The Court of Cassation is the final review level in an onshore UAE court system where the governing law permits a cassation challenge. Its central function is to protect the correct interpretation and application of law. It normally examines the legality of an appeal judgment and the proceedings that produced it; it is not simply a third opportunity to ask another court to prefer one witness or factual account.
In Abu Dhabi, the Judicial Department describes the Court of Cassation as the emirate’s highest judicial body and confirms that it includes personal-status chambers. Dubai has its own local Court of Cassation. Cases within the federal court system follow the competent federal route. The correct final court must therefore be identified from the court that issued the appeal judgment, not merely from where a party lives.
For personal-status judgments governed by Federal Decree-Law No. 41 of 2024, Article 9 states a 30-day period for appeal and cassation. Cassation protects legality rather than reopening the whole family dispute
A Court of Appeal can usually engage with the parties’ factual and legal grounds within the permitted scope of the appeal. Cassation is narrower. The cassation court asks whether the appeal court applied the governing law properly, respected jurisdiction and essential procedure, gave legally adequate reasons and stayed within the relief placed before it.
This difference matters in a family case. A parent may strongly disagree with the assessment of messages, financial records or testimony. Disagreement alone is not a cassation ground. Counsel must connect the alleged error to a recognised legal ground and show where it appears in the judgment or procedural record.
The Abu Dhabi Judicial Department says its Court of Cassation ensures proper interpretation and application of law. That description captures the practical focus: a petition should identify a legal defect with precision, not reproduce the full story of the marriage or parenting dispute.
The final court depends on the judicial system that heard the case
“UAE Court of Cassation” is a useful general expression, but there is no single filing destination for every family matter. An onshore case heard through Dubai Courts ordinarily remains in that local court hierarchy. An Abu Dhabi onshore case follows the Abu Dhabi hierarchy. A matter in a federal judiciary emirate may follow the federal system and, where available, the competent federal supreme review route.
The DIFC Courts and ADGM Courts have separate procedural frameworks and appellate structures. They should not be treated as onshore personal-status cassation courts. Nor does the federal civil personal-status regime automatically determine which court has territorial jurisdiction. Applicable family law, court competence and appellate route are connected questions but not identical ones.
The first file review should therefore identify the case number, court and circuit at first instance, the appeal number, judgment date, notification record, parties’ domicile and the statutory route shown by the appeal judgment.
Article 179 supplies the legal framework for cassation grounds
Federal Decree-Law No. 42 of 2022 on Civil Procedure regulates cassation in the federal procedural framework. Article 179 identifies grounds on which judgments may be challenged in cassation. In practical terms, grounds may concern violation, misapplication or misinterpretation of law; nullity affecting the judgment or procedure; jurisdiction; conflict with a final judgment; legally inadequate or contradictory reasoning; or the court deciding outside the relief properly requested.
The exact ground must be matched to the official text and the judgment. A petition should not list every category as a precaution. It should explain:
- the legal rule the appeal court was required to apply;
- the passage or omission in the appeal judgment that constitutes the error;
- where the issue was preserved in the record where preservation is required;
- why the defect affected the result; and
- the order requested from the cassation court.
This legal mapping is often the most demanding part of the case.
A cassation petition is built from the existing record
The record normally includes the first-instance judgment, appeal judgment, pleadings, hearing minutes, expert reports, exhibits, procedural applications and proof of notification. Counsel studies how the appeal court dealt with each material ground and whether its reasoning permits legal review.
Fresh documents do not turn cassation into an evidence hearing. A new bank statement or private report may be important for another lawful application, but it ordinarily cannot cure the absence of a cassation ground. The petition must work with the procedural history and legal reasoning already before the court.
Preserve the complete electronic file. Screenshots from a portal may omit annexures or dates. Obtain the signed judgment, notification details, filed appeal grounds, responses, exhibits and any orders affecting time or enforcement. Foreign-language documents should remain with the certified Arabic translations used in the proceedings.
