A family lawyer in Ajman should identify the federal court route, the applicable personal-status regime and any cross-emirate issue before preparing a claim. Ajman follows the UAE federal judicial system. Ministry of Justice filing, family-counselling and execution services are therefore central, while the family’s substantive rights depend on the correct federal law and the facts.
Mr AlBalooshi assists with Ajman divorce, custody, guardianship, visitation, maintenance, urgent child-related measures, foreign judgments and enforcement within the agreed engagement. Use the inquiry form to describe the issue and upload the marriage certificate, identification and any current notice or order. For confidential intake by WhatsApp, contact +971 50 627 5196.
We provide family-law information, intake and case-preparation support, and coordinate with appropriately authorised practitioners for steps requiring rights of audience before a UAE court.
Ajman family cases use the federal courts, not Dubai’s local system
The official UAE Government portal identifies Ajman among the emirates that follow the federal judicial system. A person living in Ajman should not use a Dubai Courts form merely because the marriage took place, the employer is located or a lawyer’s office is in Dubai. Jurisdiction must be determined from the applicable procedural rules and the parties’ actual connections.
Federal Decree-Law No. 41 of 2024 is the current Personal Status Law. It covers matters including marriage, divorce, maintenance, parentage and custody. Federal Decree-Law No. 41 of 2022 and Cabinet Resolution No. 122 of 2023 establish a separate civil personal-status framework for qualifying non-Muslims. The two regimes should not be merged in pleadings, settlements or website explanations.
Ajman is geographically connected with Sharjah and close to Dubai, so families often live, work, study and hold assets in different emirates. That practical movement does not make every court interchangeable. Prepare an emirate map showing each spouse’s residence, children’s home and school, marriage place, employer, property, existing proceeding and requested enforcement location.
The first Ajman decision is which personal-status regime applies
Route selection should be completed before discussing likely outcomes. Relevant facts can include each party’s nationality and religion where legally material, residence, marriage form and place, any agreement on applicable law, children’s location and prior proceedings.
For a matter governed by the 2024 Personal Status Law, the claim must follow that statute and its current implementing measures. For a qualifying non-Muslim case under the 2022 civil law, civil divorce, joint custody and financial consequences follow the separate federal framework. Abu Dhabi’s local Civil Family Court law is not an Ajman law and should not be cited merely because the parties seek a civil divorce.
A foreign-law request is another distinct issue. The party relying on foreign law may need to plead and prove the relevant current provisions in an accepted form. A translated internet article is not a substitute for the official text and any required expert evidence. Mandatory UAE rules and public order may remain relevant.
Federal Family Guidance should begin with a settlement brief
The Federal Judicial Council’s 2025 implementing decisions include Resolution No. 67 of 2025 on Family Guidance. The Ministry of Justice states that the regulation strengthens family counsellors’ role in amicable settlement and gives agreements completed through the authorised process the force of an executive deed. The Ministry also lists Family Counseling and Smart Family Counseling among its digital systems.
Prepare for guidance as a legal stage. Bring a one-page chronology, marriage and child records, a supported expense schedule and a proposed child arrangement. Divide the dispute into issues that may settle and issues requiring a judicial decision.
A clear settlement can address divorce terms, dowry or related rights where applicable, child residence, contact, travel, housing and support. Use exact dates, amounts and responsibilities. “Shared costs” is incomplete unless the agreement identifies the percentage, expense category, approval process and payment deadline. “Flexible visits” may fail when the parents no longer communicate.
Before signing, consider validity, the children’s interests, rights that cannot lawfully be waived and the execution route. Private messages showing agreement in principle may not have the same effect as an authorised settlement deed.
An Ajman divorce file should separate status from consequences
A divorce application concerns marital status, but connected claims may need different allegations and proof. Build a case matrix for:
- the legal basis for ending the marriage;
- interim support while proceedings continue;
- final spousal and child financial claims;
- custody, guardianship and visitation;
- passports, travel consent or protective restrictions;
- dowry and post-divorce rights where relevant;
- use or delivery of personal documents and belongings;
- recognition of a foreign marriage or judgment; and
- enforcement in Ajman or another location.
Do not assume that success on marital status automatically decides every child or financial question. The court needs the legal basis and evidence for each remedy. Conversely, a settlement may end some issues while leaving a narrow dispute for judgment.
If the other spouse has filed elsewhere, obtain the full case number, court, claim, service documents and next date. Parallel proceedings can cause inconsistent positions and unnecessary cost.
