UAE federal personal status courts deal with family disputes in the emirates served by the federal judiciary, but they are not the correct forum for every UAE family case. The first task is to identify the judicial system, the applicable personal-status regime, the territorial connection and any urgent relief required. A filing made in the wrong court or under the wrong legal route can lose time and create avoidable service, translation and jurisdiction disputes.
Mr AlBalooshi assists individuals and families with federal-court route assessment, family-guidance preparation, case documents, urgent applications and the progression of personal-status claims. Use the inquiry form or WhatsApp +971 50 627 5196. Send a short chronology, the parties’ nationality and religion where legally relevant, their UAE residence and work locations, the marriage and birth records, and details of any existing UAE or foreign case.
UAE federal personal status courts are part of a specific judicial system
The phrase “UAE family court” can hide an important jurisdictional distinction. The official UAE Government description of the judiciary identifies Abu Dhabi, Dubai and Ras Al Khaimah as emirates with their own local judicial authorities. Federal judicial departments serve Sharjah, Ajman, Umm Al Quwain and Fujairah. A family living in the UAE should therefore identify the competent judicial authority before preparing the merits of a claim.
The location of a wedding, the current home of each spouse, the defendant’s address, a child’s habitual day-to-day residence, a party’s workplace, the location of assets and the relief requested can all matter. The answer is not always the emirate named on a visa or the place where the couple last lived together. Cross-border facts and parallel proceedings may create additional questions.
This page explains the federal-court route. It does not describe Dubai Courts, the general Abu Dhabi personal-status system, the specialist Abu Dhabi Civil Family Court or Ras Al Khaimah Courts as though they were federal courts.
The applicable family-law regime must be classified before filing
Federal jurisdiction does not mean that one substantive law applies to every family. The court may first need a clear regime analysis.
Federal Decree-Law No. 41 of 2024 on Personal Status is the current federal personal-status legislation governing matters within its scope, including marriage, separation, divorce, maintenance, parentage, custody, guardianship and succession. It replaced the former 2005 federal personal-status legislation as the present starting point, subject to transitional and case-specific issues.
Federal Decree-Law No. 41 of 2022 on Civil Personal Status creates a different civil route for people within its scope, supported by Cabinet Resolution No. 122 of 2023. It addresses civil marriage, no-fault divorce, financial consequences, joint custody and succession for qualifying non-Muslims. Eligibility and any properly invoked foreign law must be assessed rather than assumed.
The Abu Dhabi local civil-family framework is separate. A person should not import Abu Dhabi Civil Family Court forms, English-language procedures or local financial concepts into a federal-court filing without a lawful basis.
Federal personal status cases cover distinct claims and applications
A personal-status file may concern one issue or several connected issues. Common matters include:
- divorce, judicial separation and proof or registration of marital status;
- spousal and child maintenance, housing and related financial obligations;
- custody, guardianship, visitation, child travel and passport issues;
- parentage and family-status declarations;
- marriage permissions, authentications and other non-contentious applications;
- protective, urgent or temporary orders connected with a family dispute;
- enforcement or variation of an existing personal-status judgment; and
- succession, estates, guardianship of minors and related personal-status matters where the court is competent.
Each claim needs its own legal basis, remedy and evidence. A divorce request does not automatically place every asset, company, child-travel concern or foreign order before the court. The statement of claim and accompanying applications should identify precisely what the court is being asked to decide.
Family guidance can be a legal stage, not an informal conversation
Many contested personal-status disputes begin with Family Guidance. The purpose is to identify the dispute, explore lawful settlement and determine whether the matter can be resolved without full litigation. The procedure should be approached seriously even when reconciliation is unlikely.
In 2025, the Federal Judicial Council introduced regulations implementing the 2024 Personal Status Law. The Ministry of Justice states that Resolution No. 67 of 2025 expanded the role of family counsellors in amicable resolution and allows qualifying agreements to have the force of an executive deed. Other 2025 regulations address arbitrators, visitation, affidavits and authentications, and Sharia marriage officers.
Not every application follows the same referral route. Urgent orders, some petitions, authentications and matters expressly excluded by the applicable law may proceed differently. Before attending Family Guidance, prepare the outcome sought, the minimum acceptable terms, a child-focused proposal where relevant, and documents showing income, housing and existing arrangements. Do not sign settlement language that is unclear, incomplete or difficult to enforce.
Urgent family applications require evidence of urgency
Family disputes can involve immediate maintenance, child safety, travel, access to documents, housing or preservation of assets. An urgent application is not granted merely because the dispute feels pressing. The applicant should connect the requested temporary order to a specific legal risk and support it with reliable evidence.
