Foreign judgment recognition is the legal process by which a UAE court accepts the authority or effect of a judgment issued by a court in another country. Enforcement is the further step of using UAE execution measures to compel compliance, collect money, transfer control of an asset or implement another enforceable obligation. The two ideas are closely related but should not be treated as automatic or identical.
For onshore UAE proceedings, the principal framework is Chapter Four of Federal Decree-Law No. 42 of 2022 Promulgating the Civil Procedure Code. The Code addresses foreign judgments and orders, and the articles that follow extend the framework to specified foreign arbitral awards, notarised instruments, settlement records and execution instruments. A treaty may alter or supplement the domestic route, so the issuing country must always be identified.
Family judgments need particular care. A foreign divorce decree, maintenance award, child order and property direction may contain legally distinct parts. Recognition of marital status does not necessarily make every financial or parenting term executable in the UAE. Mr AlBalooshi can assess the order, the applicable route and the evidence required. Submit the inquiry form or WhatsApp +971 50 627 5196.
Recognition and enforcement answer different questions
The Civil Procedure Code has been amended since it was promulgated. Article numbering in the enforcement chapter should be checked against the current consolidated text before a citation is relied on in a filing.
Recognition asks whether the foreign decision should be treated as legally effective for a defined UAE purpose. A person may need recognition to prove that a marriage ended, prevent inconsistent proceedings, update records or rely on an issue already decided. Enforcement asks whether a coercive remedy can be used against a person or property in the UAE.
The distinction matters in family cases. A final foreign divorce may establish civil status while a foreign order dealing with a UAE property, child travel or ongoing maintenance requires separate examination. Some terms may be declaratory, some monetary and some incapable of direct execution in the form used abroad. The applicant should identify the exact practical outcome sought rather than asking generally to “attest” a judgment.
The Civil Procedure Code is the starting point for the onshore route
The Civil Procedure Code states that foreign judgments and orders may be enforced in the UAE on the same conditions under which the issuing country enforces UAE judgments and orders. This reciprocity provision makes the foreign jurisdiction relevant from the outset. A judicial-cooperation treaty may provide a more specific route and should be checked before relying only on the general Code.
Under the Civil Procedure Code, the concerned party applies by petition to the execution judge using the required particulars. The judge may obtain supporting documents before deciding. The current official text provides an expedited decision framework, but applicants should not assume an outcome or timetable: court competence, filing acceptance, document deficiencies, service issues, objections and appeals can affect the process.
The execution judge must verify five central safeguards
Before ordering execution, the Civil Procedure Code requires verification of conditions concerning:
- Jurisdiction: UAE courts must not have exclusive jurisdiction over the underlying dispute, and the issuing foreign court must have been competent under its own international-jurisdiction rules.
- Regular issuance and authentication: the judgment or order must have been delivered under the law of the country where it was issued and duly authenticated.
- Notice and representation: the parties must have been properly summoned and represented in the foreign proceedings.
- Finality: the judgment must have the force of res judicata under the issuing court’s law, shown in the decision or by appropriate proof.
- Consistency and public order: it must not conflict with a UAE judgment or order and must contain nothing contrary to UAE public order or morals.
These conditions are not a checklist to be asserted without evidence. Each proposition should be tied to an official record from the issuing country and presented in the form accepted by the competent UAE court.
Jurisdiction can be the decisive issue
The execution judge considers both sides of jurisdiction. The foreign court must have been competent under its own law, but recognition can also fail where the UAE courts had exclusive jurisdiction over the original dispute. The analysis is issue-specific.
For example, a divorce judgment may include marital-status, child, property and support terms. The jurisdictional basis for one part may not answer the others. Directions about immovable property in the UAE, a child presently in the UAE or an obligation governed by mandatory local rules require focused analysis. An applicant should map each operative paragraph of the foreign order to the right and asset it concerns.
Residence, nationality, domicile, place of marriage, location of property and the defendant’s connection to the issuing country can all be relevant. A short foreign judgment may not explain its jurisdictional basis, making a certificate, originating claim or foreign-law material important.
Proper service must be proved, especially after default
The Civil Procedure Code protects the respondent’s right to have been properly summoned and represented. A judgment obtained after personal participation is usually easier to document than a default judgment, but neither category is automatically accepted or rejected.
For a default judgment, preserve the originating process, proof of service, translated address evidence, court findings on service and any record showing the time allowed to respond. Email, publication or substituted service may have been valid abroad, yet the UAE execution judge still needs reliable evidence that the applicable foreign procedure was followed.
Do not describe mere delivery of a letter as judicial service if the foreign court record does not support that conclusion. If the respondent changed address, lived in the UAE or participated through counsel, include the relevant official record rather than selective correspondence.
