An Abu Dhabi post-divorce financial order can address the economic consequences of a civil divorce, including a lump sum, periodic alimony, housing, property adjustment, child support, interim relief or an amendment to an existing financial order. It is a separate legal exercise from obtaining the no-fault divorce judgment. The court must first have jurisdiction, the correct Abu Dhabi civil-family regime must apply, and the requested relief must be supported by reliable financial evidence.

Mr AlBalooshi assists with eligibility and jurisdiction analysis, post-divorce applications and responses, financial disclosure, accounting-expert work, urgent support, settlement terms, enforcement and cross-border asset issues. Use the inquiry form to identify the divorce judgment, marriage duration, children, each spouse’s nationality and location, monthly income, businesses, property, investments, liabilities, existing agreements and the exact order required. You may also WhatsApp +971 50 627 5196.

Submitting an inquiry does not file an application, freeze assets, suspend a deadline or create a lawyer-client relationship. Identity, conflicts, court competence, scope, fees and formal engagement must be confirmed first.

The financial application follows the civil-divorce judgment

Abu Dhabi Judicial Department’s current Civil Family Court guidance states that a spouse who cannot reach an amicable financial settlement may use the official post-divorce application for a financial order after the divorce judgment has been issued. Article 8 of Abu Dhabi Law No. 14 of 2021, as amended, addresses financial claims arising from divorce. ADJD Chairman Decision No. 8 of 2022 provides the more detailed procedural and assessment framework.

This sequencing matters. A no-fault divorce determines marital status without requiring proof of blame. It does not automatically distribute every asset, settle child expenses or calculate continuing support. A claimant should therefore distinguish:

  • the divorce judgment ending the marriage;
  • a post-divorce financial application;
  • any urgent or provisional request;
  • a child-custody or parenting dispute;
  • enforcement of an existing order; and
  • recognition or enforcement involving another country.

Filing the wrong form, combining incompatible remedies or assuming that the divorce order already resolved money can delay practical relief. Read Abu Dhabi No-Fault Divorce for the status process.

Confirm the Abu Dhabi civil-family regime before valuing the claim

The local Abu Dhabi framework is not a general formula for every UAE divorce. Decision No. 8 of 2022 identifies categories covered by the law and territorial connections to the court. The analysis can turn on nationality, religion where legally relevant, the legal system of a nationality, where the marriage was concluded, whether it was an Abu Dhabi civil marriage, residence, work, domicile, the claimant’s connection to Abu Dhabi and the location of disputed property.

The financial route must be kept distinct from:

Legal route Financial framework Important caution
Abu Dhabi civil-family law Law No. 14 of 2021 and Decision No. 8 of 2022 Local rules, bilingual forms and a specific accounting-expert framework
Federal civil personal status Federal Decree-Law No. 41 of 2022 and Cabinet Resolution No. 122 of 2023 Separate civil regime outside the local Abu Dhabi framework where applicable
Federal Personal Status Law Federal Decree-Law No. 41 of 2024 Different rules for Muslim personal-status rights, including mahr, iddah and maintenance

Terms such as alimony, maintenance and compensation may appear across regimes but do not necessarily have the same legal basis, duration or calculation. The marriage certificate and divorce judgment should be reviewed before any estimate is discussed.

Orders available depend on the pleaded facts and evidence

The official ADJD application form allows an applicant to identify the remedy sought. The listed options include a lump sum, monthly alimony, interim alimony pending the final order, a clean-break arrangement, property adjustment, child support, amendment of an existing financial order and other relief.

Those labels do not guarantee that a particular order will be made. The court has discretion under the local framework. The application should connect each requested remedy to facts, documents and a workable proposed order. For example:

  • a lump-sum claim should state its legal basis, calculation and payment proposal;
  • a monthly support claim should show actual needs and the payer’s capacity;
  • housing relief should identify the current home, reasonable alternative and utilities;
  • property adjustment should identify ownership, value, finance and the precise adjustment sought;
  • child support should separate education, housing, healthcare, residence and recurring costs;
  • interim relief should explain urgency and why waiting for the final determination creates harm; and
  • an amendment request should identify the existing order and the material change relied upon.

