Tell us briefly about your family-law matter and how we may contact you. Your details are handled under the Privacy Policy. Sending this form does not create a lawyer–client relationship.
Please do not upload passports, Emirates IDs, children’s identity documents, intimate evidence, complete financial records or original documents. If a document is needed to understand your enquiry, attach one only, and send anything further through a secure route agreed with the office.
A family lawyer for business owners in Dubai must separate personal-status rights from company ownership, asset title, trust or foundation structures, pensions, end-of-service benefits and succession arrangements. A divorce court does not become a universal commercial court merely because spouses own a business. The case needs a coordinated map of legal regimes, assets, control, evidence and enforceability.
Mr AlBalooshi assists business owners, founders, executives, investors and high-net-worth families with confidential UAE family-law assessment, financial disclosure, settlement planning, urgent applications, child arrangements and cross-border coordination within the accepted engagement. Use the inquiry form or WhatsApp +971 50 627 5196.
Business-owner family cases require a legal and financial control map
Begin with what exists, who legally owns it and who controls access. The map should list each company, branch, partnership, foundation, trust, property, bank or investment account, digital asset, pension, insurance policy, loan and guarantee. For every item, record the jurisdiction, registered owner, beneficial interest, acquisition date, source of funds, current value evidence and any restriction on transfer.
Then record control separately. A spouse may be a shareholder but not a director, a director but not the beneficial owner, a signatory without ownership, or a beneficiary without management power. Those distinctions affect what a family settlement can lawfully promise and which approvals are needed.
A useful opening pack contains:
- the marriage contract and any pre- or postnuptial agreement;
- group structure and organisation charts;
- company constitutional documents and share registers;
- recent audited or management accounts;
- bank, brokerage and investment statements;
- property title and financing documents;
- pension and end-of-service records;
- wills, trusts, foundations and nominations; and
- a chronology of major transfers, distributions and loans.
This is a classification exercise, not an invitation to disclose irrelevant client or employee data.
Personal-status law and company law must remain distinct
The applicable UAE family regime may be Federal Decree-Law No. 41 of 2024, the federal civil personal-status law for qualifying non-Muslims, or an Abu Dhabi civil-family route. That regime determines the family-law claims. The status and transfer of company shares are governed through the company’s own jurisdiction, constitutional documents and applicable commercial law.
Federal Decree-Law No. 25 of 2025 is the current federal Commercial Companies Law. Free-zone or financial-centre entities can have different rules. A family court settlement stating that “the business goes to one spouse” may still require a share transfer instrument, board or shareholder approval, regulatory consent, register update, financing consent and release from guarantees.
Map each proposed family outcome to the separate implementation step. If the business is in DIFC, ADGM or another free zone, obtain advice on the entity’s governing regulations. If it is foreign, destination-country counsel may be required. The cross-border asset division guide explains this sequencing.
Company valuation is different from money available for settlement
Revenue, profit, cash in the bank and shareholder value are not the same. A profitable business may have restricted cash, working-capital needs, debt, contingent liabilities or minority discounts. A high turnover does not establish a spouse’s available income, and a historic investment round does not necessarily establish today’s value.
A valuation brief should identify the valuation date, purpose, legal interest being valued, methodology, information available and assumptions. It may consider maintainable earnings, assets, debt, market evidence, shareholder rights, key-person risk, related-party balances and liquidity. The family lawyer should ensure the expert answers the legally relevant question rather than producing a general corporate report.
Where one spouse controls records, a staged disclosure request can be more effective than demanding every company document. Start with ownership, accounts, tax filings, bank statements, management reporting and material transactions. Expand only where gaps or inconsistencies justify it.
Financial disclosure should be complete, proportionate and secure
High-value cases often involve information that is commercially sensitive but legally relevant. The proper response is controlled disclosure, not concealment. Use a numbered data room or document index, restrict access, identify confidentiality concerns and ask for appropriate procedural protections where available.
Do not alter records, delete messages, move assets to defeat a claim, backdate agreements or create artificial debts. Those steps can create adverse evidential and legal consequences. Equally, do not take entire servers, customer databases or privileged advice merely because a spouse can access the office.
Useful disclosure usually includes personal statements, declared remuneration, dividends, director loans, related-party balances, significant transactions and evidence of beneficial ownership. Redaction may be appropriate for unrelated third-party details, but it should not remove material information. The evidence in UAE family cases guide provides a practical structure.
Lawful asset preservation is not the same as hiding assets
Asset preservation means protecting value through lawful governance, suitable insurance, controlled signing authority, accurate records, enforceable agreements and proportionate interim relief. It does not mean transferring assets after a dispute to frustrate a spouse or court.
If there is evidence of imminent dissipation, identify the asset, owner, proposed transaction, timing and supporting documents. An urgent application should request a measure no wider than necessary. A vague fear that “everything may disappear” is less useful than a signed sale instruction, unusual transfer, threatened liquidation or removal of access.
