Most family matters can be conducted in an orderly way. Some cannot, because something is about to happen — a departure, a hearing, a sale, a loss of housing — that a final judgment months later will not repair.
Interim applications exist for that narrower category. This page is about recognising when you are in it, what an application of that kind actually requires, and what tends to go wrong. Whether any particular relief is available depends on the applicable framework and the competent court, and the urgent and interim applications guide deals with the framework itself.
Urgency is not the same as importance
Almost everything in a family dispute feels urgent to the person living it. The question a court is being asked is narrower: is there something that must be dealt with now because dealing with it later will be ineffective?
Useful test questions:
- Is there a date? A flight, a hearing, a lease expiry, a completion. Urgency with a date attached is far more legible than urgency in general.
- Is the harm reversible? A child removed to another country, an asset sold to a third party, evidence destroyed — these are difficult or impossible to undo.
- Has something changed recently? A situation that has been the same for a year is harder to present as needing relief this week, unless something specific has altered.
- Would waiting make the final decision meaningless? That is the essence of the argument.
If the honest answer to all four is no, an urgent application is probably the wrong tool, and using it anyway tends to damage credibility for the moment when something genuinely is urgent.
The situations that most often justify moving quickly
- Proposed or feared removal of a child from the country, or non-return from a trip.
- Immediate safety concerns for an adult or a child. Safety comes before litigation strategy — if anyone is in immediate danger, contact the competent UAE emergency service or authority rather than working through a legal route first.
- Loss of housing or of the means to meet essential costs while the case runs.
- Support that has stopped, leaving a household or a child without provision.
- Disposal of an asset that is central to the dispute.
- An imminent step in another forum — a hearing or a filing abroad — that will affect what a UAE court can do.
What an urgent application needs
Urgency does not lower the evidential bar; if anything it raises the premium on clarity, because there is less time to explain.
- A short, dated chronology that shows how the situation arose and what changed. This is the single most valuable document.
- The specific event or date creating the urgency, evidenced — a booking, a notice, a message, a listing.
- Precisely what you are asking for. A narrow, specific request is easier to grant than a broad one. “Restrain travel with the children pending the hearing” is a request; “protect my rights” is not.
- Why it cannot wait, stated in one paragraph.
- The documents that support each assertion, referenced rather than dumped.
- What you have already tried — a request made and refused, or ignored, strengthens the position considerably.
Where urgent applications go wrong
- Overreach. Asking for everything at the interim stage invites refusal of the part that mattered.
- Delay. An application made three weeks after the triggering event answers its own urgency argument.
- Unsupported allegation. Serious assertions made without evidence do more damage to the applicant than to the respondent.
- Self-help first. Retaining a passport, withholding a child or moving money before applying frequently converts a strong position into a compromised one.
- Ignoring the other side of the ledger. An interim order can carry consequences for the applicant too, including where it is later discharged. Ask about that before applying.
- Forgetting the main case. Interim relief is a holding step, not an outcome.
If an urgent application is made against you
Respond, and respond on time. Silence is read as acceptance of the account given, and short deadlines are usually short for a reason.
Deal with the specific factual assertions rather than the tone of the application. Where an assertion is wrong, say why and produce the document that shows it. Where something is right but incomplete, supply the context. And take advice before agreeing to an undertaking or a consent arrangement to make the application go away — those can bind you well beyond the immediate moment.
After an interim order
An interim order is a bridge, not a destination, and three things follow from that.
Comply with it exactly, even where you disagree, while advice is taken about challenging or varying it. Breach converts your grievance into their case.
Keep the main proceedings moving. Interim relief can create a false sense that the problem is solved. It is a temporary arrangement, and it usually falls away or is replaced.
Record what happens under it — payments made, contact taking place, arrangements followed. That record is what the court will look at when the interim position is reviewed.
Practical planning while the case runs
Even where nothing is urgent today, a small amount of preparation makes an urgent application possible if it becomes necessary:
- Keep the chronology current rather than reconstructing it under pressure.
- Keep copies of key documents somewhere you can reach quickly, including from a phone.
- Keep travel consents, passports and school documents accounted for and know who holds what.
- Keep a record of requests made and answers received.
- Know how to reach your lawyer outside office hours if a real risk exists.
The timeline planner will keep a chronology on your own device; nothing it holds is transmitted or stored anywhere.
A note on proportion
Interim applications are powerful and they are noticed. Used where they belong, they prevent real and irreversible harm. Used as a tactic, they damage the person using them and make the next application — possibly the one that matters — harder. If you are unsure which side of the line you are on, that uncertainty is worth putting to a lawyer before filing rather than after.