Child arrangements in Ajman must work across real distances
Ajman children may attend school or have a parent working in another emirate. A parenting plan should account for traffic, school start times, activities and handover locations. An abstract equal-time proposal may not serve a child if daily transport is unrealistic.
The governing law determines the concepts of custody, guardianship and parental authority. Under the federal civil personal-status regime, joint custody is central for qualifying non-Muslim cases. The 2024 Personal Status Law has its own custody and guardianship provisions. Do not borrow one regime’s terminology without checking applicability.
Prepare a weekly schedule and an annual calendar covering school terms, weekends, public holidays, religious occasions where relevant, vacations, medical appointments and remote communication. Identify who holds passports, receives school notices and makes urgent decisions. If safety is alleged, explain the specific risk and support it with lawful evidence.
Children should not carry messages, record a parent or choose between households. Adult communication and evidence collection should remain separate from the child’s relationship with each parent.
Ajman child travel disputes can become urgent quickly
A proposed trip or relocation needs more than a ticket. Review custody and guardianship rights, existing orders, passport possession, consent, the destination, school impact and return plan. A holiday visit and a permanent move require different analysis.
For planned travel, organise the itinerary, flight details, accommodation, contact information, consent correspondence and return date. For a relocation request, add residence status, housing, school, healthcare, future contact arrangements and cost allocation.
If unauthorised departure is imminent, record the exact date, source of information and likely harm. The requested protective measure should be lawful, proportionate and directed to the competent authority. Unsupported travel-ban applications can intensify the dispute and affect credibility.
Immediate safety concerns may also require police or protection services. A website inquiry is not an emergency-reporting channel.
Maintenance claims need an Ajman-ready financial schedule
Support claims can include categories recognised by the applicable regime, such as child living costs, housing, education, healthcare and other legally relevant expenses. Spousal entitlement and duration may differ between personal-status and civil non-Muslim routes.
Create a table showing each expense, monthly or annual frequency, payer, supporting document and amount requested. Separate the child’s expenses from the parent’s personal costs. Explain unusual medical, learning or transport requirements.
Income evidence should be lawful and reliable. Salary certificates, employment terms, regular bank credits, business ownership records and benefits may be relevant. Company turnover is not automatically the owner’s disposable income, and an expensive photograph is not a financial statement.
For interim support, show why the need cannot wait for final judgment. After an order, maintain a payment ledger with due dates, amounts received, direct payments and balance. An accurate ledger is essential if execution becomes necessary.
Evidence collection must respect UAE privacy and cybercrime rules
Family disputes often involve private messages, location data, recordings and account information. Do not enter a spouse’s device, email, banking or cloud account without lawful authority. Do not publish accusations or circulate private images. Separate the desire to know what happened from the evidence legally available for court.
Preserve complete records already lawfully held. Keep original files, dates, sender information and full message threads. Cropped screenshots can remove context and make authentication harder. If a record is in another language, retain the original and prepare accepted Arabic legal translation.
Use an issue-based index: marriage, children, finance, travel, safety, property and prior proceedings. A neutral chronology should connect each event to the relevant document. Repetition and insults make a bundle harder to use.
If a police report or medical record exists, obtain it through the lawful channel and clarify what it proves. An allegation in a report is not automatically a final factual finding.
Ministry of Justice e-filing requires accurate party information
The Ministry provides an e-filing system and a service for registering cases before federal courts of first instance. Current forms, access conditions, fees and technical steps should be checked on the official portal when filing.
Names must match identity and civil-status documents. Provide the most accurate available address, mobile number and email for service. If the respondent works in another emirate or lives abroad, plan service rather than entering a convenient but incorrect address.
Foreign documents commonly need authentication and certified Arabic translation. Scan complete pages, endorsements and stamps into readable PDFs. Descriptive filenames and a short index can reduce filing errors.
Remote meetings or hearings still require identification, privacy, a stable connection and immediate access to the indexed bundle. Arrange interpretation where needed rather than relying on a relative to translate legal evidence informally.
Ajman property questions may extend beyond the family claim
Spouses may hold a home, tenancy, bank account or company interest in Ajman, Dubai, Sharjah or abroad. A divorce does not automatically convert every asset into joint property. Registered title, beneficial ownership, contractual rights, company structure, applicable law and the remedy requested all matter.
Build an asset schedule listing the legal owner, acquisition date, source of funds, debt, location and document reference. For a company, distinguish the shareholder’s shares from assets owned by the company. For real property, preserve the title or contract and financing evidence.
Some ownership or repayment disputes may require a separate civil or commercial claim. Coordinate that claim with the family proceedings so positions about title, contribution and valuation remain consistent. After judgment, another authority may still need to register or execute the result.