A broad demand for “half of everything” or a percentage copied from an online summary is not a substitute for a pleaded case.

The court considers a wide financial and family picture

Articles 15 and 16 of Decision No. 8 of 2022 give the court discretion to assess financial rights and possible lump-sum compensation. The regulation identifies a detailed set of factors. Depending on the claim, they include:

  • total years of marriage and the spouses’ ages;
  • each spouse’s contribution to the end of the marital relationship where relevant to the provision relied upon;
  • material or moral damage and gains lost because of the marriage or divorce;
  • each spouse’s economic, financial and social position;
  • education and qualifications;
  • career sacrifice connected with raising children or a pre-marriage restriction on work;
  • the standard of living during the marriage;
  • a wife’s contribution to the husband’s wealth;
  • health, employment and ability to work;
  • financial position at divorce;
  • wealth and available income;
  • the number and ages of children and their need for care; and
  • differences in income and financial dependency.

The importance of a factor depends on the particular remedy and evidence. The court retains discretion. Conduct should not be treated as a route to re-litigate the divorce merely to punish a former spouse; it must be relevant under the legal provision and proved lawfully.

The regulation’s calculation criteria are guidance, not a guaranteed award

Article 18 of Decision No. 8 of 2022 states that the court and expert may be guided by specified calculation criteria. The text refers, among other matters, to a percentage of the husband’s last monthly income, the number of years of marriage, property and wealth, and a joint account and the spouses’ participation in it. The regulation also expressly preserves the court’s power to increase or reduce an amount and determine calculation, payment or instalments according to the divorce circumstances and expert findings.

The percentage language should therefore not be advertised as an automatic entitlement or a prediction. Questions remain about the remedy claimed, the spouses’ circumstances, the evidence accepted, the expert’s analysis and the judge’s determination. Any estimate should be presented as a scenario, not a promise.

Financial disclosure should be complete, consistent and traceable

The official post-divorce financial-order form asks for occupation, monthly salary, allowances, other income, outgoings, child-related costs, assets and liabilities. It instructs applicants to state monthly amounts in UAE dirhams and to attach supporting material.

The form’s document checklist includes Emirates ID, passport, employment contract, six months of statements for all bank accounts, the latest credit-card statements, tenancy contract, property title and mortgage statement, and an expert report if already obtained. A more complex case may also need:

  • salary certificates, bonus and commission history;
  • end-of-service benefit, pension or share-plan documents;
  • company registers, audited accounts, management accounts and shareholder records;
  • real-estate valuations and finance statements;
  • brokerage, cryptocurrency and investment records;
  • loan agreements and evidence of the use of borrowed funds;
  • insurance, trust, nominee or beneficial-ownership documents;
  • school, nursery, medical, therapy, visa and childcare invoices;
  • evidence of rent, utilities and the former marital standard of living;
  • marriage, prenuptial, postnuptial and settlement agreements; and
  • records of transfers, gifts or asset disposals around separation.

Use one schedule with columns for owner, location, currency, current value, valuation date, debt, net value and supporting document. Convert foreign amounts consistently and record the exchange-rate source and date. Do not hide an asset because it is abroad or omit a liability because the other spouse disputes it.

Accounting experts can shape the evidential record

Articles 15 and 17 permit reliance on an accounting expert. The expert may assess income, wealth, assets, liabilities and the overall financial position, then report on compensation or support issues within the assignment.

Expert work is not a private negotiation. Parties should read the appointment decision, understand the questions referred and submit indexed evidence within the permitted timetable. A useful expert submission:

  1. identifies each issue in the appointment;
  2. states the applicant’s or respondent’s position briefly;
  3. provides calculations that can be reproduced;
  4. links every amount to a numbered exhibit;
  5. separates fact, assumption and disputed inference;
  6. explains foreign currency and valuation dates; and
  7. identifies missing information and the lawful request needed to obtain it.