Finality is different from winning at first instance
A foreign decision normally needs the force of res judicata under the issuing court’s law. That may require expiry of an appeal period, dismissal of an appeal or a separate certificate of finality. A seal on the judgment authenticates the document but does not necessarily prove that ordinary review is exhausted.
Obtain a current certificate from the issuing court or competent authority where available. If one part of the order is final and another remains open to variation or appeal, identify the distinction. Interim custody directions, temporary maintenance and protective measures may need a different route from a final judgment.
Foreign-law terminology should be explained accurately. “Absolute,” “decree nisi,” “executory,” “final and binding” and similar labels do not carry an identical meaning in every country. A UAE filing should state what the issuing jurisdiction says the order can presently do.
Public order review can divide a family judgment into parts
The Civil Procedure Code prevents enforcement of terms contrary to UAE public order or morals. Public-order review is not a general invitation to retry the merits, but it can be important where the foreign result conflicts with a mandatory UAE principle.
Family judgments often need severability analysis. A court may be asked to recognise the divorce while separately assessing maintenance, custody, guardianship, succession or property consequences. The applicant should avoid assuming that a foreign court’s labels determine the UAE legal classification.
The applicable UAE family-law regime also matters. Muslim personal-status cases under Federal Decree-Law No. 41 of 2024, federal civil personal-status matters under Federal Decree-Law No. 41 of 2022, and Abu Dhabi civil-family cases are distinct. The Civil Procedure Code is procedural; it does not erase the substantive rules relevant to the requested effect.
A conflicting UAE judgment may prevent execution
The foreign decision must not conflict with a UAE judgment or order. Disclose all UAE proceedings, including interim, execution and child-related orders, even if one party believes they were superseded abroad. The judge should not discover a competing local record only through the respondent.
Conflict may be narrow. One order may address divorce status, another maintenance arrears and another a child’s current residence. Prepare a table comparing the parties, issues, dates, operative terms and present status. If a UAE order has been appealed, varied or discharged, include the official procedural record.
Parallel proceedings also create strategic risk. Filing a new merits case and an execution petition without coordinating their objectives can produce inconsistent positions. Advice should be taken before characterising a foreign issue as already decided.
Treaties may provide a different recognition route
The UAE is party to judicial-cooperation arrangements with some countries, including regional and bilateral instruments. A treaty can address recognition, required documents, refusal grounds, competent authorities and transmission. Its geographic and subject-matter scope must be verified from the official text.
Do not assume that a general friendship, extradition or legal-assistance agreement covers family judgments. Likewise, a treaty for civil and commercial judgments may contain exclusions or special rules. The judgment date, state of origin and requested remedy all matter.
Where a treaty applies, comply with its document and certification rules. Article 225 of the Civil Procedure Code preserves the effect of treaties between the UAE and other states on execution of foreign judgments, orders and instruments.
Family judgments should be separated by remedy
Create a remedy schedule before filing:
| Foreign order component | UAE question to answer |
|---|---|
| Divorce decree | Is recognition needed for status, records or a later family claim? |
| Maintenance award | Is the amount final, due and executable, and how are later accruals calculated? |
| Child residence or contact | Does the UAE court have current competence, and what welfare or urgent issues exist? |
| Travel or passport direction | Can the term operate through UAE authorities, or is a local order required? |
| Property division | Where is each asset, who holds title and does a UAE court have exclusive competence? |
| Costs or interest | Is the sum final, supported and compatible with the execution route? |
This prevents an all-or-nothing filing. It also helps determine whether recognition, execution, a fresh local application or foreign-country action is the appropriate next step.
Documents should prove authenticity and legal effect
A typical preparation file may include:
- the complete sealed or certified foreign judgment;
- the originating pleading and record identifying the parties and relief;
- proof of summons, service and representation;
- a certificate of finality or enforceability;
- any appeal, variation or correction order;
- official proof of the foreign court’s authority where required;
- marriage, divorce and child identity records;
- a schedule of money due and payments received;
- UAE judgments or proceedings involving the same parties;
- legalisation or attestation appropriate to the issuing country;
- certified legal Arabic translations; and
- treaty text or foreign-law evidence where relied upon.
Requirements vary. The court may request further evidence, and a document accepted for immigration or civil-status use is not necessarily sufficient for judicial execution.
Legalisation and translation do not create enforceability
Attestation confirms signatures or seals through the applicable authentication chain. Translation enables the UAE court to read the document. Neither process proves jurisdiction, service, finality or compatibility with public order.
Use the original or properly certified copy required by the issuing authority and UAE court. Names, dates, currency, paragraph numbering and court terminology should match across the source and Arabic translation. If an attachment contains the operative schedule, translate and authenticate it too.
Read legalisation and attestation for the distinction between authentication, apostille and legal Arabic translation.
Execution needs an identifiable UAE target
Even a recognised money judgment needs a debtor or asset against which UAE execution can operate. Identify lawful information about salary, bank accounts, vehicles, real estate, company interests or other property without accessing private data unlawfully.
