Non-Muslim families in the UAE now have civil routes that did not exist a few years ago, and a great deal of what is written about them online is out of date or blends two different frameworks. These answers keep the federal civil regime and the Abu Dhabi civil-family route separate, because eligibility and procedure differ.

The existence of a civil route does not mean a party may pick whichever answer looks most favourable. Eligibility, jurisdiction and applicable-law questions still have to be worked through on the facts.

One warning before the answers. The UAE runs more than one family-law framework, and they must not be read as a single system: Muslim personal status; the federal civil personal-status regime for those within its scope; the Abu Dhabi civil-family route, which is a local framework with its own eligibility and procedure; onshore court procedure, which is separate again from the substantive law; and cross-border recognition and enforcement, which depends on both countries involved. A rule from one does not carry across to another.

No-Fault Civil Divorce

What is no-fault divorce in the UAE?

It is a civil divorce in which an eligible spouse may ask the court to end the marriage without proving harm or blaming the other spouse. The legal ground is separate from financial, child and property issues, which may still require agreements or decisions.

The full explanation is on No-Fault Divorce in the UAE.

Which law creates federal no-fault divorce?

Federal Decree-Law No. 41 of 2022 on Civil Personal Status, supported by Cabinet Resolution No. 122 of 2023, governs the federal route. Abu Dhabi has separate local civil-family legislation and procedure that should be analysed independently.

Who can apply under the federal civil law?

The law covers non-Muslim UAE citizens and non-Muslim foreign residents within its scope, subject to applicable-law provisions. Religion, residence, jurisdiction, foreign proceedings and the marriage record should be checked before filing.

Does my spouse have to agree?

No mutual agreement is required for an eligible spouse to request no-fault divorce. The other spouse must still be properly notified and may respond on procedure or connected claims. Settlement remains useful where finances or children need agreed arrangements.

Must I prove adultery, abuse or abandonment?

Not to establish the no-fault ground for divorce. Evidence may still matter for protection, children, financial issues or another legal claim. Do not include unnecessary private allegations merely to make the divorce request appear stronger.

Do I have to attend family guidance?

The UAE Government’s official guidance states that civil-divorce cases under the Civil Personal Status Law are exempt from family-guidance referral. Court filing, service and case-management requirements still apply.

Civil Marriage in the UAE

What is civil marriage in the UAE?

It is a statutory, non-religious marriage route for people within the applicable civil-personal-status framework.

This is set out at length on Civil Marriage in the UAE.

Which federal law covers civil marriage?

Federal Decree-Law No. 41 of 2022 and Cabinet Resolution No. 122 of 2023 are primary official sources.

Who is eligible?

Eligibility depends on the framework’s stated scope and conditions. Review nationality, religion where relevant, age, status and other criteria.

Is civil marriage available in every emirate?

A federal framework exists, while Abu Dhabi also operates a specific civil-family route. Competent services and procedures must be checked.

What age is required?

The applicable route specifies its own age and capacity conditions. Confirm the selected federal or Abu Dhabi framework.

Can a person already married apply?

Current marital status is an eligibility issue. Existing marriages and final prior-divorce or death records must be disclosed.

Civil Marriage in Abu Dhabi

Who can apply for civil marriage in Abu Dhabi?

Applicants must meet the current ADJD eligibility conditions concerning consent, age, status, relationship and other stated criteria.

For the detail behind this, see Civil Marriage in Abu Dhabi.

Can tourists marry civilly in Abu Dhabi?

The official service may be available to visitors, subject to eligibility, application approval and attendance requirements.

Do both parties need to attend?

Attendance requirements depend on the selected service and current rules, including any limits on video-conference completion.

What age is required?

Current ADJD information should be checked for the selected service. Both parties must satisfy the applicable legal-capacity requirement.

Can a currently married person apply?

No application should conceal an existing marriage. Current marital status is a material eligibility issue.

What documents are required?

Passports and status records are central; additional documents, translations or authenticated records may be required.

For Non-Muslim Couples

Which UAE law applies to a non-Muslim couple?

Federal civil personal-status law may apply, while Abu Dhabi has a separate local civil-family system. Citizenship, residence, marriage and chosen route matter.

Family Lawyer for Non-Muslim Couples in Dubai covers this in full.

Is Abu Dhabi Civil Family Court available to Dubai residents?

Eligibility depends on the published Abu Dhabi criteria and case connection. Do not assume residence in another emirate creates or excludes jurisdiction without review.

Can non-Muslims obtain a civil marriage in Dubai?

The UAE Government publishes a Dubai civil-marriage service with defined conditions, including non-Muslim status and a Dubai-residence connection. Check current requirements.

What is the federal minimum age for civil marriage?

Federal Decree-Law No. 41 of 2022 states that both spouses must be at least 21. Local service conditions should be checked separately.

Can either spouse request a no-fault civil divorce?

Yes, the federal civil law gives both spouses a unilateral right to request divorce through the court, without removing related financial or child issues.

Must a civil divorce first go through family guidance?

The federal civil framework provides a direct civil-divorce route. The exact filing procedure and any local requirements should be confirmed for the competent court.

Non-Muslim Inheritance

Do non-Muslims have civil inheritance rules in the UAE?

Yes. Federal Decree-Law No. 41 of 2022 creates a civil personal-status framework for persons and matters within its defined scope.

The complete treatment is on Non-Muslim Inheritance UAE.

Can a non-Muslim leave all UAE assets to chosen beneficiaries?

