appeal is pending
An appeal does not always suspend every provision of a family judgment. Some orders may be provisionally executable or subject to special enforcement treatment. A stay can require a separate request and satisfaction of the statutory criteria.
The appeal plan should therefore include an enforcement plan. Confirm whether an execution file exists, what sums or conduct are due, whether there is a travel or custody measure, and whether compliance can occur without prejudicing the appeal. Do not ignore an order because an appeal is intended.

Interim orders and final judgments need separate classification
Family litigation often produces temporary maintenance, housing, contact, travel or protective measures before a final judgment. Their purpose, enforceability and challenge route may differ from those of the final merits judgment.
A party should not wait for the final case to end before checking an urgent order’s deadline, nor assume every case-management decision is independently appealable. Obtain the operative text and ask what the law permits for that particular decision.
Where circumstances change after an order, the correct step may be variation or a new interim application rather than an appeal alleging that the original court erred on the material then available.
Appeal hearings focus on the framed dispute
The court may manage written submissions, documents, expert issues and oral hearings through its procedural system. Parties should follow directions, attend when required and ensure the authorised representative has access to the full file.
At hearing, counsel should be able to answer: what exactly is challenged, which rule applies, where is the evidence, what answer was given below, and what order is requested now? Emotional context may explain the dispute, but it must be connected to a legally relevant issue.
If settlement remains possible, negotiations should proceed without missing procedural deadlines. Do not rely on informal assurances that the other party will not enforce or that a deadline will be extended.
Appeal judgments can affirm, change or reverse the result
Within its legal powers, the appeal court may uphold the challenged judgment, amend parts of it, reverse it, address issues within the appeal or take another course authorised by procedure. The precise outcome depends on the grounds, evidence, law and requests.
The appeal judgment should be read as a whole. Its operative section determines obligations, while the reasons explain the court’s legal and factual basis. Any correction, clarification, enforcement or cassation question must be considered promptly after official notification.
A further Court of Cassation challenge, where available, is narrower and focuses on legal or qualifying procedural error. It is not another full factual appeal.
The first consultation should answer six operational questions
Bring the judgment, notification record and full first-instance file. The initial review should establish:
- which court system and family-law regime apply;
- whether the decision is appealable;
- the verified final filing date;
- which provisions are challenged or accepted;
- what evidence and legal grounds support each request; and
- whether enforcement or urgent protection requires immediate action.
A concise chronology, financial schedule and indexed document set save time. Preserve messages in their original form and keep Arabic translations with the source documents.

Is an appeal a complete new trial?
It is a review at a second litigation level, not a free-standing replacement case. The appeal remains connected to the first-instance dispute, challenged judgment, permitted grounds and relief.
Does filing an appeal stop enforcement?
Do not assume that it does. Some family orders may be enforceable while appeal continues, and a stay may require a separate application. Review enforcement and appeal together.
Can I appeal a temporary maintenance or contact order?
The answer depends on the order’s legal character and the special procedure governing it. Interim, urgent and case-management orders may have distinct routes or periods, so obtain the operative order immediately.
Which Court of Appeal hears a Dubai case?
An onshore Dubai case ordinarily follows the Dubai Courts hierarchy. Jurisdiction is confirmed from the first-instance judgment and governing legislation, not from a later change in residence.
What does the appellant need to prove?
The appellant should identify a material legal, factual or procedural error, support it from the record or admissible appeal evidence, explain its effect and request a precise lawful outcome.
What should the respondent do?
The respondent should check admissibility and time, answer each material ground, preserve supporting evidence and state the requested result. If the respondent wants the judgment changed, any required responsive appeal step must be considered promptly.
Can the Court of Appeal change maintenance?