Time must be audited immediately after the appeal judgment
Article 9 of Federal Decree-Law No. 41 of 2024 sets 30 days for appeal and cassation in personal-status judgments under that law. Civil Procedure also contains time rules, but the practitioner must identify the controlling provision, when the period began, how official notification occurred and whether the challenged decision is capable of cassation.
Do not calculate from the day a party casually read the result or received an informal message. The file may contain a formal notification event. Weekends, public holidays, electronic service and statutory extensions must be assessed under the applicable rules. An incorrect assumption can make an otherwise arguable petition inadmissible.
A rapid review should record the judgment date, formal notification date and method, last filing date calculated under the applicable law, current enforcement status and any separate deadline for a stay request.
Not every appeal judgment is open to cassation
Access to cassation is statutory. The type and finality of the judgment, subject matter, court system and any admissibility conditions determine whether the route exists. Some decisions may be final at appeal level; some interlocutory or procedural orders have a different route; and an attempted challenge may be rejected without examination of the merits if a required condition is absent.
Do not rely on the label “final judgment” alone. It can describe enforceability, the end of an ordinary appeal or the conclusion of the case while leaving a limited extraordinary or cassation route. Equally, a party cannot create cassation jurisdiction merely by describing an issue as important.
The written advice should separate three questions: is the judgment challengeable, is the petition in time and is there a legally sustainable ground?
Enforcement and cassation are separate procedural tracks
Filing a cassation petition should not be assumed to suspend enforcement automatically. A maintenance, custody, travel, housing or financial order may already be enforceable, or parts of it may have immediate effect. A party seeking suspension may need a separate application and must meet the statutory test.
The practical strategy should assess both tracks. The cassation team examines legal error. The enforcement team checks what is executable now, what compliance is possible, whether amounts should be paid or secured, and whether urgent relief is required. Ignoring an enforceable order while waiting for cassation can create additional consequences.

Family-law classification remains important at final review
UAE family disputes can fall under Muslim personal status, federal civil personal status for qualifying non-Muslims, or the Abu Dhabi civil-family framework. Choice-of-law and jurisdiction questions may also arise in expatriate and cross-border cases. These regimes should not be blended.
The applicable substantive regime affects the legal rule against which the appeal judgment is tested. A petition challenging maintenance reasoning under Muslim personal-status provisions cannot simply rely on a civil-divorce concept from another regime. An Abu Dhabi civil-family appeal requires attention to that court’s legislation and procedure as well as the general appellate framework.
The petition should identify the regime, relevant statutory provision and reason that provision controlled the disputed issue.
Common defects require precise legal treatment
Potential cassation issues may arise where an appeal court applies the wrong statute, treats a mandatory condition as optional, refuses jurisdiction on an incorrect basis, overlooks a decisive defence, gives reasons that do not reveal how a material issue was resolved or rules beyond the parties’ requests.
Not every imperfect phrase justifies cassation. Reasons are read as a whole. A harmless procedural irregularity may not have affected the outcome. A factual assessment may be within the appeal court’s lawful discretion even if another view was possible.
The analysis should distinguish legal error, evidential weight, procedural nullity and dissatisfaction. Only after that classification can the realistic grounds and requested remedy be drafted.
Possible outcomes are more varied than “win or lose”
Depending on the law and the issue, a cassation court may find the challenge inadmissible, reject it, quash all or part of the appeal judgment, remit the matter for reconsideration, or decide a legal issue itself where the procedural rules allow. The precise consequence depends on the ground and posture of the case.
A quashing decision does not always deliver the final substantive outcome sought by the petitioner. A remitted case may require further hearings before the competent court, and that court must apply the cassation ruling within its legal effect. Costs, deposits and enforcement consequences should be assessed separately.
Clients should plan for each procedural branch instead of treating filing as a guaranteed reversal.
