No-fault divorce means a civil divorce in which the applicant does not have to prove that the other spouse caused the marriage to break down through adultery, abuse or another matrimonial wrong. Within the UAE, the term belongs to specific civil personal-status routes. It is not a universal description of every divorce available in every court.

Federal Decree-Law No. 41 of 2022 on Civil Personal Status allows either spouse, within the law’s scope, to request divorce by unilateral will. Article 7 states that harm or blame does not have to be proved, and Article 8 addresses the procedure. Cabinet Resolution No. 122 of 2023 supplies the executive regulation and official forms. Abu Dhabi also has a distinct local civil-family framework and a dedicated Civil Family Court no-fault divorce process.

Muslim personal-status divorce under Federal Decree-Law No. 41 of 2024 must be analysed separately. Talaq, khula and judicial separation have different decision-makers, requirements and consequences. Describing all of them as “no-fault divorce” can conceal the correct legal route.

A civil divorce judgment ends the marriage, but it does not necessarily resolve every financial, child, property, immigration or cross-border issue. Mr AlBalooshi can assess eligibility, jurisdiction, documents, connected claims and foreign recognition. Use the inquiry form or WhatsApp +971 50 627 5196.

No-fault describes the proof required for divorce

In a fault-based model, a spouse may have to establish a defined ground such as harm. In a no-fault civil model, the court can dissolve the marriage on a spouse’s stated wish to separate without deciding that the other spouse committed matrimonial misconduct.

This changes the proof needed for the divorce itself. It does not make evidence irrelevant to all connected matters. Income, duration of marriage, contributions, children’s needs, housing, risk and conduct with financial consequences may still matter to a financial, custody or interim application under the applicable civil regime.

No-fault also does not mean “no procedure.” The applicant must use the correct form, establish court competence and legal eligibility, provide the marriage and identity documents and ensure proper notice. The respondent may raise jurisdiction, identity, marriage-status or connected-claim issues even if the respondent cannot prevent the divorce simply by denying fault.

Federal civil divorce under Articles 7 and 8

Federal Decree-Law No. 41 of 2022 creates the federal civil personal-status framework. Article 1 defines its scope, including non-Muslim UAE citizens and the categories of non-Muslim foreign residents addressed by the law, subject to its terms and permitted choices. Eligibility should be checked rather than inferred from an English-language marriage certificate or residence visa alone.

Article 7 is titled “Divorce by Unilateral Will.” Either spouse may request divorce without proving harm or assigning blame. Article 8 deals with divorce procedure through the form prepared for the purpose. Equal access by husband and wife is a central feature of this civil route.

Article 3 excludes divorce proceedings filed under this civil law from referral to Family Guidance. That exception is specific. It should not be used to bypass family guidance in a Muslim personal-status case or to assume that every later child or financial dispute is exempt.

The executive details and forms are governed by Cabinet Resolution No. 122 of 2023. Parties and lawyers should check the current official court portal at filing because form versions, electronic channels, fees and document requirements can change.

Abu Dhabi has a separate local no-fault route

Abu Dhabi Civil Family Court operates under Abu Dhabi’s civil-family legislation and regulations within its jurisdiction. Its official guidance describes no-fault divorce as divorce without evidence that the other spouse did something wrong and provides dedicated applicant and respondent forms.

The Abu Dhabi Judicial Department identifies eligibility factors that include Abu Dhabi residence, a civil marriage through the Abu Dhabi Civil Family Court or other stated jurisdictional criteria. It also describes nationality and religion requirements for the local route. These official criteria should be checked in the current law and forms; a temporary visit or employment connection should not be assumed sufficient.

The official process includes court review, notification of the respondent, case-management preparation and referral to the judge. The ADJD page publishes a target timetable, but a target is not a guaranteed completion date. Service problems, document issues, connected claims or court directions can affect timing.

Muslim divorce uses different legal concepts

Federal Decree-Law No. 41 of 2024 governs Muslim personal-status matters within its scope. It separates several routes:

  • talaq, involving divorce by the husband through legally recognised expression and statutory documentation;
  • khula, requested by the wife and connected to lawful compensation under Articles 65 to 68;
  • judicial separation or annulment, based on statutory grounds and evidence, including harm, non-maintenance, absence or other specified circumstances; and
  • agreed or court-recorded arrangements where the applicable law permits them.

These are not interchangeable with Article 7 federal civil divorce. A Muslim wife should not be told that a unilateral civil no-fault form is automatically available, while an eligible non-Muslim spouse should not be required to prove harm if the correct civil route applies.

Read divorce for Muslims, talaq, khula and tafreeq for the separate legal tests.