If an expert calculation appears wrong, respond with documents and arithmetic. Personal attacks or an unsupported alternative number rarely resolve the evidential problem.

Housing and child costs require separate analysis

Articles 19 and 20 of Decision No. 8 of 2022 address housing connected with joint custody and temporary housing support for a divorced woman. Relevant considerations include the children’s pre-divorce living standard, location of the new home, basic utilities, the mother’s financial position and the father’s means. The court may assess whether suitable housing can be rented or owned and whether a full or partial allowance is justified.

Articles 23 and 24 address the father’s duty to spend on children after divorce and the court’s assessment powers. The text identifies education, residence-related fees, treatment and other daily or periodic expenses previously provided. The court may adjust the amount and method of payment with reference to the expert assessment and the family’s circumstances.

Child support is not simply a percentage of one parent’s salary. Prepare a child-by-child budget, distinguish annual from monthly expenses and remove duplication. A school fee paid directly should not also appear as a cash reimbursement unless the proposed order explains the treatment.

See Child Maintenance for broader UAE planning and Education and Health Decisions for decision-making issues.

Interim relief may protect immediate needs

Article 21 permits a divorced woman to request provisional alimony pending final determination of financial rights. The regulation refers to documents showing both spouses’ monthly income, including bank statements for the preceding six months, and allows the court to consider whether the applicant has stable income meeting basic needs.

Article 42 separately identifies provisional and urgent measures, including temporary support, temporary housing or restoration of utilities, protective seizure, temporary child arrangements and return of personal documents or belongings.

An urgent application should be narrow. It should identify:

  • the immediate need or threatened harm;
  • the amount or measure requested;
  • the period for which it is required;
  • evidence of income, expenses and non-payment;
  • why ordinary case timing is inadequate; and
  • why the requested order is proportionate.

An inquiry form or WhatsApp message does not obtain emergency relief. If there is immediate danger, contact the competent emergency authority.

Settlement can reduce issues but must be drafted for enforcement

ADJD publishes a post-divorce settlement-agreement form. A sound settlement should define assets, transfers, releases, support, child costs, housing, payment dates, currency, bank charges, default consequences, disclosure assumptions and the treatment of future changes.

“Clean break” language needs particular care. It should state which claims are released, what property each party retains, which obligations survive and how the agreement will become a court order or otherwise enforceable. Child-related provisions may remain subject to the child’s interests and the court’s powers. A private agreement should not be presented as binding on every foreign authority without recognition analysis.

Read Divorce Settlement Agreements and Financial Settlements for preparation points.

Cross-border assets add ownership, valuation and enforcement questions

An Abu Dhabi financial claim may involve overseas property, foreign businesses, pensions, trusts, digital assets or accounts. The court’s jurisdiction over the parties does not mean every foreign registry will implement an Abu Dhabi order directly.

For each foreign asset, identify legal title, beneficial ownership, governing documents, value, debt, transfer restrictions, tax consequences and the country where enforcement would occur. Obtain destination-country advice before asking for an order that may be impossible to register or that creates unintended tax or regulatory consequences.

Foreign documents may need authentication and translation. The UAE Ministry of Foreign Affairs attestation service authenticates eligible documents; it does not decide matrimonial ownership or guarantee recognition abroad.

Enforcement and appeal rights require prompt review

Decision No. 8 of 2022 gives the court authority to follow and enforce its judgments. Articles 47 and 48 address immediate enforcement and protective measures, including protective seizure, travel restrictions and bank deduction in the circumstances stated in the regulation.

Article 49 states that a post-divorce financial or alimony judgment below AED 500,000 is final and enforceable when issued. Article 50 identifies limited grounds on which judgments under Article 49 may be challenged, including jurisdiction and invalidity affecting the decision. The exact route and deadline must be checked from the judgment, service record and current procedural law immediately. “Final” does not mean that enforcement happens without the necessary file, notice, asset information or court directions.