Useful evidence may include confirmed travel details, school or medical records, recent account material, a current tenancy document, written threats, police or medical records where relevant, existing orders and a focused chronology. The relief requested should be proportionate. An application that is too broad, unsupported or inconsistent with the main case may be refused or may complicate later proceedings.
Where there is immediate danger, contact the competent UAE emergency or protection authorities. A court filing should not delay safety measures.
Filing starts with jurisdiction, parties, remedies and a usable record
The Ministry of Justice provides electronic systems for federal litigation, including e-filing and smart family-counselling channels. Current access requirements, service categories, forms and fees should be checked on the official platform at the time of filing.
A well-prepared federal personal-status filing normally requires:
- the correct names, identity details and service information for all parties;
- a concise chronology with dates that match the official records;
- the legal and factual basis for the court’s jurisdiction;
- separately stated remedies rather than one general request for “all rights”;
- legible supporting documents in the required form and language; and
- any urgent application, foreign-law material or existing judgment that affects the route.
UAE Pass and online access make filing more convenient, but they do not cure a defective claim. A person should retain the submission receipt, case number, payment record and every version of the uploaded documents.
Notification and service can determine whether a case progresses
The defendant must be notified through legally accepted procedures. Give the most accurate available address, telephone number, email, employer details and any overseas address. If the defendant is outside the UAE, service may require additional steps and significantly affect timing.
Do not use an address known to be obsolete or conceal a foreign residence. Defective service can cause adjournments, reopen procedural issues or affect later recognition of the judgment abroad. If a party is deliberately avoiding service, record the attempts and ask for the legally available next step rather than improvising informal notice.
Electronic messages from the court should be monitored carefully. Missing a notification, case-management requirement or deadline because a registered number changed can have serious consequences.
Arabic is the official court language in the federal system
Federal civil procedure states that Arabic is the official language of the courts. A non-Arabic-speaking party can participate through the court’s accepted interpretation arrangements, but pleadings and documentary evidence must comply with the applicable language and translation rules.
Foreign marriage certificates, birth records, judgments, bank documents and correspondence may require authentication and certified Arabic translation. Translation should preserve names, dates, legal status and operative terms. A summary, informal translation or machine translation is not a substitute for a complete court-usable version.
English documents used in Abu Dhabi Civil Family Court should not be assumed to be accepted on the same basis in a federal personal-status case. The two systems have different language rules.
Evidence should prove each requested order, not merely tell the history
The Evidence Law, Federal Decree-Law No. 35 of 2022, governs proof in civil and commercial matters and may be relevant alongside the rules specific to personal status. The court will assess the legally admissible record, not the quantity of screenshots or accusations filed.
Organise evidence by issue:
- Marriage and status: original certificate, registration extract, prior divorce or death record, and any relevant marriage agreement.
- Income and maintenance: salary evidence, bank statements, recurring expenses, school and medical invoices, rent and proof of actual payments.
- Children: birth certificates, school and healthcare material, present routine, travel records and existing parenting arrangements.
- Conduct or harm: dated messages, official complaints, medical evidence and witnesses where lawfully relevant.
- Property or contribution: title documents, payment trails, loan records and evidence of the legal claim being advanced.
- Foreign proceedings: complete pleadings, orders, service evidence, finality documents, authentication and translation.
Preserve original files and metadata. Avoid editing screenshots, selectively deleting conversations or accessing an account without authority.
Child cases separate custody, guardianship, contact and travel
Parents often use “custody” to describe every child-related decision. UAE personal-status law distinguishes daily care from legal guardianship and from specific issues such as visitation, schooling, healthcare, passports and travel. The civil personal-status route has its own joint-custody framework.
A useful proposal should address the child’s actual week, school transport, medical needs, communication, holidays, passport control, travel consent and the safe exchange of the child. The court may focus on welfare, stability and each parent’s ability to meet the child’s needs under the applicable regime.
Do not remove a child from the UAE, retain a child abroad or breach an order in the hope of improving a litigation position. Obtain advice before travel where consent, a travel ban, guardianship or a foreign order is uncertain.
Financial claims require a claim-specific schedule
Maintenance is not a single undifferentiated figure. Depending on the governing law and facts, a case may involve spousal maintenance, child support, housing, education, healthcare and other recognised expenses. The party seeking an order should present a realistic schedule supported by evidence; the responding party should provide a complete, accurate account of means and existing payments.
