An Abu Dhabi no-fault divorce allows an eligible spouse to ask the Civil Family Court to end the marriage without proving adultery, abuse, abandonment or another matrimonial wrong. The status decision may be procedurally focused, but the overall family case can still involve disputed jurisdiction, service, financial rights, housing, child arrangements, travel, evidence and recognition in another country.

Mr AlBalooshi assists with Abu Dhabi civil-divorce eligibility, jurisdiction, case preparation, responses, related financial and child applications, urgent measures and cross-border planning. Use the inquiry form with your name, mobile, email, nationality, religion where relevant to the applicable legal route, Abu Dhabi residence or work connection, marriage place and date, children, current addresses, any agreement and every existing court case or order. You may also WhatsApp +971 50 627 5196.

Submitting an inquiry does not file a case, notify a spouse, stop a foreign proceeding or create a lawyer-client relationship. Identity, conflicts, court competence, scope, fees and formal engagement must first be confirmed.

No-fault divorce ends the marriage without a blame trial

Abu Dhabi Law No. 14 of 2021, as amended, defines divorce under the local civil-family framework as termination of marriage by the unilateral will of a spouse without the need to prove damage. Articles 6 and 7 state that either spouse may seek divorce by expressing a wish to separate and end the marital relationship, without justifying the request, proving harm or blaming the other party. ADJD Chairman Decision No. 8 of 2022 develops that framework through the Civil Marriage and Divorce Regulations.

“No fault” describes what must be shown to obtain the divorce status. It does not mean:

  • the court accepts jurisdiction automatically;
  • the marriage certificate can be incomplete or invalid;
  • lawful notification of the other spouse can be skipped;
  • every financial or child question is decided with the divorce;
  • past conduct is irrelevant to all ancillary claims;
  • an agreement or foreign order is automatically enforceable; or
  • the judgment will be recognised in every other country without further steps.

The court may end the marriage even though the former spouses continue to dispute finances, children or enforcement. A sensible strategy separates the status application from each additional remedy.

Eligibility requires the Abu Dhabi civil-family route to apply

The Civil Family Court is a specialised Abu Dhabi court. Its local law and regulation should not be generalised to divorce proceedings in Dubai or the other emirates.

The current regulation describes persons covered by the law and several connecting routes. They include non-Muslim UAE citizens, certain foreigners assessed by the family-law system connected to their nationality, marriages concluded in a country whose family law is not mainly based on Islamic law, marriages concluded under the Abu Dhabi civil-marriage framework and any further category authorised by the competent Chairman’s decision. The official ADJD public guidance also identifies Abu Dhabi residents and people married through the Abu Dhabi Civil Family Court, subject to the stated nationality or legal-system conditions. For some Arab League nationals, ADJD says official proof of religion may be requested.

Eligibility should therefore be checked from documents, not assumed from one fact. Relevant questions include:

  • Was the marriage concluded through the Abu Dhabi Civil Family Court?
  • Where and under which law was another marriage concluded?
  • What nationality or nationalities does each spouse hold?
  • Which passport or nationality is used for UAE residence where multiple nationalities exist?
  • Is either spouse a UAE national, and if so, are they non-Muslim?
  • Does a spouse live, work or have a domicile in Abu Dhabi?
  • Where is the respondent, and can lawful service be completed?
  • Is a connected claim for financial rights or child arrangements also proposed?

A party should not select this court merely because a no-fault procedure appears simpler. Filing in a court without jurisdiction can cause delay, cost and conflicting proceedings.

Court competence is separate from the no-fault ground

Articles 3 and 4 of Decision No. 8 of 2022 address subject-matter and territorial jurisdiction. The Civil Family Court may hear civil-family matters within the regulation, including divorce and its effects, interim measures, joint custody and post-divorce financial claims. Territorial connections in the regulation include residence, work, domicile, an Abu Dhabi civil marriage, certain Abu Dhabi assets and defined circumstances involving a claimant or defendant connected with the emirate.

The court is required to examine its competence. A respondent may challenge jurisdiction even if they cannot force the claimant to prove blame for the marital breakdown. Parallel proceedings abroad, an exclusive foreign property issue or a dispute about which family regime applies may require a coordinated forum analysis.

Before filing, prepare a short jurisdiction schedule listing every connection to Abu Dhabi and every case elsewhere. Do not omit an address, nationality, order or proceeding because it appears inconvenient.