Court and legal-regime eligibility come before speed

The correct route may depend on:

  • each spouse’s nationality and religion;
  • UAE residence and the emirate of residence;
  • where and how the marriage was concluded;
  • whether the couple obtained an Abu Dhabi civil marriage;
  • a valid choice of law or request to apply another law;
  • an existing foreign or UAE case or judgment;
  • the children’s residence and nationality; and
  • the relief sought beyond divorce.

Federal civil law and Abu Dhabi local civil law are not competing forms to choose only by convenience. The court must have competence, and the applicable statutory requirements must be satisfied. Filing in the wrong forum can lead to rejection, transfer, delay or a foreign-recognition complication.

Dubai residents should not assume the Abu Dhabi Civil Family Court route applies merely because it appears simpler online. Conversely, a party eligible for an Abu Dhabi civil process should not automatically import Dubai or federal procedures.

The application still requires reliable documents

A typical civil no-fault divorce file may require:

  • passport and Emirates ID copies for both spouses;
  • UAE residence information and verified contact details;
  • the marriage certificate;
  • legal Arabic translation where required;
  • authentication or apostille evidence for a foreign certificate where accepted;
  • proof relevant to the selected court’s jurisdiction and civil-law eligibility;
  • any prenuptial or postnuptial agreement;
  • existing divorce, custody, maintenance or protection proceedings; and
  • the approved divorce application and disclosure forms.

Names and dates must be consistent across the documents. Where transliteration differs, provide an explanatory record rather than silently changing a name. A previous marriage or foreign divorce may also need proof before the current marital status can be determined.

Notice and response remain part of procedural fairness

No-fault divorce does not mean the respondent can be kept unaware. The court must notify the other spouse under the applicable rules. Accurate addresses and contact information matter. Deliberately providing a false address can threaten the integrity and later recognition of the judgment.

The respondent may not need to consent to the dissolution where unilateral civil divorce is valid, but can still address jurisdiction, identity, service, connected financial relief and child arrangements. The official Abu Dhabi forms include a defendant’s response for no-fault divorce.

A spouse abroad may be served through cross-border channels. Extra time, translation, authentication or judicial-cooperation steps can be required. Proper service is particularly important if the judgment will later be recognised or enforced in another country.

Divorce, financial orders and property are not one question

The termination of marriage can be decided separately from financial consequences. Under the federal civil framework, Article 9 addresses the divorcee’s alimony, while the executive regulation provides further detail. Applicable factors, evidence and procedure must be reviewed in the current text.

The Abu Dhabi Civil Family Court provides a post-divorce application for a financial order and a post-divorce settlement form. Its official guidance states that a financial claim can be made if the parties cannot reach an amicable settlement. The divorce judgment should not be mistaken for a complete release of financial rights unless the documents and applicable law clearly produce that effect.

Property title, jointly held accounts, business interests, debts, pensions and foreign assets may require separate analysis. UAE civil divorce does not automatically create the same marital-property division found in every foreign jurisdiction. A prenuptial agreement can be important, but validity, scope and enforcement must be assessed.

Review financial settlements, settlement agreements and Abu Dhabi post-divorce financial orders.

Children remain subject to welfare-based decisions

The federal civil personal-status regime contains a joint-custody framework. Abu Dhabi Civil Family Court also explains that joint legal and physical custody applies after civil divorce unless a parent waives that right or the court orders another arrangement, with the child’s best interests governing a dispute.

Joint custody does not eliminate the need for a workable plan. Parents should address residence, school, medical decisions, holidays, passports, travel, relocation, communication and expenses. A court may need to decide if the parents cannot agree or if a proposed arrangement is unsafe or impractical.

Child maintenance is distinct from the adult divorce. A parent should not trade away a child’s support or contact for a quick dissolution. Read joint custody and child maintenance.

Urgent and protective issues may need separate orders

A no-fault application is not an emergency protection mechanism. If violence or immediate danger exists, call UAE Police on 999. A separate protection, criminal or urgent family application may be needed.

Interim issues can include temporary maintenance, housing, school decisions, passports, travel restrictions, child handovers and preservation of specified assets. The court, legal basis and evidence must be identified. Applying for no-fault divorce does not automatically freeze accounts, prevent travel or create interim custody terms.

Do not take self-help measures that breach an order or expose a child to risk. Use urgent interim applications for a preparation overview.

Foreign marriage and overseas recognition require planning

The UAE court may accept a foreign marriage document if the document and legal requirements are satisfied, but it may need authentication or apostille where accepted and legal Arabic translation. The original marriage’s validity and any earlier status event may also require proof.