Property ownership and post-divorce financial claims also depend on the applicable regime. UAE law does not create a universal automatic 50/50 division of everything owned by either spouse. Title, beneficial claims, proven contribution, agreements, company ownership, liabilities, foreign marital-property law and the remedy available in the selected court may all matter.
Never move, conceal or dissipate assets to frustrate a claim. If preservation is genuinely necessary, the legal basis and evidence for a proportionate order should be assessed promptly.
Hearings, experts and settlements should be prepared as one case strategy
After filing and notification, the matter may pass through case management, written submissions, hearings, evidence directions, expert work and judgment. The exact path depends on the claim. Financial, accounting, property or foreign-law issues may require an expert or additional proof.
An expert does not replace the judge and should receive an organised record. Identify disputed transactions, explain the requested calculation and respond within the appointed process. Unsupported narrative and disordered account extracts increase cost and reduce clarity.
Settlement remains possible during proceedings. Terms should address all connected issues, dates, payment mechanics, travel and document handover, default consequences and enforceability. A partial settlement should state what remains for the court.
Judgment, challenge and enforcement are separate stages
A first-instance judgment must be read with its reasons, operative wording and notification record. Review immediately whether clarification, correction, appeal or another procedural step is available. Time limits vary by decision and procedure; do not rely on a general online deadline.
An appeal is not simply a second opportunity to repeat the first filing. It should identify a lawful ground and the part of the judgment challenged. Access to the Federal Supreme Court is subject to jurisdictional and professional rules, including the required pleading status for counsel where representation is used.
A judgment may still need execution. Maintenance arrears, custody or visitation arrangements, document delivery and financial orders can involve different enforcement measures. Keep proof of payment, non-compliance and all enforcement notices.
Foreign elements may affect service, applicable law and enforcement
An expatriate family may have a foreign marriage, overseas assets, another nationality, a foreign prenuptial agreement or proceedings in two countries. These facts do not automatically remove federal-court jurisdiction, but they can change the required evidence and the practical value of an order.
A party asking the UAE court to apply foreign law should be prepared to prove the law in the required form. A foreign judgment may require recognition under the Civil Procedure Law or an applicable treaty. Jurisdiction, valid notice, finality, conflict with UAE judgments and public policy are central considerations.
If a UAE judgment will be used abroad, obtain the complete judgment, evidence of finality and notification, certified translation and the authentication required by the destination country. Recognition should be planned before settlement terms are finalised.
A federal personal-status court document checklist
Prepare the following where relevant:
- passports, Emirates IDs and proof of UAE residence or work;
- full contact and service details for the other party;
- marriage, divorce, birth and death certificates;
- marriage agreements, settlements and powers of attorney;
- an issue-by-issue chronology and list of orders requested;
- income, bank, expense, housing and liability evidence;
- child school, medical, care, contact and travel records;
- every existing UAE and foreign judgment or active pleading;
- certified translations and authentication records; and
- an urgent-risk note identifying the event, date, evidence and temporary order sought.
Do not upload irrelevant intimate material. Redact unrelated account numbers or third-party personal data only where legally appropriate and without altering evidence.
Common mistakes before the federal family court
Common errors include filing in the wrong judicial system, mixing Muslim and civil personal-status rules, asking for remedies without evidence, using expired contact information for service, submitting partial foreign judgments, relying on informal translations, missing court notifications, treating Family Guidance as unimportant, or agreeing to vague settlement terms.
Another mistake is presenting every family disagreement as misconduct. Keep the case tied to legally relevant facts. Calm, precise documents are usually more useful than accusations, repetition or unnecessary private detail.

Frequently asked questions
Which emirates use the UAE federal personal status courts?
Federal judicial departments serve Sharjah, Ajman, Umm Al Quwain and Fujairah. Abu Dhabi, Dubai and Ras Al Khaimah maintain local judicial systems. The competent court still depends on territorial jurisdiction, the parties’ connections and the remedy requested. Do not file solely because one party has a visa issued in a federal-court emirate. Check residence, domicile, workplace, child location, defendant address, property and existing proceedings before choosing the forum.
Does the 2024 Personal Status Law apply to every federal family case?
No. Federal Decree-Law No. 41 of 2024 is the current general personal-status framework for matters within its scope, but Federal Decree-Law No. 41 of 2022 provides a distinct civil personal-status route for qualifying non-Muslims. Nationality, religion where legally relevant, residence, marriage form and a valid request to apply foreign law can affect the analysis. The legal regime should be identified before the statement of claim is drafted.
Must I attend Family Guidance before filing for divorce?