The Abu Dhabi civil route must not be mixed with other UAE divorce regimes

Three legal routes regularly cause confusion:

Route Core question Important distinction
Abu Dhabi civil-family law Does Law No. 14 of 2021 and Decision No. 8 of 2022 cover the parties, marriage and court connection? Local Abu Dhabi framework with its own bilingual forms and civil procedures
Federal civil personal status Does Federal Decree-Law No. 41 of 2022 and Cabinet Resolution No. 122 of 2023 apply? Separate federal UAE civil regime; it is not the Abu Dhabi local law
Federal Personal Status Law Does Federal Decree-Law No. 41 of 2024 govern the parties or claim? Different substantive scope and procedure, including Muslim personal-status matters

The label “non-Muslim divorce” does not answer the whole question. A foreign Muslim may be able to marry civilly in Abu Dhabi in circumstances stated by ADJD, while a UAE Muslim citizen is outside the civil-marriage service described by ADJD. Nationality, religion, marriage route and jurisdiction must be considered together and with the current official guidance.

Initial documents should prove marriage, identity and jurisdiction

ADJD’s current public guidance identifies a marriage certificate and identity documents as core materials. A prepared file may also require:

  • complete marriage certificate in English and Arabic where available;
  • MOFA-attested foreign marriage certificate where required by the court;
  • full passports and Emirates IDs;
  • UAE residence, work or domicile evidence supporting Abu Dhabi competence;
  • current physical and electronic address information for both spouses;
  • proof of any name, nationality or civil-status change;
  • existing prenuptial, postnuptial or settlement agreement;
  • prior UAE or foreign judgments, interim orders and pending case details;
  • children’s identity and birth documents if related relief may follow;
  • a schedule of assets, liabilities, income and urgent needs for a financial application; and
  • certified or official translations directed by the court.

Do not upload only a cropped certificate or a screenshot from a foreign portal. The court may need the complete document, authentication chain and proof that it is final. If the marriage occurred outside Abu Dhabi, check whether the issuing authority, foreign ministry, UAE mission and MOFA steps are required.

The divorce application follows a bilingual court process

Decision No. 8 of 2022 provides for a civil-divorce claim using the bilingual form, submitted by the person concerned or a special representative. The regulation requires payment of the prescribed fee, court review of the application and documents, and particular attention to jurisdiction.

If the application is approved, the regulation provides for a hearing and lawful notice to both spouses. The case manager reviews the claim and attachments, addresses preparation and refers urgent requests to the judge. The defendant may use the designated response form, including to raise a jurisdiction objection. At the hearing, the judge confirms the attending claimant’s continuing wish to divorce before giving the status ruling.

The ADJD Civil Family Court page states that both parties or their legal representatives attend the case-management session. Current filing channels, UAE Pass requirements, form versions, fees, session method and attendance directions should be verified when the case is prepared. Do not rely on an old screenshot or an unofficial checklist.

The regulation contains a stated court fee of AED 5,000 for the civil-divorce application. Court fees and service channels can change; verify the amount displayed by ADJD at the filing date and distinguish it from lawyer, translation, attestation, expert, notice and enforcement costs.

First-hearing divorce is a legal procedure, not an instant private declaration

The law and regulation describe divorce at the first hearing without referral to Family Guidance. This does not mean that a private message, signed website form or unilateral declaration immediately ends the marriage. A court judgment is required.

The regulation states that the hearing is scheduled at least 30 days after approval of the request and includes notice and case preparation steps. ADJD’s public page says the court aims to finalise the case within one month from registration. That is an official service aim, not a guaranteed deadline. Incorrect jurisdiction, incomplete documents, service problems, technical filing issues or related applications can affect the actual timetable.

Do not plan remarriage, immigration changes, travel or foreign recognition around an assumed date. Wait for the official judgment, confirm its status and obtain the documents required for the next authority.

A respondent can raise procedural and jurisdictional issues

No-fault divorce does not require the respondent’s agreement to the marital breakdown, but the respondent retains procedural rights. Depending on the facts, a response may address:

  • whether the Civil Family Court has subject-matter and territorial jurisdiction;
  • whether the parties fall within the local civil-family framework;
  • authenticity or completeness of the marriage document;
  • identity and nationality discrepancies;
  • whether notice was properly served;
  • the existence of another divorce, appeal or reconciliation;
  • urgent interim applications;
  • preservation of financial claims and evidence; and
  • separate child-arrangement or financial proceedings.