After divorce, another country may require a certified judgment, proof of finality, authentication and translation before updating civil status or recognising financial and custody consequences. Recognition standards are governed by the destination country and any applicable treaty or reciprocal rules.

A party who already started divorce abroad should disclose it. Parallel cases can create inconsistent orders and service problems. Coordinated UAE and foreign advice is especially important when children, immigration status or property exist in more than one country.

Hypothetical example: simple dissolution, unresolved finances

Assume an eligible non-Muslim spouse obtains a federal civil divorce under Articles 7 and 8 without proving harm. The couple owns an apartment in one name, has joint debt and cannot agree on spousal support. The no-fault judgment can end the marriage, but ownership, debt and financial claims still require analysis under the applicable law and documents.

The example demonstrates the boundary between marital status and financial relief. It does not imply that a financial claim will succeed or that every court separates the issues in the same procedural way.

How Mr AlBalooshi can assist with civil divorce

Mr AlBalooshi can assess federal or Abu Dhabi civil eligibility, court competence, foreign-marriage documents, service, connected financial and child claims, urgent applications, settlement terms and overseas recognition planning. He can also explain when a Muslim personal-status route applies instead of civil no-fault divorce.

Request a case review through the inquiry form. Provide both spouses’ nationalities, religions, current residences, marriage place and certificate, children’s residence, any agreement and all existing cases or judgments. You can also WhatsApp +971 50 627 5196. No outcome or timetable is guaranteed, and representation starts only after conflict checks and written engagement.

Frequently asked questions about no-fault divorce in the UAE

1. What does no-fault divorce mean?

It means the applicant does not have to prove matrimonial wrongdoing or harm to obtain the civil divorce. The applicant must still establish court competence, eligibility, marriage and proper procedure.

2. Is no-fault divorce available everywhere in the UAE?

Civil no-fault divorce exists under the federal civil personal-status regime and Abu Dhabi’s local civil-family regime within their respective scope. The correct court and eligibility must be checked for the parties and marriage.

3. Can either spouse apply under the federal civil law?

Yes, where Federal Decree-Law No. 41 of 2022 applies. Article 7 permits either spouse to request divorce by unilateral will without proving harm or blame.

4. Is the other spouse’s consent required?

Not for a valid unilateral civil divorce request within the law’s scope. The respondent must still be properly notified and may raise jurisdiction, service and connected-claim issues.

5. Must the applicant attend Family Guidance first?

Article 3 of the federal Civil Personal Status Law excludes divorce proceedings under that law from Family Guidance. Other family claims and other legal regimes must be considered separately.

6. Is an Abu Dhabi employment connection enough to file there?

Not automatically. Abu Dhabi residence, civil marriage, nationality, religion and other jurisdictional criteria in the current local framework and official guidance must be checked.

7. Can a Muslim spouse use the civil no-fault form?

It should not be assumed. Muslim divorce under Federal Decree-Law No. 41 of 2024 uses distinct talaq, khula and judicial-separation routes. Eligibility for any civil exception requires case-specific analysis.

8. What documents are usually required?

Identity records, residence evidence, the marriage certificate, translations and authentication where required, contact details and the approved application are central. Agreements, child documents and prior orders may also be relevant.

9. Does no-fault divorce divide property automatically?

No. The divorce ends the marriage, while property title, debts, financial claims and agreements may require separate settlement or court determination under the applicable law.

10. Can a spouse claim financial support after civil divorce?

Potential claims depend on the applicable regime. Article 9 of the federal Civil Personal Status Law addresses divorcee alimony, and Abu Dhabi provides a post-divorce financial-order process. Evidence and statutory factors remain necessary.

11. What happens to the children after civil divorce?

Federal civil and Abu Dhabi civil systems use joint-custody principles within their scope. If parents disagree, the court determines arrangements based on the child’s best interests. Maintenance and travel issues still require attention.

12. How long does no-fault divorce take?

It depends on the court, service, document completeness, case management and connected issues. An official target is not a guarantee. Current court information should be checked on the filing date.

13. Can the divorce be completed if one spouse is abroad?

It may be possible, but jurisdiction, service abroad, attendance, representation and document authentication must be planned. Defective foreign service can undermine later recognition.

14. Will my UAE no-fault divorce be recognised overseas?

Recognition depends on the destination country’s law, jurisdiction and notice standards, finality, authentication, translation and public policy. Obtain advice in the destination country as well as the UAE.

15. Can we settle finances and children privately?

Parties can negotiate, but the agreement must be lawful, precise and appropriately recorded or approved. Child rights and welfare are not merely private adult assets, and informal terms may be difficult to enforce.