Use Family Judgment Enforcement for the enforcement framework and Family Law Appeals for procedural review.

Prepare a focused instruction pack for Mr AlBalooshi

A financial application is only as good as the records behind it. To make an initial review useful, gather:

  1. the marriage certificate, divorce judgment and proof of finality if available;
  2. every marriage or settlement agreement;
  3. a one-page chronology;
  4. a schedule of requested orders;
  5. a complete asset and liability schedule;
  6. six months of statements for every account, plus longer records where a transaction is disputed;
  7. income, employment, company and investment documents;
  8. a monthly personal and child budget with invoices;
  9. evidence of housing and urgent needs;
  10. all existing applications, orders and expert communications; and
  11. a list of foreign assets, proceedings and enforcement countries.

Do not send original passports, altered statements or passwords through a website form. Redact only after preserving a complete evidential copy and obtaining instructions about what the court or expert requires.

Frequently asked questions

Is the financial order included automatically in an Abu Dhabi no-fault divorce?

No. ADJD’s public guidance describes the post-divorce financial order as a separate application made after the divorce judgment when the parties have not reached an amicable settlement.

Can either former spouse seek a lump-sum order?

Decision No. 8 of 2022 states that the judge may, at the court’s discretion, compel either spouse to pay a lump sum to the other after divorce. The facts, legal basis and evidence determine whether relief is available.

Does the regulation guarantee a fixed percentage of salary or assets?

No. Article 18 contains criteria by which the court and expert may be guided, but it also preserves judicial discretion to increase, reduce and structure the amount according to the case and expert findings.

What financial records does the official form request?

The official form asks about income, allowances, other income, outgoings, child costs, assets and liabilities. Its checklist includes identity documents, employment contract, six months of bank statements, credit-card statements, tenancy, property and mortgage records, and any existing expert report.

Can the court appoint an accounting expert?

Yes. The regulation permits an accounting expert to assess the spouses’ financial position. Parties should submit complete, indexed and reconcilable evidence addressing the expert’s assigned questions.

Can I request temporary alimony before the final order?

The regulation permits provisional alimony and other interim measures in appropriate cases. The applicant should prove immediate need, income, expenses and why final determination cannot safely be awaited.

Can the court order temporary housing?

Yes. The local framework addresses housing support and provisional housing measures. The court may consider pre-divorce living conditions, children’s needs and each spouse’s financial position.

Is child support part of the same calculation as former-spouse support?

It should be analysed separately. The regulation specifically addresses child education, residence-related charges, treatment and recurring costs. A clear order should avoid duplicated expenses.

What if one spouse owns a company?

The company interest, income, retained earnings, shareholder loans and control may all be relevant, depending on the claim. Corporate documents and a defensible valuation are usually more useful than an unsupported estimate.

Are overseas assets ignored?

No. They should be disclosed where relevant. However, ownership, valuation, foreign law and enforceability may require separate advice in the country where the asset is located.

Can we file a settlement instead of litigating every issue?

ADJD provides a post-divorce settlement form. The settlement should be complete, informed and drafted so payment, property, releases, child costs and default consequences are clear.

Can an existing financial order be amended?

The official form includes amendment of an existing financial order, and the local law addresses modification of alimony as circumstances evolve. The applicant must identify the existing order and the legally relevant change.

What happens if the respondent hides or transfers assets?

Preserve lawful evidence and seek advice promptly. Depending on proof and urgency, disclosure requests, expert analysis or protective measures may be considered. Do not access accounts unlawfully or make unsupported fraud allegations.

Is every order under AED 500,000 unchallengeable?

Article 49 states that qualifying judgments below AED 500,000 are final and enforceable when issued, while Article 50 identifies limited challenge grounds. The judgment and procedure require immediate individual review.

Can Mr AlBalooshi give a reliable case assessment from a few figures?

A preliminary issue map is possible, but a responsible assessment requires the divorce judgment, agreements, financial disclosure, requested remedies, jurisdiction facts and any urgent or foreign element. No outcome or amount can be guaranteed.