A foreign custody or contact term may require a local operational order rather than ordinary debt execution. A direction to transfer foreign property will usually require action in the country where the asset is located. An order against a company that was not a party cannot simply be extended to it.
The applicant should decide whether the goal is status recognition, collection, compliance, registration or evidence for another case. That choice determines the forum and documents.
Respondents should challenge the statutory condition, not retry everything
A respondent served with an execution petition should obtain the full foreign record and UAE filing promptly. Relevant grounds may include lack of foreign jurisdiction, defective service, absence of finality, a conflicting UAE order, public-order incompatibility, mistaken identity, satisfaction of the debt or an inapplicable treaty.
Merely disagreeing with the foreign judge is usually not the same as showing that the Civil Procedure Code is unsatisfied. The response should cite an official document for each objection. If an appeal is pending abroad, provide the filing and court confirmation. If payment occurred, supply bank records and a clear reconciliation.
Do not ignore the petition while trying to reopen the foreign case. UAE objection and appeal periods can run independently of overseas steps.
Practical example: one divorce decree, three UAE tasks
Assume a foreign decree dissolves a marriage, orders monthly child support and directs sale of an apartment in Dubai. The person may need marital-status recognition, enforcement of accrued support and property-specific advice. Each task has a different object and evidence.
The divorce may require a certified final decree. The support claim needs calculations and proof of payments. The apartment term requires jurisdiction and title analysis because the asset is in the UAE. It would be unsafe to assume that one generic application automatically completes all three tasks. This example is illustrative and predicts no result.
How Mr AlBalooshi can prepare a recognition strategy
Mr AlBalooshi can review the foreign judgment and underlying record, separate recognition from enforcement, identify the competent UAE route, assess the Civil Procedure Code and any treaty, prepare the document and translation plan, structure the petition or response and coordinate with foreign counsel where necessary.
Use the inquiry form and provide the complete judgment, proof of finality, service record, related UAE orders, the issuing country and the UAE outcome required. You may also WhatsApp +971 50 627 5196. Sending documents does not itself create a lawyer-client relationship; conflict checks, scope and written engagement are required.
Frequently asked questions about foreign judgment recognition
1. What is foreign judgment recognition in the UAE?
It is the process by which a UAE court accepts specified legal effect of a judgment issued abroad. The purpose may be status, issue preclusion or execution. The requested effect must be stated clearly.
2. Is recognition the same as enforcement?
No. Recognition concerns legal effect; enforcement uses coercive execution measures. A judgment may be relevant as proof of status without every operative term being directly executable.
3. Which UAE law governs onshore enforcement?
Federal Decree-Law No. 42 of 2022, principally the Civil Procedure Code, governs the general onshore route, subject to treaties and any specific local procedure.
4. Does the UAE enforce every final foreign judgment?
No. The execution judge must verify jurisdiction, proper issuance and authentication, summons and representation, finality, consistency with UAE judgments and compatibility with public order or morals.
5. Can a foreign divorce be recognised?
Potentially, but marital status, maintenance, children and property may require separate analysis. The applicable UAE family-law regime and intended record or remedy matter.
6. Can a foreign custody order be enforced automatically?
No. Current UAE competence, the child’s location, welfare, service, finality, public order and the operational form of the foreign order must be assessed.
7. What proves that the judgment is final?
The judgment itself may state finality, or the issuing court may provide a certificate. A seal alone may authenticate the copy without proving that review rights are exhausted.
8. What if the respondent never appeared abroad?
A default judgment is not automatically invalid, but proper summons and opportunity to be represented must be proved through the official foreign-court record.
9. Is legalisation enough?
No. Legalisation addresses authenticity. The Civil Procedure Code also requires jurisdiction, service, finality, no conflicting UAE order and compatibility with UAE public order and morals.
10. Must the judgment be translated into Arabic?
UAE court filings generally require legal Arabic translation of foreign-language material. The competent court’s current filing rules and the scope of the record should be checked.
11. Does reciprocity matter?
The Civil Procedure Code links enforcement to the conditions under which the foreign country enforces UAE judgments. A treaty may provide more specific reciprocal obligations.
12. What if a treaty applies?
The treaty’s scope, competent authority, documents and refusal grounds should be applied. Article 225 preserves relevant treaty arrangements.
13. Can only part of a judgment be enforced?
Potentially. A court may need to examine severable terms separately, especially where one decree covers divorce status, support, children and assets.
14. Can I enforce against assets outside the UAE?
UAE execution powers do not automatically reach foreign registries or banks. Local recognition or enforcement advice is usually required where the asset is located.
15. How should I prepare for a consultation?
Provide the full judgment, finality and service evidence, appeal history, authenticated copies, related UAE orders, asset information lawfully held and a concise statement of the UAE result sought.