The respondent should not ignore court notifications because the status ground is no fault. Missing a response or hearing can affect the opportunity to present jurisdictional facts, secure records and make related applications.

Family Guidance is excluded for this local civil procedure

Article 15 of Law No. 14 of 2021 and Article 39 of Decision No. 8 of 2022 exclude civil divorce and its ancillary cases from referral to Family Guidance. This is a defining difference from routes in which family-guidance or reconciliation procedures may precede court litigation.

The exclusion does not prevent spouses from negotiating responsibly. They may still explore a written settlement, mediation or other permitted consensual process. Any agreement should be precise about status, money, children, performance dates and enforcement. A settlement should not be described as ending the marriage unless the competent court has issued the divorce judgment.

Financial rights are usually a separate post-divorce application

ADJD’s guidance says that a party unable to reach an amicable financial settlement may use the post-divorce application for a financial order after issuance of the divorce judgment. This is a separate case from the no-fault divorce application.

The local regulation addresses financial rights, possible lump-sum compensation, housing, provisional alimony, child expenses and accounting-expert evidence. The court’s assessment can involve marriage duration, age, health, education, income, wealth, career decisions, financial dependency, living standard, children’s needs, contributions and conduct relevant under the particular financial provision.

Accordingly, “no fault” for the divorce status does not erase evidence about financial consequences. Preserve bank statements, salary records, company interests, property documents, liabilities, spending, childcare, education and healthcare records. Do not transfer assets, destroy messages or create artificial liabilities in anticipation of proceedings.

Read Abu Dhabi Post-Divorce Financial Orders for the separate financial route.

Children are not decided by the no-fault label

Under the Abu Dhabi civil-family framework, joint custody is the general post-divorce position, subject to waiver, challenge and court determination. The regulation distinguishes legal custody—major decisions about matters such as health and education—from physical custody and schedules.

If parents agree, their parenting terms should address school weeks, holidays, handovers, health decisions, information sharing, travel, passports, costs and communication. If they disagree, a separate child-custody application may be needed. The court can consider the child’s best interests and may make interim arrangements.

Neither parent should treat “automatic joint custody” as permission to travel internationally without the required consent or court permission. The regulation has specific child-travel and travel-ban provisions. Urgent safety issues require evidence and the proper application, not self-help.

See Joint Custody and Passports, Travel Consent and Child Travel Bans for focused guidance.

Urgent measures can run alongside the main case

Article 42 of Decision No. 8 of 2022 identifies provisional and urgent orders that may be sought in appropriate cases. They can include temporary financial support, temporary housing or utility restoration, interim child arrangements, temporary permission or restriction on child travel, return of personal documents and protective seizure.

An urgent request needs a clear legal basis, specific relief and reliable evidence. Explain what happened, why ordinary timing is inadequate, what immediate harm is feared and how the proposed order is proportionate. Do not exaggerate risk or ask a private website to contact the court or police on your behalf.

If anyone faces immediate danger, contact the competent emergency authority. A web inquiry does not obtain protective relief.

English-language procedure has defined limits

Article 44 of the regulation permits the court, in its discretion, to conduct litigation in English where both parties do not speak Arabic. The claim form and judgment remain bilingual. The regulation also addresses departmental translation of English documents subject to a service fee.

This is not a general exemption from accurate documents. A party should still provide complete, legible originals and comply with directions about translation, attestation and formatting. Documents in a language other than English or Arabic may require certified translation.

A party may appear in person or through an authorised lawyer. A foreign lawyer may represent a litigant only after meeting the separate ADJD licensing and roll requirements stated in Article 45. A foreign-law adviser is not automatically authorised to appear in the case.

Cross-border planning should begin before the UAE judgment

An Abu Dhabi divorce judgment may need to update civil status, immigration, tax, pension, land, company or family records abroad. Recognition requirements vary. Another country may ask for a certified judgment, proof of finality, service records, legalisation, translation or evidence that the Abu Dhabi court had jurisdiction under its rules.

MOFA attestation confirms the authenticity of signatures and seals; it does not guarantee foreign recognition. Obtain destination-country advice before filing where possible, particularly if the family has another nationality, a foreign matrimonial agreement, property abroad or parallel proceedings.

Use Enforcing UAE Orders Abroad and Recognition of Foreign Marriages and Divorces to plan the document chain in both directions.