Costs, and the honest calculation
Urgent work is more expensive than planned work. It compresses preparation into days, it usually requires someone to drop other matters, and it often has to be done twice — once to stabilise the position and again properly.
That is not a reason to avoid it when it is warranted. It is a reason to be clear-eyed about the calculation. An application that prevents a child being removed from the country, or stops an asset being sold, is worth several times what it costs. An application made to make a point is not, and the money spent is the smaller part of the loss — the larger part is the credibility spent alongside it.
Ask for a scope and a cost estimate for the urgent step specifically, separately from the main matter, and ask what happens to that work if the situation resolves before the application is heard. See fees and engagement terms.
When urgency turns out to be misplaced
Sometimes the flight is cancelled, the sale falls through, or the situation the application was built on simply does not materialise. That is a good outcome, and it should be treated as one rather than as a reason to press on.
Where an application has been filed and the urgency has passed, say so promptly. Continuing with an urgent application that is no longer urgent is noticed, and it makes the next one harder. Where the underlying issue remains but is no longer time-critical, it usually belongs in the main proceedings, where it can be dealt with properly with full evidence.

If something in your matter cannot wait for a final judgment, the sequence of steps matters as much as their content.
Use the enquiry form on this page with a short outline of the matter, or contact the office on +971 50 627 5196 by telephone or WhatsApp. Please describe the position briefly rather than sending a full document set, and say if there is a hearing, a deadline or a travel date. Making an enquiry does not by itself create a lawyer–client relationship.
Frequently asked questions
What counts as urgent enough for an interim application?
Broadly, something that must be dealt with now because dealing with it later will not repair the harm — an imminent departure with a child, a safety risk, an asset about to be disposed of, a household about to lose essential support. Difficulty alone, without a date or irreversibility, is usually not enough.
How quickly should I apply?
As soon as the triggering event is known. An application made weeks after the event undermines its own urgency argument, and delay is one of the most common reasons urgent applications fail.
Is an interim order permanent?
No. It is a temporary arrangement pending the main proceedings, and it is normally replaced or falls away. Treating it as the end of the matter is a common and costly mistake.
Can I get an order without the other party knowing?
Whether any application can be made without notice depends entirely on the framework, the court and the circumstances. It is exceptional, not routine, and it should never be assumed. Ask specifically.
What if I take protective action myself first?
Self-help — retaining a passport, withholding a child, moving money — frequently damages a position that was otherwise strong. Take advice before acting unilaterally, even where your concern is genuine.
What evidence matters most?
A short dated chronology, evidence of the specific event creating urgency, and a precise statement of what you are asking for. Volume is not the point; clarity is.
Can interim maintenance be sought while the case runs?
Whether interim or temporary support is available depends on the framework and the court. Where it may be, it is better raised early than after arrears accumulate.
What happens if the other party ignores an interim order?
That becomes an enforcement question, and the route depends on the order and the framework. Record the breach with dates and take advice rather than responding in kind.
An application has been made against me. What do I do first?
Respond within the time given, deal with the specific factual assertions rather than the tone, and take advice before agreeing to any undertaking or consent arrangement to resolve it quickly.
Can an interim order be varied or discharged?
Whether and how depends on the order and the applicable route. Comply with it in the meantime while advice is taken — breaching an order you intend to challenge weakens the challenge.
Does an urgent application make settlement less likely?
Not necessarily. A well-founded application that stabilises a situation can make constructive discussion possible. An overreaching one usually has the opposite effect.
Is there a cost consequence if the order is later discharged?
There can be consequences for an applicant where interim relief turns out to have been unjustified. Ask about this specifically before applying rather than after.
What if the urgency involves another country?
Steps in one country can affect what is possible in the other, so coordinated advice in both is important. See the cross-border pages on this site, and raise the foreign element at the outset.
Is the enquiry form the right route for an emergency?
No. The form is not an emergency service. If anyone is in immediate danger, contact the competent UAE emergency service or authority. For an urgent but non-emergency legal matter, call the office as well as writing.
How do I prepare in case something becomes urgent later?
Keep a current chronology, keep copies of key documents reachable from a phone, know who holds passports and travel consents, and keep a record of requests and replies. Preparation is what makes a fast application possible.
Can the office review whether an urgent application is appropriate?
Yes, subject to conflict and engagement checks. Describe the situation and any date that is driving it, and say clearly if a child, safety or travel is involved.