Operational continuity also matters. A request that freezes all company payments may harm employees, creditors and enterprise value. Consider whether restricted transactions, notice requirements, dual approval, information access or preservation of specified proceeds would address the risk more proportionately. See emergency interim orders.
Owner remuneration and personal maintenance need an accurate bridge
Business owners may receive salary, allowances, dividends, drawings, management fees, loans or non-cash benefits. These streams should be identified without treating company turnover as personal income. Conversely, a deliberately low salary may not present the whole financial picture if the owner controls distributions or personal expenses are paid by the company.
Prepare a bridge from company accounts to personal means. Reconcile remuneration, dividends, shareholder loan movements, benefits and material personal expenses. Explain one-off items and business seasonality. For the recipient’s needs, use a supported household and child budget rather than a rounded figure derived from lifestyle impressions.
Maintenance is decided under the applicable personal-status regime. For non-Muslim civil cases, the legislation and executive regulation set financial factors. For Muslim cases, the 2024 Personal Status Law applies within its scope. The alimony and maintenance guide explains the different evidential questions.
Pensions and end-of-service benefits require scheme-specific analysis
A pension, gratuity, savings plan and end-of-service benefit can have different legal characteristics, vesting rules, payment triggers and transfer restrictions. Do not assume that a future benefit is available for immediate division or that a past payment can be ignored. Obtain the scheme rules, employment history, current statement, beneficiary nomination and evidence of any payment.
For UAE-national pension rights, official GPSSA rules and procedures may be relevant. For expatriates, federal labour law, free-zone employment rules or an employer plan may govern. DIFC and ADGM employment arrangements can differ from onshore employment. Foreign pensions require advice in the scheme jurisdiction.
The family settlement should state whether a benefit is included in disclosure, how it is valued, when a payment is due and whether implementation requires employer or authority action. Read pensions, end-of-service benefits and divorce before proposing a formula.
Cross-border assets create recognition and enforcement questions
An asset schedule may span UAE mainland companies, free-zone entities, overseas property, foreign trusts, investment accounts and digital assets. The UAE court’s jurisdiction and the foreign state’s recognition rules must be assessed for each class. One order may establish an obligation between spouses but still require local transfer or enforcement steps where the asset is situated.
Before final settlement wording, ask local counsel:
- Will the UAE order be recognised?
- What service, finality and translation evidence is required?
- Can the order transfer title, or must a spouse sign a local instrument?
- Are tax, regulatory, exchange-control or consent issues triggered?
- What happens if implementation is late or refused?
Federal Decree-Law No. 42 of 2022 governs UAE civil procedure, including execution of foreign judgments. It does not make every foreign order automatically enforceable. See enforcing UAE orders abroad and foreign judgments in the UAE.
Settlement design should protect liquidity and enforceability
The strongest settlement is not always the one with the largest headline number. It is the one that can be implemented without ambiguity. Consider cash availability, financing, security, payment dates, valuation adjustments, tax advice, approvals and default remedies. If payments are deferred, identify interest if lawful and agreed, reporting, security and events of default.
Where business interests are retained by one spouse, the settlement may need releases from guarantees, resignation documents, access termination, confidentiality, intellectual property and a timetable for corporate filings. Where spouses remain co-owners, define governance, information rights, deadlock, distributions, transfer restrictions and exit mechanisms in the correct corporate documents.
Child support and parenting arrangements should not be traded as consideration for commercial concessions. The court’s child-focused responsibilities remain separate. The divorce settlement agreements guide provides a drafting checklist.
Confidentiality needs procedure, not a promise of secrecy
Family and commercial records can contain personal data, trade secrets and third-party obligations. A lawyer can structure secure review and seek appropriate confidentiality measures, but no website should promise absolute secrecy or a particular court restriction.
Limit internal circulation, use consistent file names, preserve privilege and avoid discussing the dispute with staff who do not need to know. Public statements, social-media allegations and communications with customers can damage both the family case and business. If disclosure to a bank, regulator, auditor or board is legally required, coordinate timing and wording with relevant counsel.
In the inquiry form, provide enough information for conflict screening and urgency without uploading an entire company archive. Start with the group chart, key ownership documents, latest accounts and the disputed transaction list.
Succession planning should be reviewed after marriage and divorce events
A family dispute can expose gaps in wills, guardianship nominations, shareholder succession, insurance beneficiaries and powers of attorney. Marriage or divorce may affect existing testamentary arrangements under the governing rules. The DIFC Courts Wills Service FAQ, for example, explains specific consequences of marriage and divorce for registered DIFC Courts Wills.
Non-Muslim owners may consider the DIFC Courts Wills Service or the ADGM Courts Notary Public and Wills Office, subject to eligibility and asset coverage. These are different services. ADGM’s official guidance states that its Wills Office does not provide probate; probate applications go through the ADJD Wills and Probate Office. Muslim succession requires a separate UAE inheritance analysis.