Keep a reliable chronology and notification record

A concise chronology helps the court and legal team separate status facts from later financial or child disputes. Record the marriage date, each period of residence, separation date, changes of address, earlier proceedings, service attempts, urgent events and the date each official document was obtained. Link every entry to a source document rather than relying on memory alone.

Notification details deserve particular care. Preserve the respondent’s known home, work, email and telephone information, previous correspondence and any official evidence of relocation. Do not use an address known to be obsolete merely to accelerate the case. If ordinary service is unsuccessful, follow the court’s authorised alternative procedure and retain the orders and reports supporting it. A clean service record may also be important when the Abu Dhabi judgment is presented to a foreign authority.

Prepare the case in a practical sequence

Preparation is more manageable when the case is broken into six decision areas rather than approached as one application:

  1. Legal route: local Abu Dhabi civil, federal civil or federal Personal Status.
  2. Jurisdiction: marriage, residence, work, domicile, assets and respondent connections.
  3. Documents: marriage, identity, nationality, service, translation and attestation.
  4. Status case: application, response, attendance and judgment.
  5. Related relief: finances, children, housing, travel and urgent measures.
  6. Cross-border effect: records and countries where the judgment must later operate.

The map does not predict eligibility or an outcome. It shows which facts and records are confirmed, missing or require legal review.

Frequently asked questions

What is a no-fault divorce in Abu Dhabi?

It is a court divorce under the Abu Dhabi civil-family framework in which an eligible spouse may ask to end the marriage without proving wrongdoing, harm or blame. Eligibility and court jurisdiction still have to be established.

Who can apply to the Abu Dhabi Civil Family Court?

The law and regulation identify several covered categories and Abu Dhabi connections, including qualifying civil marriages, non-Muslim UAE citizens and certain foreigners. Nationality, marriage route, residence, work, domicile and the official guidance must be checked for the specific parties.

Can a Muslim expatriate use the Abu Dhabi civil-divorce route?

Religion alone does not answer the question. ADJD states that a Muslim who is not a UAE citizen may use its civil-marriage service, while divorce coverage also depends on the marriage and statutory connection. A UAE Muslim citizen follows a different route.

Must I prove adultery, cruelty or abandonment?

Not for the no-fault status ground. The applicant expresses a continuing wish to end the marriage. Conduct may still be relevant to a separate financial, protective or child-related issue where the law permits.

Does my spouse have to consent to the divorce?

The no-fault ground is unilateral, so mutual consent to the marital breakdown is not required. The other spouse must still be lawfully notified and may raise jurisdictional, procedural and ancillary issues.

Is the divorce granted immediately after I submit the form?

No. Filing, review, approval, notice, case preparation and a court hearing are involved. A private form or message does not terminate the marriage.

Is Family Guidance required first?

The Abu Dhabi local civil-family law and regulation exclude civil-divorce and ancillary cases from Family Guidance. This distinction should not be transferred to other UAE divorce routes.

What documents normally start the case?

The marriage certificate, passports and Emirates IDs are core documents. Foreign marriage, jurisdiction, name, nationality, service and related-relief issues may require additional records, translation and attestation.

Can I file if we married outside Abu Dhabi?

Potentially, but an outside marriage requires a careful eligibility, jurisdiction and document review. Place and law of marriage, nationalities, Abu Dhabi connections and current ADJD criteria all matter.

Are financial claims decided in the divorce case?

ADJD describes a separate post-divorce application for a financial order when the spouses do not settle. Do not assume the status judgment resolves support, compensation, property or liabilities.

What happens to children after the divorce?

Joint custody is the general rule under this local framework, subject to agreement, waiver, objection and the child’s best interests. A separate child-custody dispute application may be required.

Can I ask for temporary support or a travel restriction?

The regulation provides for defined urgent and provisional applications. The court assesses necessity, evidence, jurisdiction and proportionality; relief is not automatic.

Can proceedings be conducted in English?

The regulation permits English procedure in defined circumstances at the court’s discretion, with bilingual forms and judgment. Comply with current directions for translation and document format.

Can I handle the case through a power of attorney?

The regulation permits filing by a special representative and representation by an authorised lawyer. The power of attorney and attendance requirements must match the requested acts and current court directions.

Will another country recognise the Abu Dhabi divorce?

That depends on the destination country’s law, jurisdiction standards, service, finality, document form and any applicable treaty. MOFA attestation alone does not guarantee recognition.