Article 11 permits a qualifying testator to leave the entire UAE property by will, subject to the Executive Regulations and proper registration.

What if there is no registered civil will?

The applicable intestacy route must be established. Under the federal civil default, a spouse receives half and children share the other half equally.

Do sons and daughters inherit equally under federal civil intestacy?

Yes, the children’s half is divided equally without gender differentiation under Article 11’s spouse-and-children default.

What if the deceased had no children?

Article 11 provides a different order involving parents and, in specified circumstances, siblings. The complete family tree must be applied.

Does an unmarried partner inherit automatically?

Do not assume so. Intestacy recognises legal categories; a registered will should address an intended benefit to a partner.

Abu Dhabi No-Fault Divorce

What is a no-fault divorce in Abu Dhabi?

It is a court divorce under the Abu Dhabi civil-family framework in which an eligible spouse may ask to end the marriage without proving wrongdoing, harm or blame. Eligibility and court jurisdiction still have to be established.

More detail, and the sources behind it, on Abu Dhabi No-Fault Divorce Lawyer and Civil Court Guide.

Who can apply to the Abu Dhabi Civil Family Court?

The law and regulation identify several covered categories and Abu Dhabi connections, including qualifying civil marriages, non-Muslim UAE citizens and certain foreigners. Nationality, marriage route, residence, work, domicile and the official guidance must be checked for the specific parties.

Can a Muslim expatriate use the Abu Dhabi civil-divorce route?

Religion alone does not answer the question. ADJD states that a Muslim who is not a UAE citizen may use its civil-marriage service, while divorce coverage also depends on the marriage and statutory connection. A UAE Muslim citizen follows a different route.

Must I prove adultery, cruelty or abandonment?

Not for the no-fault status ground. The applicant expresses a continuing wish to end the marriage. Conduct may still be relevant to a separate financial, protective or child-related issue where the law permits.

Does my spouse have to consent to the divorce?

The no-fault ground is unilateral, so mutual consent to the marital breakdown is not required. The other spouse must still be lawfully notified and may raise jurisdictional, procedural and ancillary issues.

Is the divorce granted immediately after I submit the form?

No. Filing, review, approval, notice, case preparation and a court hearing are involved. A private form or message does not terminate the marriage.

Abu Dhabi Civil Family Court

Who can use the Abu Dhabi Civil Family Court?

Eligibility depends on the service and the statutory category. The local regulation covers defined foreigners and non-Muslim citizens, including marriages concluded under the Abu Dhabi civil framework and other prescribed cases. Civil-marriage guidance is broad and includes visitors, except UAE Muslim citizens. Divorce guidance uses more specific criteria. Nationality, religion where legally relevant, marriage form and an Abu Dhabi connection should be checked before filing.

The full explanation is on Abu Dhabi Civil Family Court.

Is the Abu Dhabi Civil Family Court the same as the federal civil personal-status court?

No. The Abu Dhabi Civil Family Court operates under Abu Dhabi Law No. 14 of 2021, as amended, and Resolution No. 8 of 2022. Federal Decree-Law No. 41 of 2022 and Cabinet Resolution No. 122 of 2023 create a separate federal civil personal-status framework. The eligibility, court, forms and procedural details should not be blended.

Can tourists get married through the Court?

Yes. ADJD’s official guidance states that visitors and tourists may apply for an Abu Dhabi civil marriage if the service conditions are met. Both parties must attend the ceremony, provide the prescribed identity and status documents, pay the current fee and satisfy the legal conditions. Overseas recognition may require MOFA attestation and any registration requested by the destination country or embassy.

Can a Muslim use the Abu Dhabi civil-marriage service?

ADJD states that a Muslim who is not a UAE citizen may use the civil-marriage service if the conditions are met. Muslims who are UAE citizens are excluded from that civil-marriage service. Divorce and other civil-family applications have separate eligibility rules, so a marriage-service answer should not be treated as automatic jurisdiction over every later dispute.

Must spouses prove fault to obtain a civil divorce?

No. The Abu Dhabi local civil-family law permits a spouse to request divorce without proving misconduct or damage. The applicant must still establish eligibility, jurisdiction, marriage and proper notice. Financial claims and child disputes are addressed through connected but distinct procedures. No-fault divorce removes the need to prove blame; it does not decide every consequence of separation.

Is Family Guidance required before a no-fault divorce?

Article 39 of Resolution No. 8 of 2022 excludes civil divorce and its ancillary cases under this regime from Family Guidance and sends them directly to the Court. The parties may still negotiate and submit settlement terms. If the matter belongs under a different Abu Dhabi personal-status route, other preliminary requirements may apply, which is why eligibility must be confirmed first.

How to use these answers

These answers describe the civil personal-status framework as it applies to non-Muslim families, and they are written as general information. Two cautions apply to all of them. The first is that eligibility for this framework is itself a question — it is not established simply by neither party being Muslim, and the answers below assume it has been settled. The second is that an answer that is correct in general can be wrong for a particular family once nationality, residence, an earlier marriage or a foreign order is added to the facts.

Where an answer matters to a decision you are about to take, read it alongside the instrument it rests on rather than on its own, and take advice on the facts.

Where these answers stop

Nothing on this page addresses how another country would treat the same marriage, divorce or arrangement, and several of the questions below have a foreign half that matters as much as the UAE one. Where that is your situation, the UAE answer is a starting point rather than a conclusion, and advice in the other jurisdiction is the other half of it.