A will is not a substitute for company governance. Align wills with share registers, foundation or trust documents, insurance, nominations, loan arrangements and guardianship plans. Review DIFC wills, ADGM wills and family business succession.
Trusts, foundations and family offices require specialist coordination
The UAE federal Trust Law and ADGM trust and foundation regimes can support lawful wealth and succession planning. ADGM states that a foundation has separate legal personality and is distinct from a trust. These structures should not be described as devices that automatically defeat family claims.
For each structure, obtain the constitutional documents, founder or settlor powers, council or trustee records, protector or guardian rights, beneficiary provisions, asset schedule and governing law. Determine whether a spouse has ownership, control, a beneficial interest, a discretionary expectation or no enforceable right. Labels such as “family foundation” do not answer those questions.
If a structure predates the marriage, was funded during it or changed near separation, record the chronology and commercial purpose. Family, corporate, trust, tax and regulatory lawyers may need to coordinate. Do not restructure after a dispute begins without advice on disclosure, injunction and enforcement risk.
A high-value case still needs a child-centred parenting plan
Nannies, drivers, multiple homes and international schools do not replace parental decision-making. A parenting plan should specify the child’s ordinary home, school week, holidays, travel, passports, medical authority, communication, handovers and expenses. It should also address staff transitions and security arrangements without turning them into surveillance.
If the family travels frequently, use realistic notice periods and a shared calendar. If private aviation or several passports are involved, precise travel consent is especially important. Where relocation is proposed, address immigration, housing, education, healthcare, extended family, travel cost and future contact.
Avoid exposing children to valuation meetings, staff interviews or adult allegations. Their best interests and relationship with each parent should remain separate from the asset dispute. See parenting plans and passports and travel consent.
How the family-law team can assist with complex family wealth matters
Mr AlBalooshi can identify the applicable family regime, court and urgent issues; organise financial disclosure; review agreements and personal-status claims; prepare settlement or litigation strategy; and coordinate company, valuation, succession and foreign counsel within the agreed engagement.
For an efficient first review, provide a two-page chronology, family chart, group structure, asset summary, marriage and child documents, existing agreements, current orders and urgent dates. State what must remain operational and what immediate risk you believe exists. Do not send unnecessary customer, employee or privileged data.
An inquiry does not itself establish a lawyer-client relationship. Conflict checks, accepted scope and engagement terms are required before advice or representation begins.

Frequently asked questions
Are company shares automatically divided in a UAE divorce?
No automatic universal rule should be assumed. The family regime, legal ownership, agreements, contributions, company law and available remedies require analysis.
Can a family court transfer shares in my company?
The requested family relief and the court’s powers must be assessed. Corporate implementation may separately require approvals, instruments and register updates.
Is company turnover treated as my personal income?
Not by itself. Turnover, profit, cash, salary, dividends, drawings, loans and benefits should be reconciled to show actual personal means.
Must commercially sensitive records be disclosed?
Relevant records may be required, but disclosure should be proportionate and controlled. Seek procedural protections rather than concealing material information.
Can I move assets to protect them before filing?
Do not transfer or hide assets to frustrate a claim or order. Obtain advice on lawful preservation, governance and proportionate interim measures.
How is a private company valued for family proceedings?
The expert may consider earnings, assets, debt, shareholder rights, market evidence, liquidity and key-person risk using a defined valuation date and purpose.
Are pensions or gratuity included in financial disclosure?
They may be relevant, but scheme rules, vesting, payment triggers and applicable law matter. Obtain current statements and benefit documents.
Can spouses settle by transferring a property or business?
They may agree lawful terms, but land, bank, company, tax and regulatory steps must be completed. The family agreement alone may not transfer title.
What if assets are held through a foundation or trust?
Review ownership, control, beneficiary rights, governing documents, funding and timing. The structure’s label does not determine the family-law result.
Can an urgent order stop asset dissipation?
Potentially, where jurisdiction, evidence and urgency support proportionate relief. Identify the specific asset, transaction, timing and risk.
Will a UAE financial order work against overseas assets?
Not automatically. Recognition, enforcement and local transfer requirements must be checked in each asset jurisdiction.
Should I update my will after divorce?
Yes, obtain succession advice promptly. Marriage and divorce may affect gifts, appointments, nominations and registered wills under the relevant rules.
Is a DIFC will the same as an ADGM-notarised will?
No. They are different services with different rules, coverage and probate pathways. Eligibility and asset mapping should be reviewed separately.
Can business staff help collect evidence?
Only through lawful, controlled requests. Avoid taking unrelated personal data, privileged material or entire systems without a defined evidential need.
What should I upload for Mr AlBalooshi’s first review?
Send the chronology, group chart, ownership documents, latest accounts, asset summary, family records, agreements, orders and every urgent deadline.