Foreign judgments require recognition before Ajman enforcement
An overseas divorce, custody or maintenance judgment is not automatically executable through the Ajman federal courts. Recognition analysis can include the foreign court’s competence, finality, proper notice, public order, absence of conflicting UAE decisions, translation and any applicable treaty.
Obtain the complete judgment and reasons, proof of finality or enforceability, and evidence of service. A foreign certificate that confirms divorce status may not contain executable financial or child terms.
Authentication may involve an apostille where the relevant convention route applies or consular legalisation, followed by UAE requirements and Arabic translation. Authentication confirms origin; it does not decide recognition.
If enforcement is sought abroad for an Ajman order, the destination country’s court will apply its own recognition rules. Prepare the UAE judgment, finality and service evidence, translations and any treaty certificates early.
Execution and appeal are separate from the first judgment
A favourable order may still require execution for unpaid support, delivery of documents, child contact or another obligation. Gather the operative judgment or executive deed, notification and enforceability details, payment ledger and precise breach evidence.
Assets or conduct outside Ajman may require coordination with another emirate or country. Identify the implementing authority for each item. Do not assume one federal execution request transfers every property or resolves a foreign asset.
For appeal, obtain the written judgment and notification record immediately. The available period and review route depend on the decision and current procedure. Identify the alleged error in jurisdiction, applicable law, evidence, procedure or relief instead of repeating the entire first-instance story.
An appeal may not suspend all enforcement automatically. Any request for a stay needs separate analysis.
What to send for an Ajman family-law review
Prepare:
- passports, Emirates IDs and current addresses;
- marriage and child birth certificates;
- nationality and religion information relevant to route selection;
- any marital agreement or foreign-law clause;
- a dated chronology and urgent deadline list;
- Family Guidance reference and proposals;
- all UAE and foreign filings, judgments and notices;
- proposed parenting, visitation and travel plans;
- income, housing, school, medical and expense evidence; and
- property, business, authentication and translation records where relevant.
State whether the next step is guidance, settlement, first filing, urgent protection, defence, appeal or execution. This allows the review to focus on the immediate decision.

Frequently asked questions
Does Ajman use the federal court system?
Yes. The official UAE Government portal identifies Ajman as an emirate following the federal judiciary, with Ministry of Justice services used for federal filings.
Can I file in Dubai if I live in Ajman but work in Dubai?
Work location alone does not decide family jurisdiction. Residence, the other party, children, claim and applicable procedural rules must be assessed.
Which law applies to a Muslim divorce in Ajman?
Federal Decree-Law No. 41 of 2024 is the current Personal Status Law, subject to its application provisions and the facts.
Is civil divorce available to non-Muslims in Ajman?
Qualifying non-Muslims may use the federal civil personal-status framework under Decree-Law No. 41 of 2022 and its regulation. Eligibility requires review.
Does Abu Dhabi Civil Family Court law apply in Ajman?
No automatic application arises. Abu Dhabi’s local civil-family framework is distinct from the federal civil regime available in qualifying Ajman cases.
What should I take to Family Guidance?
Bring identification, the marriage and child records, a short chronology, a supported financial schedule and practical settlement proposals.
Can a Family Guidance agreement be executed?
The Ministry states that agreements completed under the authorised federal regulation can have executive effect. Clear and lawful wording remains essential.
How does the court approach child custody?
The court applies the correct legal regime and considers the child’s interests and evidence. Custody, guardianship, residence and contact should be distinguished.
Can an Ajman court stop a child’s travel?
A proportionate protective measure may be available where jurisdiction, legal basis and reliable evidence show a specific risk.
Is there a fixed maintenance figure?
No universal figure applies. Entitlement, means, needs and supported housing, education and medical costs must be assessed under the governing law.
Are federal family cases conducted in English?
Federal court proceedings operate in Arabic. Foreign-language documents generally require accepted Arabic legal translation and may need authentication.
Can I submit my case electronically?
The Ministry of Justice provides federal e-filing and first-instance registration services. Current forms, access and fees should be confirmed on the official portal.
Will Ajman enforce my foreign divorce judgment automatically?
No. Recognition requires analysis of jurisdiction, finality, notice, public order, translation, authentication and any applicable treaty.
What if maintenance or contact terms are ignored?
Execution may be required. Keep the operative order, notification proof, accurate payment ledger or neutral child-contact record and breach evidence.
What should I upload with the inquiry form?
Upload identification, the marriage certificate, a concise chronology, any Family Guidance or case reference, and the current order, notice or urgent travel document.