Many personal-status disputes are referred to Family Guidance, but not every application follows the same route. Urgent applications, petitions, authentications and matters excluded by the governing law may proceed differently. Federal regulations introduced in 2025 strengthen the family-guidance framework and the enforceability of qualifying settlements. Obtain route-specific advice before filing, especially if there is a travel, safety, maintenance or limitation concern.
Can a Family Guidance agreement be enforced?
The Ministry of Justice states that Resolution No. 67 of 2025 gives qualifying agreements reached through federal Family Guidance the force of an executive deed. Enforceability still depends on the agreement satisfying the applicable requirements and stating obligations clearly. Payment dates, child arrangements, travel consent, document delivery and default terms should be precise. A person should understand the whole agreement before signing because later enforcement may focus on its wording.
Can I file a federal personal-status case online?
The Ministry of Justice provides e-filing and smart family-counselling systems. Access commonly involves UAE Pass, electronic forms, document upload and fee payment. Available service categories, forms and technical requirements can change. Online filing is a delivery method, not a substitute for jurisdiction or legal drafting. Keep the receipt, submission number, uploaded file set and every notice issued through the registered contact details.
What documents are usually needed for a federal divorce case?
Start with passports, Emirates IDs, the full marriage certificate, current residence and service information, a chronology and any prior agreement or judgment. Add documents linked to the relief sought: income and expense evidence for maintenance, birth and school records for children, title and payment evidence for a property claim, and authenticated translated records for foreign events. The court may request further material depending on the case.
Do foreign documents need Arabic translation?
Arabic is the official language of federal courts. Foreign-language documents commonly require a certified Arabic translation and, depending on the document and place of issue, an authentication or attestation chain. Translate the complete operative document, not selected pages. Names, dates and legal terms should match the original. Requirements should be confirmed for the specific court and document before filing.
Can I ask for urgent maintenance or a child travel order?
Potentially, if the applicable law and facts support an urgent or temporary application. The request should identify the immediate risk, the precise interim order needed and the evidence supporting it. Travel details, medical or school records, payment history, messages, existing orders and a focused chronology may be relevant. The court retains discretion. An urgent label without proof does not establish urgency.
How does the court decide a child custody dispute?
The court applies the governing personal-status regime and considers the legally relevant child-welfare and parental factors. Custody, guardianship, visitation and travel are not interchangeable. Evidence should show the child’s routine, care, schooling, health, safety and each parent’s practical proposal. Under the federal civil route, joint custody has a specific statutory role; the Muslim personal-status route has different concepts and requirements.
Are UAE family assets divided equally on divorce?
There is no universal rule that every asset is automatically divided 50/50. The outcome depends on title, the governing legal regime, agreements, proven contributions, liabilities, company ownership, foreign-law issues and the remedy available. A spouse should prepare a schedule identifying each asset, legal owner, location, acquisition date, funding and supporting records. Financial disclosure should be accurate and proportionate to the claim.
What happens if the other party lives outside the UAE?
The court must first have jurisdiction, and the defendant must be notified through a legally accepted route. Overseas service may require translations, formal channels and additional time. Provide the best available foreign address and contact information. Do not conceal the overseas location or rely only on informal messages. Defective notice can affect the UAE case and later recognition of the judgment abroad.
Can a foreign divorce judgment be used in a federal court?
A foreign judgment may require recognition or enforcement under the Civil Procedure Law or an applicable treaty. The court may examine foreign jurisdiction, valid service, finality, conflicts with UAE judgments and public policy. Submit the complete judgment, not a summary or certificate alone, together with finality and service evidence, authentication and certified translation as required.
How long does a federal family court case take?
There is no reliable single duration. Timing depends on Family Guidance, service, contested facts, urgent applications, translations, expert work, foreign-law proof, hearing schedules, appeal and enforcement. A clear filing and accurate contact information can reduce avoidable delay, but no lawyer should guarantee a completion date. Ask for a stage-based estimate after the court, claims and evidence are known.
What affects the cost of a federal personal-status case?
Cost factors can include court and service fees, translation and authentication, expert appointments, overseas service, the number of applications, hearing and appeal work, and lawyer fees under a written engagement. Official fees and service charges can change and should be checked at filing. A narrow, organised case may cost less than proceedings involving several countries, disputed assets and urgent child applications.
When should I contact Mr AlBalooshi about a federal court matter?
Seek advice before filing, signing a Family Guidance settlement, moving a child, responding to an urgent application, relying on a foreign order or allowing a court deadline to pass. Early review is particularly important when jurisdiction or the applicable legal regime is disputed. Use the inquiry form with the case number, next date, emirate and required outcome, or WhatsApp +971 50 627 5196.
